    Breach of contact. I hired Qolos to complete a website for me. I paid $10,055 to him and now the site is about 1/2 done and he is stating he needs more money as he ran out of hours. This seems to be a scam of his, that he does often

    Dear BBB Team Member,
    This letter is in response to the complaint filed against QOLOS **** regarding services rendered under a time and material contract entered into on January 26, 2024. The payment made by the customer constituted a non-refundable retainer fee to secure our contracted services, as clearly stipulated in the agreement.
    Attached, please find the following documents:
    - The signed contract.
    - The hours report detailing the hours utilized under the time and material terms.
    - A document outlining the completed tasks, including additional work not specified in the original contract.

    QOLOS **** has diligently fulfilled all contracted tasks from the statement of work and performed additional work requested by the customer. According to the terms of the contract, this project does not qualify for a refund, as the work was completed in full compliance with the agreement.
    Furthermore, the customer owes an additional $4,250 for tasks such as logo creation, which were explicitly defined in the contract as requiring additional fees, and the doll wall feature requested by the customer.
    Additionally, we are providing a text message from the client acknowledging that the hours covered under the time and material contract have been exhausted and requesting QOLOS to continue working without further compensation.

    The results of our team's efforts can be viewed at ******************************. Whether this website meets the terms of the contract is a matter for the courts to decide, however, our response is that these claims are baseless and absent of facts. QOLOS, Inc. is confident in our position. Should the courts be involved, we believe they will not only find in our favor regarding the execution of the contract but also determine that the customer is in breach of contract for the additional costs incurred beyond the retainer fee.
