    Signed a contract May 4, 2022 to rebuild my garage top deck and fix two known leaks. I gave them a check for $16,000 up front - to purchase the decking material and worker wages. Began removing old decking and rains started in late May. Extensive water damage to my garage. Many months of excuses, me being out of town, and them closing the business for a month due to health issues. Assured leaks were fixed in October. Gave them a check for $8,000 for continued progress. More rain and once again extensive damage to my garage. They finally asked a roofer to address the problem. Leaks finally fixed in late February and finally began laying new deck. But always another excuse - no materials, too wet, too dry, staff not paid, etc. This May, with the deck still not done and being fed a constant stream of excuses and lies, I told them that I would not be paying them any additional money as they had not delivered anything close to the value of the $24,000 I had already given them, let alone the remaining $8,000 from the contract. The contractor had stopped talking to me before then and was communicating through his brother. The contractor had been telling us since May 2022 that he had the materials, including the rails for the new deck. He was also a few boards short for completing the deck. He assured me he had them as well. He ordered everything through **** Lumber. I finally called **** Lumber and learned that he had NEVER ordered the rails or the extra decking. He had spent that $5,000+ on something else and had been lying to me for almost a year. He abruptly quit on May 10, 2023, even leaving all his tools. I have since hired a competent professional who completed the deck in two days. But, I had to pay for the railings and extra boards again. I am seeking $6563.97 for the needed materials, for damage to my garage, and other items I can provide you with if interested. From the second water damage to my garage in late October, I had workers only 36 of 191 days.
