I am submitting a complaint regarding my experience with Shefayoga Roosevelt. I purchased a set of four individual one-month memberships and three single-use class passes from them, which are clearly itemized on my receipt. After using only one month (for a total of three classes), I determined that the membership was not suitable for me. I then requested a refund for the three unused months and three unused class passes. (Also, the three class passes have since disappeared from my account on the MINDBODY portal which I have NOT used and should not have expired after a month). In my communication with the studio, their team claimed that my purchase was part of a "single package" and therefore non-refundable. However, when I initially purchased over the phone, it was explicitly explained that these were four individual monthly memberships, each set to expire individually upon usage. My receipt also reflects this, showing each month as a separate item, not a package.Their stated policy only restricts refunds for months that have already been used, which I respect. However, this policy should not extend to unused months or passes. Despite several attempts to communicate and a final email sent on October 28, 2024, the studio has not responded or provided any resolution.

      Business Response

In response the complaint, we worked with this customer for a tailored custom package.  We were going to sell her a 6 month membership which is at a discounted price.  She wanted to purchase it because her employer reimburses her for the membership up to only a certain amount.  Therefore, we custom made a 4 month package for her because that was the amount the employer would reimburse.  We do not have a 4 month membership.  Therefore we put our system 4 individual months at a discount to create her membership.  She came for one month, then returned stating she was no longer employed and the membership did not work for her and she wanted a refund of the 3 remaining months.  It was never our intention to give her 4 separate months, it was the only way to put it in our system.  Four separate months would have cost more.   She was reimbursed by her employer for this cost but yet she wants refund.  This does not seem fair and equitable.  It is also disappointing that we worked with her to her needs and then she goes to great lengths to get a refund and file a complaint.  If we were in error, I assure you, we would refund.  This is not an accurate complaint. I request the complaint be denied/removed.

Here this the contact log from my manager on 9/21:

      N. called in wanting to enroll in a special membership in order to use all of her wellness reimbursement benefit offered by her employer. I worked with her to craft a 4 month membership + 3 Class manager special, which was the closest way to reach her total benefit amount. Since we do not usually offer a 4 month membership, I enrolled her in 4 x 1 month memberships, and explained to her that each month, the expiration date of her membership would automatically update to the end of that month.

I am rejecting this response because:

their response misrepresents the terms of my purchase and introduces irrelevant factors. My receipt clearly itemizes four separate one-month memberships and three individual class passes, directly contradicting their claim that this was a custom package. The inability to reflect a custom package in their system is not my responsibility and does not change the terms as presented to me at the time of purchase. Furthermore, their mention of employer reimbursement is irrelevant to this dispute. How the purchase was funded does not ****** my right to a refund for unused services. Their refund policy explicitly states that refunds are not provided for used months, but it does not address or prohibit refunds for unused months or unused class passes. I am simply requesting a refund for services I paid for but did not use, which is both reasonable and consistent with their stated policy. Their refusal to issue this refund fails to meet basic consumer protection standards and ignores their obligation to honor the documented terms of the transaction.

      Sincerely,
