      In late August, I purchased a half yard of drain rock from Pacific Top Soils that was loaded into the bed of my truck with a loader piece of equipment. I asked the operator to be careful and also confirmed that he would not spill the rock over the edge of my bed and he confirmed that he would not. The operator confirmed that he would be careful and would make sure not to spill. He proceeded to not be careful and quickly dump all of the material from an unnecessarily high height above the cab, causing the rock to cascade over the edges of the cab and damage my paint. I noticed the damage and brought it to his attention, he proceeded to tell me that I needed to follow-up with a phone call with the office. I called the office that weekend and was not able to get a hold of anyone. Later on, I was able to get a hold of the office and they have said that because I did not file a report that day in person, they cannot help me. I have tried multiple teams to reach an agreeable resolution with Pacific Top Soils and they are refusing to cooperate. I would like to pursue compensation for the damages to my vehicle.

      *********** waited 6 days to call our office regarding some scratches on the tailgate of his truck, that he states were from having Drain Rock loaded at one of our locations.

       

      I have attached a picture of the signs we have posted on all of our offices making customers aware they are getting material loaded at their own risk.

      We have well trained employees working on the loaders, even so, materials can move, or bounce as they are being loaded into the bed of a truck or onto a trailer.  We spoke to ************ more than once and explained that we were not going to pay for repairs to the truck tailgate.

      I apologize that he does not like the outcome, it is our policy and we stand behind it.

      Good Morning - As we have previously discussed, your loader was not careful and proceeded to pour drain rock all over the exterior panels of my car causing damage as shown in the photos. I did not wait 6 days to make my first attempt at contacting your business, I was told by your loader to call the office and I did that weekend but was not able to get in touch with anyone.

      I am not trying to be difficult but feel that you your company should acknowledge and provide means of repairing the damage caused. It is quite clear from the photos that the damage I am explaining matches what is shown in the photo.
