    I contacted Got Floored because I needed new flooring in my home. I found a product online that I was interested in using, but the store did not have a sample in stock for me to evaluate. The owner requested I pay an $8k deposit (approx. 35% of the estimated project cost) upfront before he would order a material sample. I thought this was odd and felt pressured to pay since I needed to see the sample to keep the project moving forward. I paid the $8000 deposit on May 19, 2023. The owner did not provide written terms regarding the deposit nor did I sign anything other than the receipt.We were ultimately unable to secure the material sample I wanted. I spent five months attempting to find a suitable alternative material in his showroom but failed. I only continued working with this company for so long because they had my money.On October 21, 2023, I notified the owner that I would no longer be his customer and requested my deposit be refunded. No work had been done to my home nor had any product been ordered, so the deposit should be refunded in full.The owner replied the same day and agreed to refund my deposit but hasnt made good on that promise. To date (February 2, 2024), he has only paid back half the amount owed, in two separate payments which I received on December 15, 2023 and January 8, 2024. He said he was working to free up my money, implying that he already spent it. He does not consistently respond to messages. He has closed his storefront in ******* and said he was setting up a new location, but hasnt announced the new address.I sent a letter via certified mail on January 6, 2024 to his PO Box address requesting the remainder of my money be refunded by January 20, 2024. The owner signed the return receipt on January 25, 2024. He hasnt otherwise communicated with me. He still owes me $4000.

    I believe it's time for me to take legal action against this contractor by filing a claim against his bond. Should I inform him that I plan to do this, in case that makes him take action to resolve the issue before I begin the legal proceedings?

    We have worked out a payment plan. We have paid back ***** of the deposit with plans to pay the remaining balance. This customer has been updated and has agreed. This issue has been resolved.

    I would like to reopen my complaint, number ********. The status of this complaint was marked as "resolved" as the contractor made a promise of how to move forward to resolve the issue. Unfortunately, he has failed to meet the terms of this arrangement.
