      Looker got asphalt into my sewer when paving my driveway and will not reimburse the money spent to fix it

      The customer sent us an invoice for $7,000 dollars months after the completion of the asphalt paving work, claiming that at rooter service found asphalt in the sewer clean-out. The customer claims that the ********************** clogged their sewer line, and that they needed to hire the rooter company because it was an emergency. Looker Asphalt does not dispute that their was asphalt in the sewer line, nor that the customer was in an emergency situation. We agree with both claims. We do, however, dispute that it was any fault of our company or our process that allowed asphalt to enter the line. We have paved hundreds of driveways and other projects where we come into direct contact with sewer/septic clean-outs. Our process never changes. 100% of the time, the septic company will put a lid/cap on the septic clean-out which prevents any material from entering the line. This is the first line of protection. The second line of protection is an iron, clean-out cover that protects the septic pipe and allows vehicles to drive over the top. 100% of the time, we simply manually raise the iron cover to be flush with the final grade of asphalt. We never take the iron cover complete off and check to see that the septic clean-out has been properly capped, because we never want the plastic sewer/septic pipe to be exposed and unprotected from the paving machinery and equipment. 100% of the past projects we've used this exact process and have never had asphalt enter a septic/sewer line, because in every case a clean-out is capped correctly by the installer of the system. Also, the clean-out was found to be completely intact and undamaged by the rooter company. 

      With this being said and understanding there is no possible way our asphalt could enter a properly capped, undamaged clean-out, we still felt very bad for the customer. It was around the holiday season, and we knew it was not the fault of the customer that they incurred this expense. Therefore, we very generously offered to send them a check for $3,500 to help get them through December, and they could pursue the septic/sewer contractor for more damages.  It is also very possible that a chunk of asphalt could have been placed in the clean-out between the time we finished the job and the months it took for a problem in the sewer to occur. If the asphalt entered the clean-out the day we paved, how did it take months to block the line? 

      A week or so after we made the offer for $3,500 was declined by one of the homeowners, the other homeowner contacted us and asked if we would reconsider the offer, stating the other homeowner can be very stubborn and difficult to deal with. We declined because the homeowner threated both a legal battle, as well as a smear campaign on the BBB, ************ Reviews and ********* They have done exactly that, even though they have offered any rational explanation of how asphalt entered their sewer line other that the one we have presented. Their only response is "it is asphalt in the line so we are coming after the asphalt paver".  We respectfully submit that, if a roofing contractor does not properly cap a roof vent, you cannot simply blame the rain for water entering the vent. 

      We feel we have been very sympathetic and generous in our response to this situation, and that the homeowners are being vindictive in there pursuit to smear the name of an honest and hardworking company.
