      I engaged with **** at Affordable Container back in April of 2023. We negotiated a new container with the understanding that I would eventually purchase the container. We had set up the delivery for April 20th 2023 but the business never responded after I sent the information. I ended up reaching back out and set up a date for the following week. The driver then had the wrong address and was clear across town. Fast forward, after the many asking me to pay a pick up fee that they never disclosed would be added to the drop off, knowing I would be purchasing, I had to decide when I would want to purchase. Due to my health and lay offs, I was a little preoccupied but made many attempts to email and discuss with **** how to get the invoice for the purchase price and get that settled. At one point he sent me an estimate for a new container for about $3,200. In March of 2024, I asked for it to be resent multiple times, nothing. I mailed letters with payments with notes indicating I wanted to purchase and the payments are to be applied to that balance. I heard nothing back for months until today July 3rd from ******. Claiming the account is past due and that the payment is due and threatening escalation. I emailed back everything I had emailed before with all the details. Still, no invoice attached and to make matters worse, Kelsea, included a line to tell me that is was miscommunication, when they refused to communicate, and stated that she would not send me an invoice for the purchase of the container until payment is made. I am very confused by this. I emailed my response that I would not and will not make any payments without an invoice. The company is not responsive at all, they went an entire year with never responding to single communication I sent, but cashed my payments.

      Thank you for reaching out to us regarding the concerns about the rental payments and the purchase price of the equipment ********************* is currently renting from Affordable Storage Containers, Inc. 

      We understand that ************ believes her rental payments should be applied towards the purchase price of the equipment. However, we would like to clarify our rental agreement terms to ensure there is no further misunderstanding. 

      Stated in Section 2 of the rental agreement: 

      Soul ownership of all equipment rented or leased will remain property of Affordable Storage Containers unless both parties mutually agree on the sale of the said container.

      Monthly rental payments will not apply to the purchase of said Container. 

      Our records indicate that ************ entered into a rental agreement with Affordable Storage Containers on May 1st 2023. Below, there is an attached copy of the rental agreement ************ signed electronically. This agreement outlines the terms and conditions of the rental, including the payment structure and the purpose of the rental payments.

      It is important to note the following points from the agreement:

      1.  Rental Payments: The payments ************ has made since May 1, 2023 are specifically designated as rental payments. These payments cover the use of the equipment for the duration specified in the rental agreement ************ signed.

      2.  Purchase Option: The rental agreement does not include a clause that allows for rental payments to be applied towards the purchase price of the equipment. Any intention to purchase the equipment would require a separate agreement or arrangement. 

      3.  Delivery and Pick up Charges: In our rental agreement, it clearly states that the delivery and pick up fees are charged up front and at the beginning of the rental term that ************ signed. As communicated to ************, if she does move forward with the purchase of the container, we would not charge her a pickup fee as that is no longer a service we would be providing. 

      After ************ started sending us emails stating her payments she was sending in were to be applied to the purchase price of the container we became concerned. In the event we sell a rental container, we require the full balance of the container cost to be paid upfront. We do not finance or offer lease to own options for any of our customers.

      In the event that a rental customer would like to purchase the container that they are renting, we require the payment for the container in full. This is something that we have attempted to communicate with ************ several times. Attached below are two email threads of correspondence first with **** and then later with ******. 

      We have provided all of the information included in this letter to ************ on several occasions. Kelsea provided ************ a Sales Order on July 10, 2024 detailing the specifics of moving forward with the purchase of the **** 521667-1 container that is currently in **************** possession per Ms. ***** request. This form is attached below as well. As it stands, we are waiting for ************ to make the $2,700 payment for purchase of the container she has been renting from us. ************ has not communicated with any member of our staff indicating the payment method she plans to use or when she intends on paying the $2,700 rental buyout price that has been provided to her. Again, we do not offer payment plans and have not offer this type of payment method to *************. If she would like to purchase the container she needs to pay the buyout amount in full. Until she brings in a cashiers check for the full buyout amount, this container will remain a rental container. 

      We strive to maintain transparency and fairness in all our business dealings. Our rental agreements are designed to clearly outline the obligations and rights of both parties involved. If there was any confusion or miscommunication regarding the terms of the rental agreement, we sincerely apologize for any inconvenience it may have caused.
