In May of 2023 we took my sons 16 ****** WRX STI to *****. He went over the car and gave us a quote to fix the blown motor. In June of 2023 I paid ***** 4130 to order parts. ***** kept telling us the car was being fixed and was almost done and he was just waiting on a few parts to finish it. My son grew concerned & went to ******. After demanding to see his motor he found the car was in pieces still and had never been started and parts were never ordered. He said he was waiting on money from other jobs to start my sons car. Where did my 4130 go? He spent the money on other projects which was fraud and never ordered any of the parts for my sons car. This is fraud. The lady that works on cars told my son ***** does this & tells people things have been started when they haven't. Now other things are starting to go wrong with the car because it his just been sitting for a year & a half. The rotors are rusted & shot along with the brakes and other things. Today 8 28 24 my son went to check on the car again. It is still sitting in pieces not started and more things have gone wrong. This business is a fraud and needs to be investigated. There is no reason why the car isn't done by now. ***** will not return calls or emails or messages no matter how many times weve contacted him. He is trying to get more money for parts even though parts werent ordered & he should still have the 4130 he was already paid. This is ridiculous. We want our money, the car and all the parts including the motor back otherwise I will be filing a lawsuit against him.

      Business Response

      Date: 09/13/2024

Dear ****** B:  This is the response to the complaint filed with the Better Business Bureau.

Our company does not dispute the fact that the ****** WRX STI listed in the complaint has been at our shop for an unusual amount of time. We also acknowledge receiving a deposit from *** ****** (pronounced moo-sil) mother about a month after the car was brought to our shop in *****************  We were moving into our new shop that month of May and the transition into the new shop took a couple of months.

We also acknowledge that *** ***** has been very patient pertaining to the ********* rebuild project. This Better Business Bureau case is the first direct request for a refund from *** ****** either verbally, or in writing.
When **************** arrived, it had been completely torn apart. Almost every nut, bolt, and other parts of the engine were disassembled from the previous shop, and randomly organized in boxes. The previous shop was the former ********************* in **********. They referred *** ***** to us. We did start work on *** ****** engine and sorting parts, evaluating the damaged components and washing the salvageable parts. Damage to the engine was more extensive than we initially budgeted for in our initial conversations with the customer. We did provide a general repair budget to *** ******* mother who was concerned that her son would blow the engine for the third time and wanted to keep the motor stock. Our budget was based on those requirements and our point of contact initially was *** ****** mother.

In the next month the project requirements started to change, as *** ***** requested numerous upgrades to prep the motor for future racing.  These upgrades included racing rods, pistons, hardened crankshaft, ARP head bolts studs, plus additional equipment outside of the standard factory build. This change in request led to approximately $4500 in additional parts to be added to the total build. The original parts deposit included a credit card fee so we were at least $4500 short on our parts budget.

As I attempted to gather parts for this project some parts were on back order or being affected by the lingering effects of supply and logistics shortages of the pandemic. We did send messages back and forth to *** ***** who was concerned about the slipping timeline. Our mistake, that we readily own, is that we thought we could cover the costs for the additional parts for this project, but our business ran into cash flow problems due to the additional expenses of the new facility. I would assume any other shop would require at least half of the total project cost up front, which would have been closer to $7000-$8000. This is not unusual given the general clientele of these types of builds.
Embarrassingly, months slipped by and we started receiving surprise drop in visits after hours and weekends regarding the motor build from *** ***** and his girlfriend. ****** our motor builder, in another after hours visit, who is not part of managing finances, indicated to *** ***** that she was waiting on parts and we take deposits and don't do the work. This is not true, and ***** has no oversight into financial management of our business. When she was asked about this, she had no other example of such a situation and stated that her frustration with *** ****** project and stress over the surprise visits caused her to come up with something.

I have asked ***** to gather, prep, and package *** ***** parts. Im in the process of returning parts purchased (which I have invoices for) for *** ****** project and will fully refund *** ****** deposit.  After inspecting *** ****** car, we will service *** ****** rotors and pads. We did not observe any additional damage from the engine build delay we did observe the date stamping on the tires as being from 2021 and they appear to be in the same condition as when the car was delivered to us.  When we are servicing the **** brake we will have an independent tire shop inspect the tires and provide us with a condition report.  If the tires were damaged by our shop we will replace the tires with comparable snow tires.

      Customer Answer

      Date: 09/16/2024

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I do want my full refund back plus the car and all the parts that were originally dropped off with it. We do NOT want ***** doing any repairs on the car for the brakes or tires. He can either supply us with new parts or reimburse us along with the deposit. The snow tires were brand new and put on a few weeks before the motor blew which was January of 23'. He also needs to supply a new negative battery cable as they somehow melted it by short circuiting the battery somehow. Hopefully he didn't fry the computer or any electronics in the car. We won't know until its fixed correctly.

My son did show up for visits because as I stated we got worried about the car when we couldn't get a return call, message or email from ***** until I called and left a voicemail threatening a lawsuit. So he was aware I wanted my money back. Also his website states he is open until 7pm and on Saturdays so my son showed up during open hours.

The estimate he supplied is also fake. I was never provided a copy of that estimate, only the original that was sent to me. My son also never ordered racing parts for the car. ***** told us in the beginning if the car was going to be used to race he wouldn't take on the job. Either way he couldn't handle the job and should have never accepted it. My son just wanted stronger parts so the motor would be more stable this time. Those costs were figured in to the first estimate.

There are so many other lies in his response that I am not going to waste time responding to them all. It just proves more what a fraudster he is. My son is NOT the one filing the complaint. I am as its my car also. I paid the deposit for the parts as well. Which parts were never ordered because anytime my son has been to the shop they couldn't show proof of parts or invoices. Invoices can easily be doctored just as the estimate he sent was.

In closing, I want my full deposit back of $4130 plus reimbursement for the brake pads, rotors and the negative battery cable. The car and all the parts including the keys need to be returned to us. As we work during the week we will be picking the car up on Saturday September 21st by 11am. ***** needs to be at the shop with the keys, parts and a valid cashier's check or money order for the reimbursement of the deposit and parts and tires. New, the snow tires were over $1000 and will be dry rotted from sitting as they are not supposed to be left on in weather over 40 degrees.

      Regards,

      ****** *****
