******************************* was paid $2000 on 03/08/2022 for upholstery services she has never even started. On 01/03/2024 she backed out of job and said she'd gladly reimburse monies and has since gone silent. This is not the first time she's gone silent after receiving the money.Business Response

She was told almost one year ago that I can not do her sofa after May 2022. I have many emails to confirm this.
I had a back injury and no longer do heavy pieces.
I have agreed to deliver the fabric along with the balance to an adress that she can provide.
She agreed when I offered to deliver it with no problem. And due to below freezing temperatures and Monday Holiday My office was closed.
Durring weekend she emailed at least three times asking why I have "Ghosted" her and threatend to call the police! I am not open on weekends. I am attaching emails to confirm this to BBB.
The office has been closed the rest of that week due to below freezing weather and for Monday holiday.
First thing today (Turesday 1/16/24) I have a complaint in my emails for not responding.
I would be glad to deliver fabric she purchased and remaining balance at any time.

I am rejecting this response because:***************************** did not indicate last May that she could not physically do large pieces due to her accident/injury. She just indicated she couldn't "take it". She used the same paraphrasing previously when her schedule was full and she pushed the date out for my pieces. Beyond that if she couldn't do large pieces and is claiming she told me that then, then why not refund me THEN? OR February of last year when I attempted to deliver for services? And beyond that if you couldn't do large pieces anymore then why are you posting on your ******** business page not one but two large sofas that you did AFTER you claim you told me you couldn't??? There are so many instances of *******'s lying/inconsistencies...I can provide even more details and the ENTIRE email threads that completely corroborate ALL my claims.

Regarding her claim that I threatened her, absolutely false. Threaten by definition means, making or implying threats. I told her what I planned to do and did so, no threats, action. ******* will use any excuse to her favor, weather, holidays etc. While normally legitimate, she's reaching for an excuse. She can try to claim that but was actively posting to ******** the first time she "ghosted" me in January of 2023. I genuinely thought something had happened to her. She told me on Dec. 1st, ************************************************************************ around the 16th. I tried to contact her in vain for weeks starting January 14th-28th. Then I check ******** and see she's posting since the 17th-23rd of January 2023. I have the screen shots. She finally responds on January 30th indicating she had an accident/injury.
She said in her email on Wednesday January 10th 2024 she'd gladly drop of fabric/reimbursement. I respond the next morning with an address, time and window, Saturday January 13th 10-1. This is my brother in laws home and he had a repairman scheduled the same time. She never responded (ghosted) me again. So I have to assume she's coming at that window since I provided the address/window and have not heard that she WON'T since Thursday morning. Also note she claimed the weather was freezing, yes it was unusually cold, the repairman at my brother in laws house was working outside with his table saw, compressor and power tools all within that time frame. And what was ******* doing? She updated her ******** profile picture with a filtered photo on Saturday in that time frame. She knows her way around filters/********/posting and all that so she's getting my emails and choosing not to respond.
At this point I have no confidence that the fabric she supposedly ordered will be intact. She continues to conduct herself in a questionable manner which is why I provided the full email threads for complete transparency. I know it's lot to sift through. This has been going on almost two years but I also know I have been beyond courteous and accommodating. Her actions are suspect and continue to be as she's now claiming I'm threatening her.

Attached is an email.
As you can see, I have agreed to give her all the fabric ordered as well as the remaining unused balance of her deposit.
The fabric is still in it's original packaging.
All my emailing she has responded to have my signature which includes "All sales of fabrics are special order and non refundable."
This has been my policy thats been in place for years.
I will wait for BBB to notify me of the next step.

My shop is only open part time. After my injury I spend 1/2 time at my other home out of state.

We are now closing in on TWO YEARS that you've had $2000 of mine and haven't done anything for the job/monies you accepted. Literally every time I've contacted you to drop off the sofa you couldnt accommodate. When you contacted me to drop I told you (because I wasn't physically there) I'd arrange to have it dropped off and then nothing from you again...That's your MO and all documented in the email threads. I'VE ALWAYS SAID I'D ACCOMMODATE DROPPING OFF, YOU NEVER FOLLOWED UP. CHECK THE THREAD.
Then the total ghosting/zero communication twice and subsequent ** on your part that earned all my extra.
All the ** about how you can't do any "large" pieces anymore after your accident. YOU said in the email thread that you'd RECOVERED from the accident when I'd asked. Then all of a sudden you're claiming you can't do my pieces that you agreed to almost 2 years ago...AND that you'd told me that last May? Well *******, you DIDN'T say that. You said you couldn't "TAKE" them then. JUST LIKE YOU'VE SAID HOW MANY TIMES BEFORE...You used the same paraphrasing to communicate you couldn't take them IN THAT TIME FRAME, NOT that you couldn't PHYSICALLY take them. SO BE CLEAR ABOUT THAT, I AM and it's all documented.
So you want another approach to call out your **? IF you really couldn't take large pieces in May '23 THEN WHY DIDN'T YOU ATTEMPT TO REFUND THEN??? WHY WERE YOU STILL DOING "LARGE" PIECES AND SHOWCASING THEM ON YOUR ******** PAGE AFTER MAY '23??? Why? Because you're full of it. Just like ghosting/no communication while you post away on ********* You're being unprofessional AF and with a sense of entitlement with my money for almost two years now.
Like I said, I have ZERO faith that the fabric you said you ordered will be in pristine condition much less the fact that my monies would've been earning at least 5% annual interest. You even attempted to charge me for some **** foam *******. And then you want me to just accept the fabric and a check from you??? Without any accountability on your part ON TOP OF ALL YOUR ** about you can't "take it/or do large pieces". Why would I accept a check??? You've clearly shown you're unprofessional and untrustworthy. PILAU...to your core.
I'm prepared to go to small claims or whatever I need to do ******* because you are not taking any responsibility for all your ** and I've had it with you thinking you're just going to dictate how this plays out.

I have tried numerous time to offer the compaintant her refund. She will not accept anything but cash. Unsatisfied due to her not wanting to do this on the books. My hands are tied.

***************************** has again refused to refund monies and goods. She insists that her accountant will only issue a check for the amount owed which is less than $700. She employs the accountant, so instruct them to refund in cash... She's had my monies for 3 years now and has just returned from her "vacation" home. I asked for the refund in cash, why wouldn't I? I paid her a downpayment immediately 3 years ago. What's the issue with a cash refund when you're returning from your vacation home and have not done anything for 3 years with the monies I sent except order fabric that I've never even seen???
So now she says she'll see me in court...so be it.
All of this should be posted in detail for anyone even considering hiring her...unbelievably unprofessional, and a severe lack of integrity.
