      On 1/5/23, I entered into a contract with Evola Builds, LLC to (EB) install flooring, new cabinetry, and other work in my home (see provided files). On 3/22, I observed both painting issues (performed under a separate contract) and flooring issues including scratches and one piece of flooring that clearly was a different color. I was told at that time that these issues would be addressed as part of a punch list. In April, ******* Evola personally installed the hood piece of the kitchen cabinets upside down and when he discovered it he laughingly told me about it, like it was something funny. On 4/15, I noted damage to the piece due to it being installed upside down (nail holes, etc.). EBs response essentially was were doing a lot of work on your house, you should be happy. By 4/27, additional issues with the work were identified. It was clear that the flooring on the two sets of stairs had not been installed properly. They were falling apart and posed a significant safety issue. On 6/8, I again communicated this issue. Because EB was continuing to fail at installing the stair flooring, I visited the National Wood Flooring Associations website, found a companies in my area, and contacted two. One provided me with detailed instructions on how the flooring should be installed, which I provided to EB. They refuse to correct the stairs. EB has requested full payment. The safety risk cannot be understated. I cannot have visitors to my home for fear that they might fall on the stairs. The stair structure is not physically sound. A multiple layers posterboard-like material have been used to try to align the top of the risers with the stair above. The risers are not securely attached. Its a house built of cards. I need the stairs to be properly installed, so they are safe and look professional. There are a lot of other poorly done aspects of this project, but my main concern are the stairs.

      The client provided all materials for the work performed in her home. We informed her numerous times that if she provides the material, she inherits the responsibility of any issues with delivery, installation, defects, and warranty, as we have no relationship with the manufacturer or retailer of said items. Nor do we have a markup on said materials, this serves as the motivation for the client to supply but also comes with the aforementioned risks. We can't be expected to take on those risks without fair compensation in the form of a markup. The miscolored board was provided to us to use by the client. If it did not meet her standards, it should have been removed from the stock supplied to us. The stair nosing was supplied to us by the client. They are produced by Cali Bamboo, come without any instructions or requirements for installation, or supporting materials to be used in their installation. We attempted to install them multiple times (4) using three different methods, one which was "suggested" to us by a Cali representative (it did not work) and twice using a method that another flooring contractor suggested, which had mixed results. The recommendation she speaks of from the flooring contractor she spoke to requires the removal of the underlayment, a direct warranty violation of the manufacturer, and also suggested modifying the material, also a warranty issue. We can't be expected to perform actions that *** violate the manufacturer's warranty on the suggestion of a third-party recommendation.

      Ultimately, this product was provided to us by the client with no instructions on its installation by the manufacturer. They do not support their product, and because we did not supply it, we have no leverage in the matter. This leaves it to the client to resolve with the manufacturer/ supplier. The hood was installed incorrectly and was corrected as soon as this was discovered. The damage she describes are nail holes that attach trim to the hood, no different than the nail holes that are attaching the trim throughout the kitchen. They have all been filled per industry standards, her photos are prior to this being completed. The scratches to the flooring were corrected using the manufacturer's touch up kit, and the manufacturer's installation instructions state that scratches during installation are expected, and that is why they provide a touch up kit.

      No project is ever perfect, and in the grand scope of the work performed, this is a very small list of minor items that have already been resolved, outside of the issue with the stairs. Regarding the stairs, our position is that the client needs to go back to the manufacturer she ordered them from and resolve the issue with them. There is nothing more we can do based on the lack of installation instructions, materials, and support from the manufacturer. 

      It should also be noted that we offered, and she accepted, a 25% discount on a change order that amounted to $1834.84 to appease some of the frustration she had. We also have not charged her for the additional hours spent attempting to install the flawed product for the stairs that she supplied us with.
