    3/16/2025 project start date $2739.45 total paid Acoustic Wall Paneling installation in *********** Project and optional Primary Bedroom Wainscoting Project CM Wallpaper installer requested 30% down $1092.11 total for both projects. Installer did not do a complete job on the *********** Project, so we called off the Primary Bedroom Project and asked for him to focus on correcting issues with *********** install. Installer suspended all forms of communication with us. Here is breakdown of funds spent and what we are owed that I have sent to installer with no response back:We paid:$1,564.45 - 30% down $225.00 - extra material $950.00 - office job finish He owes us $967.45. (******* deposit minus $597 material that he paid on his own)20% - $190 for hiring someone to fix & finish wall paneling and drywall damage caused by his accident ***************.$1157.45 owes us total

    My contract clearly states that all deposits are forfeited if client cancels the work.

     

    By accepting this estimate, you {the client} certify that you understand that you are personally/individually responsible for payment of the services rendered. You further certify that you understand if full payment is not received by the due date, interest will be charged at the rate of 20% or $20 per what is greater per day until the balance is paid in full. If the account is greater than 30 days old, CM Wallpaper reserves the right to turn the account over to an attorney for collections at which point you would be responsible for all collection costs including reasonable attorney's fees. Furthermore, *********** ****** holds no responsibility for the finished product if he is not provided with a quality product that he believes can be installed properly. It is the responsibility of **** **** to provide a product of reasonable quality so as *********** ****** can preform the installation in the best possible manor, resulting in a finished product that meets expectations . *********** ****** is only required to communicate this to the client verbally and will only proceed with the install per client orders. This eliminates CM Wallpaper from any liability resulting in concerns with the quality of the finished product. Furthermore, "You and we agree to submit any dispute arising under this agreement, with the exception of disputes alleging criminal or statutory violations, to binding arbitration in accordance with the BBB Rules of Binding Arbitration (Pre-Dispute). A volunteer BBB arbitrator will render a decision that the arbitrator considers to be fair; in doing so, the arbitrator is not required to apply legal principles. The arbitrator's decision will be final and binding on both you and us, and judgment on the decision may be entered in any court having jurisdiction. All administrative fees for the arbitration will be paid by the business. Further information about BBB arbitration may be obtained by contacting BBB Great West + Pacific at ************. This Agreement to Arbitrate affects important legal rights. Neither of us will be able to go to court for disputes that must be arbitrated. You also agree that any deposits paid prior to the start or completion of the work outlined in this estimate shall be forfeited and non-refundable if the client chooses to decline the agreement after such agreement is approved by the client and any and all outstanding deposits are paid by such client. CM Wallpaper will not be held liable for and damage to the clients property that the client willfully left within the area where the work was to be preformed, when such items can be removed for said area prior to CM Wallpaper performing the work. NEITHER OF US WILL BE COMMITTED BY THE ***** OF THIS AGREEMENT TO ARBITRATE UNLESS YOU SIGN BELOW, IN WHICH EVENT WE WILL BOTH BE COMMITTED.

    I am rejecting this response because:

    I did not sign any contract that stated I would forfeit deposit.   The contract and deposit was for 2 different projects.  We proceeded with the first project that was not completed to our satisfaction and because of that we informed CM Wallpaper that we do not want his services for the second project.   The unsatisfactory work was not due to the material provided or the work space.   CM Wallpaper even strongly recommended the product that we went with.   I have already proceeded with taking CM Wallpaper to small claims court and have a June 30th, 2025 date scheduled.  The **************************** will be serving him.
