    Seasonally Living, based in *********, **********, is harassing ** to pay a $6,141.47 "debt" that we do not owe. ***********************, owner of Seasonally Living, and my husband, ***** Stoner, negotiated the construction of a retaining wall at our home, near the pool they installed for us; they then came to an oral agreement to build the retaining wall for $10,5k. At that time, **** never mentioned to ***** that the price could then be increased if they incorrectly measured the retaining wall.Then, instead of sending the quote to ***** to sign, Seasonally Living sent me (Shelby ************************ the quote to sign (not *****), despite the fact that I had no part in making that oral agreement or contract with ****. When Seasonally Living sent the 3/8/22, quote to sign, they gave the quote of $10,578.75, but they included language (without telling ***** or me) that they could increase the price of the retaining wall, apparently by any amount, if they measured the retaining height length or height incorrectly. We agreed to pay the $10,5k and I signed the quote (not *****, who negotiated the contract).Then, Seasonally Living wanted more money than the $10,5k we had already agreed to pay the company. After negotiations, in total, we paid Seasonally Living about $12k for the retaining wall (about $1,5k more than what they originally quoted us on 5/8/22). This 5/11/22, agreement and payment superseded the 3/8/22 quote (which is likely invalid anyways on account of the fraud committed on us).After we paid $12k total for the retaining wall by May 2022, in or around August 2022, we were notified that we still had a $5k balance on our account for the retaining wall. We explained to Seasonally Living we paid all amounts due under the contract, that they did not mis-measure the retaining wall. We never heard back from them for about a year. Then, Seasonally Living turned us into a debt collection agency in August 2023 for more than $6k.

    Our company was contracted to build a retaining wall and the customers were quoted a price per square foot. They were invoiced for the amount measured. We offered to lower the amount and settle the balance and they did not respond to the offer. The balance remained open in on their account for a year with no attempt from them to settle it. Attached is the signed quote. They have not reached out to our office to settle, not attempted to contact us one time. We would be open to discussion but attempts to collect have gone ignored by them.

    I am rejecting this response because the response of the company, Underdog Innovations d.b.a. Seasonally Living, is largely based on falsehoods. First, we (the customers) were never quoted "a price per square foot." We were quoted about $10,500 total to build a 300-square-foot retaining wall. We paid that amount in full and more (we paid about $13k total for the retaining wall). See Estimate No. 188 attached.

    Second, we were not invoiced for the amount measured. The retaining wall today measures at less than 300 square feet. ***********'s employee measured the retaining wall to be less than 300 square feet. Yet, the company maintains that the retaining wall is somehow 50% larger at 445 square feet. We explained this to the company, but they never responded. See emails with Seasonally Living attached.

    Third, the company falsely states the company "offered to lower the amount and settle the balance and [we] did not respond to the offer." *********** never offered to lower the amount (and thus we did not respond to such a non-offer). Again, the attached emails with Seasonally Living easily disproves this.

    Fourth, the company falsely states "the balance remained open in on their account for a year with no attempt from [us] to settle it." Again, false. We told them in August 2022 that we have paid them all amounts due under the agreement (Estimate No. 188) and more -- as we ultimately overpaid by about $2.5k or $13k for a retaining wall that was supposed to cost $10.5k. Indeed, on May 20, 2023, the Company showed us having a positive account balance on our account of $1,375.95 because we overpaid by that amount, even according to the company. See Invoice # **** attached. We explained this to the company in August 2022. We never heard back from the company for more than a year. Instead, the company sent us into a debt collector in or around August 2023 for the alleged "balance" on our account. See emails attached.

    Fifth, the company falsely states "[we] have not reached out to our office to settle, not attempted to contact us one time. [***********] would be open to discussion but attempts to collect have gone ignored by [us]." Again, false. In August 2022, we explained to the company that we paid more than $12k for a 300-square-foot retaining wall (it was actually more than $13k); and that their measurement of 445 square feet was incorrect. We explained that both their employee's measurements and ****** Maps demonstrate that the retaining wall is actually less than 300 square feet (and no where near 445 square feet). We received no response from the company in August 2022. Instead, the owners, **** and *******************************, waited more than a year to turn us into the debt collector in or around August 2023. See emails attached.

    I think there is a misunderstanding with the homeowner. Underdog Innovations is not the company that did the work on their job. **** and ******************************* are not the owners of the company that did the work on their job. Stone Masters Inc. DBA Seasonally Living is the company and contractors of this job. And we have reached out to the homeowner. Via phone calls and emails. This contract was signed, the homeowner clearly explained what they wanted and the work was executed.

    I am rejecting this response because the business continues to provide BBB blatant falsehoods. As the ********** ********** of ******* website unambiguously shows, the business doing business as (******) "Seasonally Living" in Washington is registered with the corporation Underdog **************** (UBI 604-990-624). That company, Underdog Innovations ****** Seasonally Living, is owned by ******************************* (President) and *********************** (Vice President) according to both the ********** of ******* website and the Washington Secretary of State website.  To be sure, the homeowners entered a contract with (and have only ever interacted with) ******** and ***********************, who hold themselves out to be the owners and managers of the company ****** Seasonally Living. Accordingly, ******** and *********************** are either misrepresenting their ownership of the company ****** Seasonally Living to BBB or to state agencies, the latter of which is subject to penalty of perjury.

    It is clear that ******** and *********************** are attempting to hide behind legal entities owned by them and/or their parents, e.g., Stone Masters, **** ****** Chim Chimney Fireplace & Spa, Chim Chimney Fireplace, Pool & Spa, and previously Seasonally Living, owned by *** and *************************. Even assuming that ******** and *********************** did not own the company ****** Seasonally Living before November 2022, they have managed and operated Seasonally Living since at least 2021 and are closely associated with Stone Masters, ****, which previously owned the ****** Seasonally Living (from June 2020 to November 2022). To the extent that Stone Masters, **** is also responsible for ******** and *************************** false representations that they owned and operated Seasonally Living since 2021 and for ********'s and ****'s unlawful actions taken against the homeowners, then this company too is liable.  BBB and the Washington AG's office should not permit these business owners to hide behind their respective legal entities to escape liability for their dishonest business practices and other unlawful conduct.

    Finally, despite the company's false representations otherwise, no one from the company has contacted the homeowners since August 2022, when ******** and *********************** attempted to extort an additional $5,000 from the homeowners (for a portion of retaining wall that doesn't exist) in exchange for repairing a leak in the homeowners' pool that the company ****** Seasonally Living had finished installing just a couple months

    The company that Seasonally Living's representatives believe is responsible for **** and *************************' unlawful actions taken against homeowners, Stone Masters, ***** has been administratively dissolved since August 2023. This is apparently why Seasonally Living representatives want Stone Masters to be liable for ******** and ****'s conduct, as opposed to the company that **** and ******** own, Underdog Innovations d.b.a. Seasonally Living.

    I purchased a fireplace, and the moving of an existing fireplace on Oct 12, 2022 from this company. They completed this work. An additional contract was made on May 23, 2023 to have a chimney cap and chase manufactured and installed prior to the fire-off. I paid partial for this of $999 on May 23. They were supposed to measure for this *********. They came out to install it on June 8, 2023 and it did not fit. They said they would have to make another one and come out again. On June 8, 2023, they charged my credit card for the remainder of the contract $358.66. I did not authorize this payment. Today is August 9th and this job is not complete. I have been into their store numerous times, I have called and left messages, I have used their customer portal to try to communicate with them and still, nothing is complete. This work is required for final inspection by the county. I have had to contract with another company at substantially higher cost to get the work done. I want an explanation of what is going on and I want my money back for the chase cap and installation. There may also be water damage to the inside of the chimney box, we dont know yet.

    During September of 2021 we spoke with a company doing business as Seasonally Living aka Chim Chimney to have a pool installed in our backyard. They are an installer of *********** fiberglass pools. We discussed the location of the pool, an automatic pool cover, a patio cover, additional concrete and restoration of our irrigation systems. The owners ******** and **** indicated that they would be able to do all the work for us. Work began in May 2022 and been an extremely painful process with poor workmanship, lack of communication and unfinished work. We have paid $85,585 to date and have a remaining balance of approximately $13,000. Much of work cannot be redone without taking the pool and concrete out and starting from scratch. The workers that they sent out were inexperienced, left their garbage (pizza boxes, soda cans) they were inconsistent and inconsiderate. One of them was clearly on drugs. I want the pool that I was promised and paid for and I want to warn anyone else considering doing business with them.

    We understand some of the frustration that is mentioned in this. We do know that based on our contracts we will fulfill what was documented and we have already made a few repairs based on the customer request. Customer was even given an in store credit which they had no problem using. We will continue to work with this customer to repair anything that was incorrect based on the signed documents we have. We have proven we will do what we have said going above and beyond even before getting paid by the customer. We will again continue to stand behind what we have contracted to do.

    I am rejecting this response because:Although they have addressed a few of the issues there is still a list that has been outstanding for months. A list of issues was provided in August and the only issues that were addressed at that time were clean up. Some of the issues remaining are structural and integral to the design and aesthetic of the work being done. Potential leaks, bowing off the sides, unlevel and unfinished, the rail position was not installed the way it was requested. What is contracted is one doing is well is another. We have paid at the completion of every phase when requested. The store credit was provided months ago when there was still a promise that the work would be completed.So yes we did use it but to my knowledge there were no strings attached to that store credit. Additionally, their mistakes and lack of communication has cost us extra time and money. They had agreed to do a patio cover for us yet failed to pour footing or provide a plan. When it became clear that they were not willing or capable of building the cover we found someone else which meant we had to pay for them to cut out the brand new concrete to put in footings. There has been extra cost to us due to their delays with the pool cover required multiple trips by the electrician which has cost us out of pocket. Im not trying to be a pain, I believe we were very patient and understanding for the last 6+ months that this has been going on. The response from them seems inadequate to address the issues. We feel that we were sold a dream and they deliver a nightmare.

    We had never agreed to anything in writing to build a patio cover. So we would not prep for that. We have stood behind any work that was done or redone to this point. We encourage all to refer to the singed agreements for clarification. We will continue to stand behind the install. But we never committed to building a dream.

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution has been resolved after 9 plus months, finally received a refund of the amount I paid.  Very dissatisfied with this business and how they can continuously do this to other customers.  I'm thankful that I am one of the lucky ones that got my money back....unlike so many of the other customers whom received a faulty product that the business doesn't stand behind.

    Paid $6400. (Owe approximately $6500.) For a hot tub in Feb 2022. Was told it would be here in April.then May.then June.then in mid September they told be that I would have it before the end of the month. October 9th and still no hot tub. No return phone calls. I have to literally call, let the phone ring 20 time, then call back and start the process again before I get a person to answer the phone. This business was called Chim Chimney in ********* **********, then they switched there name to Seasonal Living. **************** *****. Id like a resolution. I have friends that ordered tubs after me, and they have been enjoying their tubs for a couple months..while I patiently wait. They are crooks and I want it reported.

    Customer has been offered an explanation and we are working to resolve this issue. customer is always welcome to call during our business hours or visit itn person we dont control the manufacture so we are at their mercy for production. We have seen many things speed up but we still are regularly seeing long delay still as a result of COVID.
