      Date: October 18, 2023 Removal and Replacement of Driveway Apron.Amount paid: $4,404.69 Commitment: Contract included removal and replacement of apron concrete leading to street and replacement of 13 ft of curbing on the sides of the apron. Approx 251 Sq Ft of 6 concrete poured to meet city requirements. Brushed finish, Daily Cleanup, City inspection for approval of city requirements. Nature: Unacceptable workmanship of the job. This dispute is filed for items that include (1) Failure to complete the Contract as written, (2) Lack of communication, (3) Promises of fixing it in the spring, (4) Failure to meet the City Requirements as well as failing to have the City inspection required for the job in which it failed inspection, (5) $715.02 of damage to our sprinkler system.Attempt to Resolve: After months of promises and no results I have no faith in this company to work on my concrete needs ever again. I have hired a different accredited company to remove and replace the concrete apron that ***** Boyle, Sam the Concrete Man completed. ***** said he would fix the items that failed city inspection after September 23rd. These items only included the City Requirements that failed and did not address the aesthetic issues of the entire approach.

      Project was permitted and completed in 2023. Customer called in the inspector this year 2024 to re inspect the project and delivered a scope of work to fix his issues and a timeline to have the work completed. We agreed to do all the required work at no cost to the customer.  We gave the customer two large time slots throughout the summer that they responded to by saying those time wont work for us each time. The customer then sent a letter requesting a refund for the project to have someone else fix the work to which i replied we will not be accepting as we are able to complete the scope of work delivered by the inspector. 


      Stated in the signed paperwork - 
      We are not responsible for any buried sprinkler heads, lines, buried drains or any other subsurface items.
      Notice of any initial installation defects must be made within five days of job completion. 


      4. Remedy: If, within one year of the completion date of the concrete project, Client believes that the concrete project has developed ***** Cracking, ***** Scaling and Spalling or ***** Pop outs due to defective materials or workmanship. Client must send written notice of this to Sam The Concrete Man, within 90-days of the discovery, to invoke warranty action. Note that notification by text messaging does not constitute a written notice. After Sam The Concrete Man receives notification, the concrete project will be inspected by Sam The Concrete Man within 30-days. If the inspection determines that the ***** Cracking, ***** Scaling and Spalling or ***** Pop outs has occurred due to defective materials or workmanship, within one year of the completion date. The affected area of your concrete project will be repaired or replaced, or you will be refunded your payment for the portion that is considered defective work. In the case of defective materials: The warranty is limited to the warranty provided by the materials manufacturer. The expense of labor is not included in the materials warranty. Sam The Concrete Man will have the discretion to choose between repair, replacement, or refund as remedy.


      Written Letter via certified mail was delivered 30 days ago requesting refund.

       

      Don't like unhappy clients, we tried to remedy and were denied the opportunity, despite the issue being brought to ur attention after the 90 day period

      I am rejecting this response because:
      I am requesting a full refund.

      I am very disappointed in the concrete work.  The damage done on the original work is to costly for me to have the same damage made again by Sam the Concrete Man.  The contract included  13ft of curbing replaced, did not happen.  The contract states there will be a city inspection, this did not happen until I called them after ***** would not return my calls or text.  I have supporting documentation of these claims.  He never had it inspected.


      With this poor workmanship and communication failures I choose to NOT have *****, Sam the Concrete Man repair his errors.  I can not afford to fix the damages that will be the outcome of his fix that contractually he will not be held responsible for.

      Items in the contractors reply that are false:
      1. Original job was never inspected by the city.  Documentation exist to verify this statement.

      2. He did not give me 2 large time slots.  I have 28 logged phone and text requests of the project status with no answers.  May 23rd ***** communicated that he would have a start date next week and it should go quickly.  No start date was provided as he said.  May 29th, he stated that he was aiming for early July, again no dates were scheduled.  July 22nd, he txt How does the 30th work?  We were out of town.  That is 1 day provided for scheduling throughout the summer.  I sent a request for refund that he received on Aug 4th.  I txt him to ask his intentions of this request on Aug 12th.  He replied back that he could complete the work any Monday or Friday after Sept 23rd.  There were not 2 large time slots given.

      3.  I was also within the 90 day window of the poor workmanship as identified by the City Inspection Failure.  

      I am not a happy customer and will take additional actions if a refund result cannot be completed here.

      As stated, we are more than willing to correct this to the inspector requested specification. Client needs to coordinate a time for the fix to be done and we will do it.  Inspector told us how he would like it to be done to meet specs and we more then willing to do.

      Extremely disappointed.  I recently hired ***** Boyle, Sam The Concrete Man (Spokane) to replace the approach of my driveway and I am incredibly Disappointed with the results. The work was shoddy, the materials were subpar, and the company's customer service was atrocious.

      The driveway approach is uneven with very large cracks, scaling, and improper joint tooling and finish.  The edges were jagged and unfinished. Despite multiple attempts to address these issues, the company was unresponsive to rectify the problems. Sam The Concrete Man (*******) did NOT have the City of ******* inspect the finished job as required.  After requesting such, the inspection FAILED with no response or communication from the contractor.  Certified mail sent with request and still no response.

      The Contract was not fulfilled as written, documented promises to fix it in the spring with warmer weather were communicated then spring came and no calls or text of mine received a response.  Additionally, he caused major damage in excess of $700 to my sprinkle system, to which I've had to repair out of pocket. Read the Contract!  Avoid Sam The Concrete Man (Spokane) at all costs.

      Ive tried to remedy here with BBB with no resolve.  Thank you for your remediation attempt.  On to L&I, Bond, Insurance, Small Claims

      I will continue to NOT ACCEPT this businesses response unless it is a full refund.

      On April 4, 2024, we contracted with ***** Boyle of Boyle to Boyle, LLC, dba Sam the Concrete Man, to replace the sidewalk at our house at ***********************************************************************. The crew completed the work on Friday, June 7, 2003. The width of the sidewalk varies from 19 to 22 inbches--it's like looking in a funhouse mirror. The edges are ragged, and there are depressions where water pools when it rains. When made aware of these problems, the contractor did nothing to remedy them, and we have not had any communication from the contractor since.We want the contractor to return to our house and correct the defects in our sidewalk.
