This is a completely bogus complaint.  The Foundation Group is a real estate brokerage company.  Our brokers contact owners of real estate to find out if they are interested in  purchasing or selling additional properties.  The maker of this complaint, ************************* retained our services to sell two of his properties.  He signed exclusive listing agreements (CBA Forms created by the ********************************* which are the agreements that 99% of commercial brokers in **************** use.

*****, the broker that he retained to represent him on the sale.  He listed the property in question for 1.6 million dollars.  An aggressive list price.  After widely marketing the property including putting it in all the multiple listings, ***** procured him an offer (through another broker who was representing the Buyer) for the full asking price, 1.6 million dollars.  He sent it to ***** for his review.  ***** decided he wanted to accept the offer so he signed it and we went into contract for the same.  As part of the due diligence a buyer must perform, we must allow the Buyer's lender to inspect the property.  This property is 5 units.  On the day of the inspection two of the tenants have Covid so the lender could not enter the units.  Because of the short timeline the Buyer had to perform, they asked for a one week extension from *****, the Seller.  Once the lender grants approval, the Buyer waives their contingency and their deposit money becomes non refundable.

***** spoke with ***** and explained the situation.  ***** said he would approve the same so ***** prepared an Addendum granting the Buyer an additional week to their due diligence period.

It was 3 unit triplex (we had another property of his listed which I will get to.

***** sent ***** the one week extension in the form of an Addendum created by the Buyers Broker to the Purchase and Sale Agreement for him to approve via DocuSign.  ***** executed the one week extension.  Subsequent to this, ***** decided he no longer wished to sell the property.  Unfortunately there was a Purchase and Sale Agreement mutually executed by both parties and the Buyer said they would *** for performance (they would take ***** to court and the court would certainly order him to complete the sale).  There was absolutely nothing we could do.

After the above, ***** continued to say he would refuse to sign closing documents.  I explained he should think about it as they Buyers would surely *** and he would end ** in litigation.    He became agitated and you can see his complaint below.  All without merit.  I could send you the emails from him that I responded to.  He asked the same questions over and over and even today he wrote another scathing email asking for the same and threatening us with further action.

The other property we had listed (see his complaint) again, had a signed listing agreement.  Once it expired we pulled it off of all the marketing services.  I am at a complete loss regarding his claim that we continued to market it.

***** is an accredited property investor and is / was in the finance industry.  He understands contracts and the *** forms we use are easy to understand.  At the end of the day, he wants to blame us for not being able to cancel a contract that he himself signed.

If you want the emails or contracts, please let me know.  Thank you so very much for your time and efforts.
