The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On July 18, 2017, the State of Washington, through its Attorney General’s office, filed a Complaint for Injunctive and other Relief under the Consumer Protection Act in King County Superior Court against Blue Utopia LLC and Trace Anderson. The complaint alleges Blue Utopia LLC, a Seattle-based company offering campaign and non-profit fundraising services, failed to send all the donations it collected to its clients and used new donations to cover old debts to other campaigns. The lawsuit alleges these are unfair and deceptive practices in violation of state law. The office has identified at least two affected campaigns in Washington so far.
On July 20, 2017, the Attorney General’s Office obtained a temporary restraining order requiring the company to provide donations to the intended recipients in a timely fashion and in the proper amounts.
The complaint asks the court to order Anderson and Blue Utopia LLC to stop deceptive practices, provide restitution to affected clients and impose civil penalties of up to $2,000 per violation.
