So this business runs a fitness challenge where they charge you and entry fee of $249 if you are a member or $799 if you are not a member. The challenge is if you lose 6% body fat or 25lbs you enter to win $5000 for 1st place $2000 for 2nd place and $1000 for 3rd place, I happened to win 1st place back in June and the business refuses to pay me the price money apparently because they don't have the funds. And if you don't lose the lbs ir the % they keep your money. I've been triying to contact the ceo the managers every one and either the y levae me on read they tell me they can't pay me unless it's with services. I payed my entry fee they advertised a cash prize and they say they don't have the money and I know almost everyone that signs up losses their money to them and once you win they don't want to pay and just give out excuses. I've been waiting for them to fulfill the prize they promised since i got 1st place they made a *** **** about me winning and everything I only got one of those big checks they give out but that was it. They only refunded me 3 months of membership and want to give me the reminder of free membership wich i was planning on not renewing again because of this. I don't know what else to do since I'm only being ignored and given excuses over and over again. I pay $189 monthly and had to pay my $249 extra to join the challenge which they have several of them a year runs for 6 weeks they are always advertising a free 6 week challenge and when you go in it's not free you have to deposit $799 and if you win you get it back or not if you decide to sign up they discount it from your mebership and if you don't they keep ypur money. So they advertise free and not free at all they advertise cash prizes and they they want to pay you with service instead.Business Response

Mrs ******** is a member of our community and participated in the National Challenge hosted by our Franchisor.
The National Challenge has 2 levels to it. Our local level and the Franchise (National Level)
It is an extra-curricular event hosted in our gym used as an incentive to help our challengers get the next level of fitness. The entry fee is to pay for the extra level of service while we have the challenge time frame is happening. Mrs. ******** was given coaching, nutritional resources, and access to special events as a challenger. This was a service paid for, and only refunded if the personal goal was hit.
On a National Level, the franchisee (us) pay an entry fee to participate in the event and are given a chance to win up to $5000 in prizes.
There is no written agreement for either event.
Mrs ******** is a regular member of our gym, and can only be held to the terms of her agreement, as we can only be held to the terms of Washington state regulations and our agreements.
In her membership agreement, there is no term that prizes must be honored.
In the attachments is the flyers posted in our location for the last national challenge, where it does not specifically state what the prize would be (cash, services or goods)
This was all a verbal agreement.
We refunded Mrs. ******** her initial fee of $249 for the services paid. We offered her a cash portion, releasement of her further payments for the year, and a full year of services to our location. Equaling $5K,
This was not to Mrs. ********** liking.
On the National Level, we are not responsible for any payout.
On the Local level, there is no written agreement holding us responsible for any payout, however we took it upon ourselves to offer the $5000 in PRIZES.
We are happy to offer the full year in services for the remainder of her prize, but will not be offering anything else.Customer Answer

I am rejecting this response because: Even though they say it's not written anywhere that they would give the cash prize they made an event to announce the winners in the Fit Theorem premises that I was invited to. To inform me that I was the winner of the $5000 dollars cash not services, there was a lot of witnesses that saw that day what I won even if it was not I writing or whatever they say, so my question here is, is it a scam to get people to join the challenge or to get more clients in the door because I had to make social media posts everyday of the challenge to promote the business as I was required to do and had a lot of requirements that I completed every single one of them, so in this case I believe they are promoting something and delivering something else, they are deceiving us with other information as costumers. written or not they advertised something and they are wanting to deliver something else, it's not fair for past or future costumers.

Complaint against FitTheorem regarding their deceptive business practices and unfair policies.I recently participated in FitTheorem's 6-week challenge, only to discover that it is designed to be nearly impossible for most participants to meet. The marketing surrounding the challenge is misleading, creating unrealistic expectations for customers.Furthermore, I find their deposit policy to be highly unfair. The nonrefundable deposit is presented as fully refunded, coercing individuals into becoming members to avoid losing their money. This lack of transparency is both unethical and deceptive.Additionally, the agreement provided to customers fails to disclose the high likelihood of the program not delivering the promised results. This omission misrepresents the efficacy of the program and further contributes to the overall dissatisfaction of customers.I believe FitTheorem should be held accountable for these misleading practices, and I request your assistance in investigating this matter. ****** had signed up for our 6 week challenge. The challenge is 6 weeks of nutrition coaching, accountability coaching, and fitness classes. The agreement signed by ****** on the first day stipulates that she must lose 6% body fat from the starting weight, while following all other challenge requirements. ****** used our facility, took the nutrition materials, and received 6 weeks of accountability coaching. She did not meet the goal of losing 6% body fat, therefor did not qualify for the refund. This has been explained to ******, several times. She has a copy of her signed agreement.Customer Answer

As mentioned earlier, the deposit was initially communicated as refundable at the challenge's conclusion, and the goal was portrayed as easily achievable. Despite following instructions from my outstanding instructors, the goal was not attained, indicating a flaw in the program. Unfortunately, the agreement lacks provisions to acknowledge program failure, appearing one-sided and primarily designed to attract new clients.

We have an 85% success rate. We have had clients hit the goal in the first 3 weeks. It is in our personal experience that clients that do not meet the requirements did not follow our plan set up for them. Your agreement has been provided to your several times. The group that you particiatped in, 90% of the clients reached the goal of 6% or 25lbs.Business Response

I followed the plan as it was given to me and have demonstrated my progress and meal plan to my mentor. I have consistently attended the facility three times a week as required. The business advertised the challenge as free, only introducing the deposit requirement when meeting with instructors who are also trained in sales. Notably, no deposit was mentioned during our follow-up call before scheduling the meeting with instructors. The deposit amount significantly exceeds the membership fee for the 6-week period. Furthermore, there was no mention of the possibility of the program failing in the contract.Initial Complaint

Money taken out of my account when I had asked for a freeze on my account on August 28,2023. No communication with any upper management. Given the run around by Linda S**** in billing department. I was hospitalized at the time. I would not recommend this place to my worst enemy. I went in the *********** ** location because I saw an ad that was displaying Free 6 week Fitness Program. I was shown the facility but told that I had to either pay $600 upfront and be reimbursed after the 6 weeks or pay $367 for the 1st and last month cost for a membership and to participate in the 6 week challenge which was included in the $367 + $132 a month. The 6week challenge was supposed to start on 8/1/22. I called the facility to cancel the membership on 8/1/22 due to a sudden medical issue and was told to send an email to the corporate office. I did as instructed, never got a chance to attend any of the classes and was told that I could not get a refund. I was told by ******************* that a form needed to be filled out but I never received the form.. I Never Even Received Any Type of Cancelation Policies and Procedures when I signed up and I had no idea that I was going to have something a medical incident that would hinder me from being able to attend classes. I emailed them several times and received No Response. This CANNOT Be Legal. Please assist me in getting my refund
