      ****** of transaction March 2024 - July 2024 2.Amount paid ***$107,000 3.What they committed to provide - The Golddiggers, *** committed to providing a waterline from the street to feed the sprinkler system that had just been installed inside the building. 4.Nature of dispute - When pricing the project, the **************, were given a set of plans that had been approved by the water district. Upon review the Golddiggers gave us a timeline of 30 days from approval of bid to completion of work. Almost immediately after the job was approved by us, the Golddiggers began altering the scope of work. We were told the approved plans were now "not going to work", and they had to be changed to accommodate their "new plan". They started calling the water district and insisting this option was better, and wanted them to accept the new plan. This new plan involved switching out the original underground "Vault" with a above ground "hotbox". When I discussed this change with the ******* his words were "I hope they approve the change it's going to be a lot easier". The change would remove the large 7ftx7ft concrete vault, which was being custom build with a aluminium top and replace it with a standard 2ft x 6ft above ground "safe-t-cover". I was told by Golddiggers, the original vault was being provided by *** CONCRETE out of *********. This is the main conflict. When I asked Golddiggers what the reduction in price would be he replied "nothing". Even though their ******* told me it would be a much easier process. I could not believe there was no difference in price, or labor. So - I called CUZ CONCRETE myself. The vault that was originally proposed was $17,643 (and at least 6-8 weeks for build). I also called SAFE T COVER, their above ground "300AL" which was ultimately used was $4545, and in stock.5.Golddiggers is still refusing to offer any explanation of the reduction in labor or materials. The timeline also cost us thousands in additional rent vs the 30days quoted,

      TO ALL FOR YOUR REVIEW WHAT MR ******* IS NOT TELLING YOU THAT HE DID HAVE A PERMIT FROM THE WATER DEPARTMENT BUT HE DIDNT HAVE THE NESSARY PERMITS FROM THE CITY OF ******* ALSO MR ******* IS NOT TELLING YOU THAT THE REASON FOR THE CHANGE IN THE ***** OF WORK WAS THERE WERE  POWER LINES AND GAS LINES SO CLOSE TOGEATHER THAT PREVENTED THE ***** FROM BEING INSTALLED PER THE PLANS AND HIS ENGINEER SAID TO MOVE THE LINES AT A HUGE COST AND DELAY TO MR ******* THIS IS THE REASON I HELPED MR ******* TO FIND A NEW ENGINEER TO GET HIS *** BACK ON TRACT THE REASON FOR MY BID TO CHANGE IN VALUE WAS WE PAID THE ENGINEERING COST HELPED HIM TO GET THE BONDS THAT WERE STILL NEEDED ALSO RIGHT OF WAY PERMITS AND TRAFFIC CONTROL PERMITS ALL THAT TAKES TIME TO RESOLVE WITH THE CITY IF WITH OUR YEARS OF EXPERIENCE TO HELP HIM SOLVE THE PROBLEMS HE WOULD OF HAD TO GO INTO A WHOLE NEW PLAN REVIEW NOW FROM THE TIME THAT WE WERE TOLD THE *** WAS PERMITED AND FINALLY GETTING ALL THE RIGHT PERMITS IT TOOK SEVERAL WEEKS THAT HAD GONE BY  WHEN WE FINALLY GOT ALL THE PERMITS AND STARTED THE *** IT ONLY TOOK US A LITTLE OVER 30 DAYS TO COMPLETE THE *** ALSO THE REASON FOR NOT GIVING A DISCOUNT FOR THE TWO ITEMS WAS BEFORE WE HAD STARTED THE WORK MR ******* ASKED ABOUT A DISCOUNT AND I TOLD HIM THAT THE PRICE WOULD STAY THE SAME AND THE REASON FOR THAT WAS THE ***** OF WORK HAD CHANGED THERE WERE TREES TO REMOVE FROM THE SITE THAT HE WAS TO REMOVE BUT IT WOULD BE QUICKER IF WE DID IT BEING WE HAD HEAVY EQUIPMENT ON SITE ON STAND BY ALSO TRAFIC CONTROL A WATER SERVICE TO CONNECT, CURB REMOVAL AND REPLACEMENT RETAINING **** REMOVAL EXTRA DIRT TO REMOVE FROM THE **** REMOVAL BOTTOM LINE IS MR ******* FROM DAY ONE ACTED LIKE HE WAS A CONTRACTOR DOING THIS WORK BUT WAS THE END CONSUMER ADDING ANOTHER REASON FOR US TO CHARGE SALES TAX TO THE TOTAL OF MY BID OVER ALL MR ******* HAS SENT A PAYMENT SCHEDULED PAYMENT AGREEMENT THAT WAS PER HIS TERMS AND HE IS NOT FOLLOWING UP TO HIS TERMS AND NOW HES BEHIND ON THIS AND LOOKING FOR REASONS NOT TO PAY FOR THE WORK WE PERFORMED HE IS NOW IN BUSINESS AND WE BELLIVE DOING GOOD BUT I'M STILL WAITING TO RECIEVE PAYMENT FOR THIS WORK ALSO WE HAVE PAID ALL MY SUBS AND SUPPLIERS FOR THIS ***! AGAIN STILL WAITING FOR PAYMENT

      I am rejecting this response because:Our main question, and concern, from our original statement is still not being answered by the contractor. We are simply looking for an explanation on how the price of the job would not be reduced when going from a almost $20,000 vault to a $5,000 hotbox, and how the large reduction in labor would also not affect the bottom line.  The on-site ******* mentioned that it would be a much easier process for everyone using the hotbox.  Its this process where the conflict arose. In response to our questions, theres been vague communication about permits, traffic control plans, bonds, tree removal, and retaining walls. The traffic control plan was approved by the city before the work started, the Right-of-way permit required specific questions that needed to be filled out by the on-site contractor before final approval.  The small cherry tree that needed to be removed was uprooted by the contractor after their suggestion to do so, with the understanding we would remove the debris. Which would have been done, had the crew left the debris behind. There was also a small retaining wall that was built without any communication. To summarize, there were a number of items that changed during construction and nothing was communicated with a change order of any kind. We still understand theres an outstanding balance, and hope we can come to a resolution of some kind.  However, without adequate explanation of the major changes to the scope of work its difficult rationalizing providing more than the $107,000 that has already been paid.
