I'm **** *******. On 6/4/24, I hired Quality Structures One, Inc. to build a post-frame building at *******************************************************************************, for a contract price of $85,978.09. They deviated from engineered plans, fell short of code, and used poor methods, jeopardizing structural integrity.Nails/fasteners: Used 10-***** nails instead of specified fasteners. Many boards are split, including girts/corbels, overhead door headers, and truss chords. Repairs are incomplete.Roof metal: Ordered short, improperly installed. Screws miss the purlins or are angled, relying on caulking. Leaks persist.Wall metal: Dented, with pronounced oil canning. Screws overtightened or under-engaged, washers loose, gaps up to 3/8".Insulation: No air gap, contrary to manufacturer guidance. Does not achieve R-value specified in construction documents.******* hangers: Installed with incorrect nails, some of which have rusted.Soffit: Not installed per *************************: Initial layout was off. Instead of re-pouring, they shifted posts, ignoring design flaws.Warranty: Meaningless given the inadequacy of the attempted fixes.Payment dispute: They filed a lien, accusing me of breach. However, parts of the building are incomplete as discussed above and therefore, per contract, payment for those is not due.Ive given QSO multiple opportunities to correct problems, but the building still leaks and has damaged, improperly secured components. I seek restitution for correction costs, removal of the lien, and reimbursement of professional fees. I need a building that meets code and follows the agreed plans.Business Response

We have addressed all of **** ******** concerns. Please See the attached inspection card and Engineer letter confirming any changes to engineering have been approved by the city and the Engineer. The only issue that has not been addressed is the bottom cord, which needs nails added, but Mr ******* told us not to correct it. We Warranty all our work, and if anything needs to be fixed or replaced, we are willing to do so as long as Mr ******* owns the building.
10 ***** nails were inadequate, and more nails were added per engineer-please see attached Letter.
Overhead door headers are installed per engineer plans.
The bottom Cord does need more nails. We will happily add it when Mr ******* allows the crew to be on site.
Corbel blocks were replaced and nailed per the engineer.
Roof Metal is installed correctly, and the ridge has neoprene closure per Mr ******** request. (Universal closure is a post-frame standard we have used for the past 35 years)
Any roof leaks Mr. ******* has brought to our attention have already been fixed, and boards have been added to purlins so that calking was not required.
The building is warranted as long as Mr. ******* owns the building, and we will fix any issues promptly.
All metal buildings always have a tiny amount of oil canning. There are no damaged sheets.
All wall sheets are installed per manufacturer.
Insulation is also installed per manufacturer guidelines. We have been doing this since 2006 when the solar was released. Please see the attachment. Also, the owner of the insulation company called Mr. ******* and assured him we had installed the insulation correctly. A flyer was also provided to Mr. ******* showing the insulation installed in the same building as his.
******* hangers were installed with none-Galvanized nails as per code and engineering plans. Only when nailing into treated material, do you use galvanized nails.
The soffit is a non-engineered item; the drawings are a crew reference guide. The soffit is installed per QSO design.
Site plan was approved by Mr. ******* before any digging happend. He later asked the crew to move the post for the OH door. He then changed his mind again and with ****,***** witnessing after concrete was poured. The post was moved per the request of ********** and his brother. Engineered and inspected, and approved by the county.
Mr. ******* is past due on his phase of the building the Metal that was installed on his building has yet to be paid for, and at the advice of ************************ he should not pay his bill. ************************ has engineered buildings for us in the past and has also provided letters he is now advising to Mr ******* are not okay. Mr. ******* also said he would not pay for the already installed and finished metal. Per Mr. ******** signed contract, he is now in breach of contract. We have liened his property due to lack of payment. We are always available to take care of any of our customers' concerns. Due to Mr. ******* refusing to pay his bill per ******** we are not aboligated to go into further lose of wages when a client said they will not pay there bill, we have moved the issue to our legal team, and Mr. ******* has been informed. We have had many meetings with Mr. ******** all fixes were his request, and he continues to move the goalpost. At this time, the building has passed all inspections. Our building is an Engineered structure there are no code viollations. We have passed all inspections per the county with the engineering provided. ****** engineering is giving his opionion to Mr. ******* on an Engineered adjustement we did per request of Mr. ******** That was approved by the county and inspected. We are willing to have another Meeting with Mr. ******* this Thursday but the conversations would need to be recorded due to Mr. ******* change he mind. or a third party person onsite. We would have no problem if Mr. ******* would like to have one of his builder friends onsite so that we can again explain and show changes to the building that have passed all inspections.Customer Answer

I am rejecting this response on each of the following points (These responses are on the advice of ****** Engineering):We have addressed all of **** ******** concerns. Please See the attached inspection card and Engineer letter confirming any changes to engineering have been approved by the city and our Engineer. - The issue here is not whether the county or their engineer approved changes. The issue is that the work was substandard,and the changes were not authorized by myself. Specifically, most of the changes were due to subpar work that the engineer was attempting to address. This is not acceptable.
The only issue that has not been addressed is the bottom cord, which needs nails added, but Mr ******* told us not to correct it. I did not say not to correct it. I have lost confidence in Quality Structures and wish the work to be done by another party and to be reimbursed for my extra cost.
We Warranty all our work, and if anything needs to be fixed or replaced, we are willing to do so as long as Mr ******* owns the building. At this point I do not place any value in the promised warranty. I do not have confidence that Quality Structures will make the proper corrections in a workmanship-like manner. Therefore,the warranty has no value.

The 10d nails were not per the original design of the original drawing and adding a bunch of additional nails to the conglomerate, although approved by the engineer for Quality Structures, was not approved by myself neither is it prudent. The addition of more nails has caused structural issues. My engineer, ************************, has inspected many of the failures that exist currently in direct violation of *** ******** which states, Nailing edge distances, end distances, and spacing shall be sufficient to prevent splitting of the wood. Currently the wood is split in many places.
Overhead door headers are installed per engineer plans. - As the nailing is, as stated in the item above, inadequate and/or unapproved, then it has not been installed correctly.
The bottom Cord does need more nails. We will happily add it when Mr ******* allows the crew to be on site. As addressed earlier, I have lost confidence in Quality Structures and wish the work to be done by another party and to be reimbursed for my extra cost.
Corbel blocks were replaced and nailed per the engineer. Per ****** Engineering, wherever the nails have split the block, it is in violation of the *** ******** as mentioned above. Just because it is done per the engineer does not mean it was approved by myself. Any nails that have split wood is in violation, I expect those blocks to be replaced.

Per ****** Engineering, this metal was ordered short and placed on the building incorrectly the first time. They then moved the metal (now with a bunch of holes already in it) down to attempt to compensate for Quality Structuress ordering and placement error. They tried to fix these holes that were created on the initial placement with extra lumber. The additional lumber was not approved by myself. Currently, the adding of the boards looks untidy and unprofessional. Other screws missed entirely,specifically some of these screws were installed at an angle with caulking added in the attempt to prevent leaking. This is inappropriate and unacceptable. It leaks and it will continue to have leaking problems until the caulking is not relied upon. Some of the top screws were placed less than from the edge of the steel in a manner that is not acceptable and doesnt meet industry standards. These attempts of correcting a serious mistake are completely unacceptable and the roof metal needs to be replaced. It is not appropriate to have a row of screws that do not land on the primary purlins with the attempt of stopping leaks in a brand new product. It is not appropriate to have to fix a leak with caulking on a new product.
The building is warranted as long as Mr. ******* owns the building, and we will fix any issues promptly. - As stated before, I do not have confidence that Quality Structures will make the proper corrections in a workmanship-like manner.
All metal buildings always have a tiny amount of oil canning. Per ****** Engineering, this is not necessarily true and the oil canning on this building is much greater than a tiny amount.
There are no damaged sheets. - Some of the sheets are damaged.
All wall sheets are installed per manufacturer. Per ****** Engineering, the sheets are not installed properly because the screws are either too tight or not tightened enough. In an attempt to fix the oil canning, Quality Structures has backed out some of the screws such that the neoprene washer is loose and or not even in contact with the metal. There are some gaps that are up to 3/8between the steel and the framing. This is not structurally adequate or acceptable.
Insulation is also installed per manufacturer guidelines. We have been doing this since 2006 when the solar was released. Please see the attachment. Also, the owner of the insulationcompany called Mr. ******* and assured him we had installed the insulation correctly. A flyer was also provided to Mr. ******* showing the insulation installed in the same building as his. I did receive a phone call from someone claiming to be with the insulation company but did not confirm or deny proper installation. He did tell me that the installation requires a small air gap (1/8 is enough). He sent me examples of proper installation. There is no air gap in my building. It is clear the Quality Structures did not install per manufacturers specifications.

Only when nailing into treated material, do you use galvanized nails.- Per ****** Engineering, if ***** nails exist, it is most likely due to moisture being introduced to the structure. It is expected that a new structure not have ***** nails.

The soffit is installed per *********** - Just because it is non engineered does not mean it does not need to be installed properly and should be installed per manufacturers instructions. Any poor workmanship needs to be corrected.
The post was moved per the request of ********** and his brother. Engineered and inspected, and approved by the county. When the foundation was first laid out, I noticed that it was in the wrong place. This would make the overhead door in the wrong place in relation to the other landmarks on my site. I made Quality Structures aware of this and expected them to move the entire layout to the appropriate placement on my site. They instead just moved the posts for the door, resulting in an offset of the overhead door in the endwall. I have requested them to put the door where it is supposed to be in the building and they have attempted to do this but have done so improperly, according to ****** Engineering. The posts for the door should have been removed and placed in the proper spot, not patched in with a silly fix from the engineer. The proposed fix is a ridiculous design and will not be accepted by myself. As my representative, ****** Engineering has inspected the as-built condition and has found it extremely wanting and advises that the footing be removed and a new post and footing placed in its spot.
********** is past due on his phase of the building, and at the advice of ************************, he should not pay his bill. - ************************ did not tell me not to pay the bill. What ************************ did say is that those parts of the building that require payment are not complete and therefore per contract are not due.
********** also said he would not pay for the already installed and finished metal. Per Mr. ******** signed contract, he is now in breach of contract. We have liened his property due to lack of payment. We have always been available to take care of any of our customers' concerns. Due to Mr. ******* refusing to pay his bill, we have moved the issue to our legal team, and Mr. ******* has been informed - I reject the idea of breach of contract as Quality Structures has not provided the building or building phases that was promised. In result of a lien on the property, this has become a legal issue me and I expect compensation for legal fees.
We have had many meetings with Mr. ******** all fixes were his request, and he continues to move the goalpost. I am willing to pay when the job is done properly to the agreed on specifications as contained in the contract and specifications of the drawings.
At this time, the building has passed all inspections. - It hasnt passed the final inspection or the inspections of myself or my engineer, ************************. The passing of prior county inspections is irrelevant. ****** Engineering has documented areas of poor quality, structural problems, and incorrect practices. I expect all items to be addressed and corrected so I can have a new building.
In addition, There are a couple of items that were not in the initial complaint:
Gravel for the concrete underlayment was dumped on the lawn instead of the gravel driveway. Reparations to the area will require removal of remaining gravel,prepping the area and replacing damaged soil and grass with sod. Trim on the north wall overhead door facia is damaged. Excessive soil was removed from building exterior to facilitate use of scissor lift.Attached is the response from ****** Engineering detailing the above.

As you can Mr ******* just keeps going back and forth with new and slightly different reasons to not pay per his outstanding Bill. We have meet many times with Mr ******* and he was there for all changes and approved them. please see page 3 secontion 11. If *** ******* refuses to meet and address his concerns we will let our legal team hangle this despute moving forward. We continue to stand by our work, and are more then willing to fix anything that is Wrong with Mr Gardners building.Customer Answer

I am rejecting this response because:The statement that I just keep going back and forth with new and slightly different reasons
is simply not true. The basic reasons for my dissatisfaction are clearly present although I
may have described them in various ways. Clearly, I have not approved of many changes
as indicated by Quality Structures. I absolutely want to meet and discuss how specifically
Quality Structures will address each of my concerns. If Quality Structures is ******* in
their desire to fix my building, then I suggest they start by addressing my top 3 issues:---1) The door post in question is a botched patch job at best and a ridiculous design. I
expect the post and its footing to be removed and replaced with a new post and footing.---2) Install the ************* product per manufacturers specifications.
---3) The roof metal, having been installed short and then moved, is now compromised and
unacceptable. I expect the metal to be replaced.These are only the first 3 items on my list.
Also, for your information, Ive got an email from **** ******* of ************* today
stating that they are waiting for clarification on girt nailing from the Engineer of Record. The
email says, As soon as we receive the clarification we can sign off on the frame and then
we would only have the final inspection left. Clearly, all inspection are not passed.
