I bought windows from Harley ********* in ******* WA, they offered 1 year interest free financing. With this bank. I was in the middle of looking for an investment property. As it turns out despite not being in arrears in any way they took a lien out on our house, this is their normal operating procedure for anything over 5k. They will not remove the lien unless someone pays the loan of 100%. So our year to pay is now due immediately. As an FYI, we have a perfect payment history and great credit. I would understand if this is something that they did to people with low credit history, but they are paying a lien filing charge for every person who takes out a loan with them. Honestly that is just bad business.

I ordered Windows through Harley ******** in March 2023. Their financing was through 1st Security Bank. In Feb 2024, I full paid the remaining amount due $9923. I then saw a charge of $15 on the website, I full paid that amount assuming it was remaining interest. Then last week I get a bill in the mail for $305. When I call to explain I had already full paid, I was told that a lien was filed on my house without my knowledge and that is the additional lien release fee. I was never told a lien would be filed nor that I would have to pay even more for a release. I never would have used their financing if that was the case. I have tried to call to get this resolved and they are rude and refuse to handle the issue. I shouldn't have to pay for this lien release when I wasn't even told about it. This bank as well as Harley ******** should be notifying customers if and when a lien will be filed and the fees associated.

On March 15, 2024 we have mailed out a letter addressing this complaint to the customer along with the copy of the loan agreement and account history addressing this complaint. We believe this complaint has been addressed.

      Customer Answer

      Date: 03/15/2024

      Complaint: 21381980

I am rejecting this response because:
Yes, the amounts I paid to pay off the loan were correct. However, No one once disclosed that there would be a lien filed for Using 1st Security Bank for our loan. We would have paid cash outright, had we known. We did not sign agreeing to additional charges after paying off the loan.

The lien should be released and we should not be held liable for a charge we were not informed of.

      Sincerely,

      *************************

Sales representatives approached my father *************************** from ******** to replace his roof. A new roof was not needed as the roof was under 10 years old that they took off. They made up issues to convince him. Once he realized they were pushing a gimmick on him he tried to cancel the roof and they told him no. My dad was diagnosed with Dementia and recently died on July 6, 2023. He was cognitively impaired when he signed the agreement and note for the new roof. He was in construction for over 25 years he would have known if his mind was right that they were charging him 4 times too much, $43K for a ***** square foot house. They took advantage of a cognitively impaired elderly man. They provided financing from an affiliate bank to him, (1st Security Bank) knowing that he would not live to pay all 180 $360 payments. They do this to target any living heirs (there is a clause in the attached loan documents on page 3) which is not initialed. This is elder abuse and it is sad that these people can even sleep at night.

Our mortgage company submitted a wire transfer for just over $11,000 in January 2022. The window replacement was completed in April 2022, the loan payments didn't begin until July 2022. It is now September 2022 and the funds from the wire transfer still have not been applied to our account. They have been charging us interest on the full $28,000 loan since it went into effect. I've called multiple times, the last call today with a supervisor that was rude and unhelpful. She advised me that these things take time and they don't have a timeframe to get back to me. I just have to sit back and wait for them to call with an update, which would likely not happen until next week. We should not have to make additional payments until they apply the full wire transfer amount to our account and credit the amount of the finance charges.
