      CAD homes tied into our retaining wall without permission. They knew they had no permission to do so. **** the owner of CAD Homes even confirmed they had no permission to tie into our wall yet continued anyway.

      The original wall extended beyond your property on to our property. It was discussed on site that we would tie into the wall and you were okay with that. Post on site discussion - you wanted a written agreement. You wrote up a written agreement that was not agreeable to us. The landscaping subcontractor installed a few rows of blocks tying into the wall at the property line contrary to instructions given to him not to tie into the wall, and we advised you that he was to repair the error, which he is going to do. The subcontractor will correct the error and return the wall to original condition since this was his mistake. The subcontractor is who you need to contact with any additional grievances in regard to the wall. If you'd like the landscaping subcontractor's contact information, please request it and I can provide it to you.

      I am rejecting this response because: We had a verbal agreement and you were in agreement with us putting it in writing. Once I went to the effort of putting it in writing you rejected it outright. I do not believe you acted in good faith and you were going to attach to our retaining wall with or without an agreement.

      It is not our responsibility to contact or deal with your subcontractor. I want you to live up to your verbal agreement which was put into writing.

      Additionally you stated that the wall would be returned by Friday April 14'th 2023. 

      Do not have your subcontractor come onto our property, we are currently getting estimates to repair the wall.

      Good Morning,

      We are sorry that we have created this inconvenience for you. While meeting onsite it was our understanding that we were under verbal agreeable about tying into the retaining wall. Our work on the retaining wall had commenced at this point. Later you suggested having a written agreement and we were receptive to having one put together. We suggested you draft something up. Upon review, we rejected your written agreement because it contained additional items outside the scope of the of our conversations pertaining to the retaining wall, therefor, we were unable to accept your written agreement. Once you informed us that we did not have permission to tie into the retaining wall, we instructed our subcontractor not to access your property, and only tie into the portion of your retaining wall that extended beyond your property line and onto our property. Unfortunately it seems like the subcontractor did not relay this information to his employees, and they added a couple of rows beyond the line against our instruction. Later, upon your instruction via email, we were told remove the blocks and return the property to the original state. We agreed to this and informed to performing subcontractor that this needed to be completed by 3/14/23. Our subcontractor failed to meet the deadline we had given them, but attempt in good faith yesterday to follow your request. Our contractors were onsite yesterday morning 4/19/23 and you instructed our project manager to get our subcontractors get off of your property, which we did as promptly as possible.

      I am rejecting this response because:

      We had a verbal agreement and wanted to put it in writing to ensure that we were all on the same page and had the same expectations. You rejected the written agreement outright; no changes or corrections were suggested.
      Because your outright rejection of the written agreement and you actions prior, during, and after the construction led me to believe that you were not intending to live up to the verbal agreement in any way whatsoever.


      Additionally, It was only after we started the BBB complaint that you sent your contractors to remove the blocks on our property.  This was after we clearly stated that we do not want to supervise or control you subcontractors, and that they had no permission to be on our property.


      If CAD home lives up to the agreement, we can resolve this issue. CAD homes is free to contact me outside the BBB to resolve this.
