      I was a previous student of **** that had a very bad experience with racial discrimination from other students and some staff. I have been recently trying to enroll into a different school and require an unofficial transcript from the **** so that I may enroll into the new school, but they refuse to give me any form of proof of classes completed. I was given financial aid and student loans for the school year when I attended **** and I was kicked out of the school after I had medical reasons for missing class. Now **** is saying I have a balance with them even though I did not complete the whole years program with them and they received my full financial aid and loans for the year. I now owe the loans and **** is trying to charge me apart from what I have to pay from the federal loans. I have been trying to get any form of proof of classes I completed at **** and every time I call or go into the school the administrators refuse to even talk to me. I am always told **** is busy or not in the office. While my time at ****, she was always available and now I have not been able to speak to her or retrieve any sort of information of my classes completed so that I can start the new school with financial aid. I need either an unofficial transcript or something that shows the classes I completed. My new school is not requiring that it be official, but **** continues to deny any form of information I can provide to my new school. I would also like the discrimination and review of so called charges to addressed. I provided the school with medical records for missed days and they still chose to drop me from the program.

      We are writing in response to complaint ID ******** submitted by ******* ******* with regard to her enrollment as a student at VICI Beauty School. The Complainant appears to raise several issues in her complaint, so we will attempt to address them each. We have made multiple attempts to explain these issues to both the Complainant and her mother without success and we greatly appreciate the assistance of the BBB in this matter.


      First, please refer to the attached **** ******* Contract & Refund, you can see that the Complainant signed her enrollment contract with the school on January 18, 2023. Please note the yellow highlighted sections of the contract which state that a student may have their enrollment terminated as a result of not maintaining satisfactory progress in academics or attendance. In addition, school policies related to tardiness,absences, termination and other rules are outlined in the school catalog, and that failure to abide by these policies and rules may result in termination.Finally, please note that just above the Complainants signature is her acknowledgment that she had received a copy of the school catalog that was incorporated into the contract. We should note here that both our enrollment contract and our student catalog have been approved by both the State of ******************************************************** (****) and the *********************************************************** (******).


      The Complainant had significant attendance issues while enrolled in school. Please refer to the attached **** ******* Apex Notes,Attendance & **** 62, which is a month-by-month accounting of the nearly five months in which the Complainant was enrolled. Each day highlighted in orange is either an absence, tardy or left early. By the date of the Complainants enrollment termination, she had accumulated ***** absence hours,the equivalent of over 23 school days. Her attendance percentage was 76.9% out of a required 90%. The schools attendance policy can be found on the attached **** ******* School Policies. The school allows 160 hours of what are essentially absence hours before a student would go over their contracted hours, as found in the **** ******* Contract & Refund, highlighted in green. The Complainant exceeded this amount with little more than a third of the program completed. Please refer to the attached **** ******* Apex Notes,Attendance & **** 62, which is a complete printout of the schools written note history of the Complainant. There you will see all the times the Complainant was tardy or no call, no showed. There are nine separate occasions where school staff met with the Complainant to counsel her on her attendance.Please refer to the attached **** ******* Counselling, where you will find documentation signed by the Complainant acknowledging these and ***************** sessions, fourteen in all.


      The last page in the ******* Counselling PDF is a Student Monthly Attendance Counselling Form dated June 1, 2023, in which the Complainant is placed on Final Warning Status. This means that the student is not allowed to have any absences or tardies whatsoever during the month of June. Up to the date of her termination, the Complainant had four unexcused absences and four tardies. The Complainants enrollment was terminated on June *******, in accordance with published school policies.


      The Complainant had the right to Appeal her termination,which she did. A hearing was held on July 12, 2023, before the Appeal Board,comprised of three non-VICI Beauty School employees. The Board unanimously agreed to uphold the termination, please refer to the attached **** ******* Termination & Appeal, which is copies of the termination and appeal documents. In her complaint to the BBB, the Complainant stated that, I provided the school with medical records for missed days and they still chose to drop me from the program. This statement is patently false. As you can see from the appeal documents, the Complainant provided two medical excuses, one for June 2nd and one for June 28th, which was after the date of her termination.She had no documentation for the previous three months, the remaining three days in June, or the four tardies in June. However, please note that the schools written policy does not allow for a student who is on Final Notice to have an absence excused by a doctors note.


      Next, the Complainant states that the school will not release her transcripts. The schools policy as published in the school catalog and made part of the enrollment catalog is that transcripts will not be released until the student has satisfied all their financial obligations to the school. The schools transcript policy can be found on the attached **** ******* School Policies. This has been explained repeatedly to the both the Complainant and her mother. The Complainant is currently in collections for the balance due of $6,870.49, a balance that she has not made any payments on since her termination.
      Lastly, the Complainant make a claim of racial discrimination, from other students and some staff. This claim is completely unsubstantiated and has not been raised by the Complainant prior to her BBB complaint. There is no mention of discrimination in the detailed ******* Apex Notes, there are no written complaints in the student file. At no time has the Complainant identified who these alleged other students and some staffmay be. This appears to be a fabricated claim to ****** sympathy from the BBB and has no basis in fact. There can be no investigation without substantive details,which the Complainant has not provided. The Complainant if now time-barred by the 300-day time limit of both the **** and Title VII for filing a discrimination claim.


      The school terminated the Complainant appropriately within its published policies and procedures. The schools refund policy, as printed on the enrollment contract and in the school catalog, is virtually identical to the **** Refund Standard attached as **** ******* Apex Notes, Attendance & **** 62PS Refund Standard, and the Complainants refund was calculated in full compliance with ****, ****** and US Department of Education standards. Copies of the refund documents are included in the attached **** ******* Contract & Refund.


      This complaint is entirely without merit and the school looks forward to an appropriate review from the BBB. Thank you for your time and consideration.
