On September 6, 2024 myself, my son and daughter-in-law closed on a $535,000 house at ******************************************************************************************. As part of the transaction, Vista Title and Escrow was to pay off three of our creditors. They paid off two. They did not pay off a **************** personal loan with a balance of $1403.96 The escrow company paid only one installment of $163.11. Manager ***** ******* tells me it was an accident that they paid the wrong amount and the remainder of the $1403.96 was refunded by check to my son and daughter-in-law. I asked them about the refund check and they said ***** had told them the refund was for the property taxes that we should not have been charged for. What person in charge of making these payments could possibly believe a loan payoff of $163.11 sounds plausible. The statement from **************** clearly stated $1403.96 was the total due. Also, my closing documents from escrow state $1404 is earmarked for ****************. As a former news reporter, I told Ms ******* this whole thing sounds like a case of employee theft, but now I think it's a company theft. I am attaching an escrow closing document that shows the company earmarked $1404 for ****************, and I am attaching the ** statement ***** relied on. I also have a thread of emails that detail the conversation between ***** and myself if you would like to read it, I can forward it to you. Thank you.

Good Day, and thank you so much.

Im writing to let you know my case against Vista Title has been resolved. **** from the company called me today to say, Yes, errors have been made and we will pay off the loan.

I told **** I appreciated his investigation and I thanked him for calling me with the results.

I failed to ask **** if the pay off would be $1240.89. Thats what I believe I am owed. I only mention this because at this point I have made additional payments on the loan, so that needs to be taken into consideration.

    Good Morning,

Im writing with an update on complaint  ******** against Vista Title & Escrow in ***********

Three weeks ago I emailed saying the complaint had been resolved. It was not.

Rather than pay off the **************** personal loan in its entirety, the company waited until I had made more payments and then paid off the lower remaining balance.

Vista Title was obligated to pay $1240.89. They paid $628.67.  I am now owed $612.22. Attached is the bank document showing the payment made by Vista Title.

I had a hunch this would happen.

Thank you for hearing me out.

    Sincerely,
    **** Zanakis

    Business Response

    Date: 12/02/2024

Vista Title issued a check to ********************* in the amount of $1,240.89, this was the additional amount that was to be paid per the lender's instructions.  I've attached a copy of the check that cleared our bank for documentation  The total payment of $1,404 to **************** now has us in compliance with the lender's instructions for this closing.

I just left **** a voice mail to call me to confirm that her credit card has been credited for this additional amount.  The check cleared our bank on November 22nd.  I'm not sure what **** is referring to as for the $628.67 amount, but I'm sure we can get clarity once I talk with her.

Let me know if you have further questions on this matter.

    Sinceely,

    ****** *****
