    The paving project, including hot asphalt patches and full-surface sealcoating was completed at the end of Sep. 2024 across 3 days. We paid A1 Asphalt $10,409.10 for this ******* Dec. 2024, one of the patches showed failure along joints and throughout the whole surface (sinking, bowing, cracking). We reached out to A1 Asphalt via phone and email about 10 times over the next 3 months to reach consensus to resolve this issue. A1 Asphalt firmly holds that the damage is due to poor compaction of the backfilled trench over which they paved (please see attachment for further narrative of site conditions as well as additional reasons why this patch may have failed that are not due to poor compaction of the backfilled trench) and does not admit that their paving work, processes, and lack of site preparation, were the cause of the failure. We believe A1 Asphalt failed to deliver the work that they were paid for. A1 Asphalt is now no longer returning calls or emails from us.A1 Asphalt has not offered any solutions except to provide a new for-profit bid to replace the patch. This would mean we are paying twice for the same patch. The refund amount requested reflects the portion of the bid for the patch only, plus tax, as no other work completed by this contractor is being disputed at this time. We will only accept a replacement of work if it comes with a written 1-year guarantee of workmanship.I am filing this complaint on behalf of our ***********************.

    patch paving was completed  september 22 , 2024  for factoria station HOa    ***** ******

     

    we did estimate on 7/11/2024 and job was delayed due to sewer  which was not done till september *******

    scott  mccombs   was person of incharge of job from HOa ;when A 1 asphalt did  estimate to finishing of entire job

    8 feeet deep sewer was repaired by  other conctractor hired by HOA,    sewer contractor did all backfill and compaction of trench  in rainy season.

    scott  ******* called  september  ******* : stated sewer was done and they wanted hot patch done before cold season.  

    we went on spetember 22,204  patched with hot asphalt and compacted asphalt flush with existing asphalt .   new hot patch was  compacted down to flush with old asphalt.   

     

    on march 18,2025  ******* ****** called for 1 st time started conversation with accusation patch trench is failing due to asphalt. we have answered every call she has made and emails. on march 18,2025  she called 4-5 times in short period of time . he have tried to explain to lindsey  how compaction works, that due to poor compaction and backfill of 8 ft depth sewer trench is now settling its own because due poor compation and backifilling of wet material in trech.

    this is very standard failure of trenchs , due to being too deep and its sometime impossible for sewer conctractors to fully compact with out geotech lab testing in layer of material backfill and proper compaction test.. ******* has ingored to listen to me and she has lack knowelde how trechs fails.

     

    as i tried to expain ******* on mutiple phone conversation that this trech will continue to settle as we are getting to dryer season and that water level in trench dries up, material will compact its from gravity and will take  top surface such (asphalt , concrete ) to settle down also..   

    the best approach will be to dig down 7-8 feet material out and backfill with drycrushed gravel material and compact in 5-6 inches  layers of crushed gravel material  and compact with hoe attachment 

    we can not be hold accountable for subbase failure , trench failure due to poor compaction

    I am rejecting this response because:

    After consultation with multiple contractors who are experts in paving, it is clear that no hot asphalt patch should have been completed per the site conditions. All contractors that I have consulted with agree that a trench will settle, and that any professional paver would install a temporary cold patch, wait until at least the following summer, if not a full year, for settling to occur naturally, and then install a permanent hot patch. A1 Asphalt bid work that goes against best paving practices. They did not advise us against this course of action.

    In addition, all of the contractors that I consulted with agree that the corrective action to take now would be to wait until summer, then remove the existing patch down 6-8" and then reinstall the hot patch using best paving practices. Not a single professional I have consulted believes that excavating the entire trench is the right corrective action; in fact, suggesting excavation of the entire trench is blatantly the wrong course of action, as it uncompacts all of the soil which will lead to the same settling we are currently experiencing.

    A1 Asphalt should never have bid or completed this work as they did; it was guaranteed to fail. They are placing the blame on others when it was within their control to provide good work. I am still requesting a full refund for this work that failed.

    we did not work for ****** , nor she was ever in contact with usfor this job  . we worked for ***** and he was contact of person for this job.  ***** has made arrangement and sechduled the work ,  ***** was incharge of making call when to do the patch

     

    i dont see where lidnsey coming with all accusation against us  without having any contact with us while job was being performed

    I am rejecting this response because: The business is evading responsibility for performing work out of compliance with good business practices. Their reply is not relevant to the complaint filed.

    The work referenced in this complaint was completed for a homeowner's association, not an individual. I am filing this complaint on behalf of ************************** as noted previously.

    Our homeowner's association will escalate this issue outside of the BBB's system.

    Please find a letter from the ************************************ addressing our change in leadership. The contract in dispute with A1 Asphalt is between A1 Asphalt and the ************************************ with ***** ******* representing the Association and coordinating the work with the contractor. The contract was never with ***** ******* personally. As such, any representative from the ************************************ is qualified to deal with A1 Asphalt on behalf of the Association. Please let me know if that needs further clarification or documentation.
