**** of *** stopped at my house regarding tornado damage. He asked if I received money I stated yes he said I need to sign this form to talk to my insurance company because the insurance company should be paying for way more than they did and thats what *** does so its no stress on homeowners. I signed form 7/27/2024 and got the cashiers check dated August 1st. The paperwork stated i put it down that day which is false and therefore voids anything tying me to anything now known as a contract because by the time they even received the payment 3 days had been already over with and i had never been in a tornado ever and have a 83 year old mother and disabled daughter and grandson which was so overwhelming that this down payment considering absolutely nothing has been done nor bought nor setup appointment be returned but **** is saying too bad you can cancel but no money coming back even though *** broke contract initially. Now i cant sleep, Im going back into depression severely and I want nothing to do with this company.

Dear ***** ***** and Better Business Bureau,

Thank you for bringing this matter to our attention. At Martindale Pinnacle Construction, we take pride in providing professional and reliable services to our customers, especially when it comes to sensitive projects involving insurance claims. It seems there has been some misunderstanding regarding our role as the chosen contractor for your insurance claim. We want to clarify that as a general contracting business, we work closely with both clients and insurance companies to ensure the work is done according to approved standards and within the scope of the claim. Our goal is to provide transparent and efficient service from start to finish. Unfortunately, due to insurance taking their time approving the scope of loss, you requested we cancel the process.

We understand how stressful dealing with insurance claims can be, and we want to make sure you feel comfortable and informed throughout the project. If there were any delays or miscommunication in the process, we sincerely apologize. We are here to work with you and the insurance company to ensure that the project is completed to your satisfaction and in accordance with the terms of your claim.

Per MPC contract, termination of a project is subject to a fee equal to 25% of contracted price.

Please feel free to reach out to our office directly at ************ or *********************************** so we can discuss this matter further and ensure your concerns are fully addressed. Thank you again for bringing this to our attention. We look forward to resolving this matter.

Sincerely, **** Martindale Owner/Manager Martindale Pinnacle Construction

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear

The response from *** is just trying to pass the buck per se because the only thing they worried about was my down payment. They didnt do any additional work that my insurance company requested at all. Then **** stated they ( who is they) had me on schedule to put my fence done at least for the $5,000. They got but nobody in my area number 1 has me down anywhere and most importantly I never approved any fencing type or company to put the fence up and on top of that in order to do my fence you would have to have my backyard marked from diggers hotline and a permit taken out nothing. Therefore how can he charge me fees for something he never did. Also according to Wisconsin state code the contractor has to give me in bold font a 3 day cancellation with both our signatures and a carbon copy. My notice is in small print that you dont even recognize and doesnt pass Wisconsin guidelines at all. *** took advantage of a disabled, elderly woman in a national disaster and I just want my $5,000. Refunded so i can get my work done. Hes done nothing but get my money then nothing.

      Regards,

      ***** *****

All this hes only the contractor is *******. You have to respond to my insurance company and the person that did that was no longer working for them. I just want $5,000. You think you can just take that kind of money from people and just say oh well. No especially not an elderly and disabled. Thats a crime. Please just issue me my money back.

I have MPC do my roofing and siding after storm damage in 2023. Recently I had a major window leak. I have hired a person to fix the leak. They had advised me that problem with window leak is due to improper siding installation. They had also advised me to see if *** had closed building permit as they believed that *** would have not passed the inspection due to a lot of items missing and improper installation. Upon checking I discovered that they indeed did not close the permit. I have contacted the city of Minneapolis building inspector to conduct the inspection. They did so on 7/31/2024 and found problems. Theyve been trying to reach to *** to correct these problems. In meantime I have reached to *** and spoke to **** (owner I believe). Hes been very unhelpful and unwilling to honor their workmanship guarantee and thus far has ignored Citys email/phone calls trying to resolve permit issues. When fixing the leak we also discovered some sheathing getting dark and moldy and if not addressed in timely fashion can result in further damage and mold growth.

We have talked with the customer and sent a different crew out to inspect the property due to the original subcontractor ***************** not responding to our calls/texts. Customer stated there was a water leak coming in from one of the windows and a repair had already been done. *** did not repair any windows 2 years ago when this project was completed. *** was hired to replace roof, siding, and gutters. There has also been another significant hailstorm in that area since MPC finished work. We see the window seals get broken all the time during storms and if not replaced will result in leaks.

Entered into contract with Martindale Pinnacle Construction, LLC to have our roof replaced due to damages from the May hail storm. Contract signed by both parties on 8/2/22 and check in amount of $1,500.00 was provided to company. Second check in amount of $2,854.72 was provided to company on 8/4/22. Company had issue obtaining materials, materials were obtained and delivered to our house approximately 9/9/22. Company went to City of Stillwater to pull roofing permit and was denied because they do not have ********* required lead certification for working on homes built after ****. We were told they would look into this and they could not perform any work until they obtained lead certification, or they would be fined $30,000.00 per day. A week later, after asking, we were told the regional manager could not attend course and it had to be the general contractor who is the company owner. They were working to get him certified. Another week later, on 9/28/22 we were told the ** is "too busy" and won't be taking the class and our options are either: "We can set you up with our *********************** to complete the roof (no company name or info was provided), or we won't be able to complete the work. I contacted them the next day 9/29/22 and informed them we have met all our obligations of the contract and if they fail to perform and meet their end of the contract obligations then then contract must be cancelled. Later that date I received an email from ******************* stating "This email is to serve the purpose as a cancellation of contract. The contract between **** and *********************** and MPC is no longer in effect." Since 9/29/22 we have been awaiting refund of our $4,354.72 paid to them which was promised in full and was to be delivered 9/30/22 by ******************* between 4:30 and 6:00. At 5:55 I received an email from their company that no money will be refunded until they have a company come and pick up the roofing materials and a date is unknown when that will take place.

Hello! I am sorry your experience with MPC has been less than stellar. Unfortunately, this has been the busiest season yet for us and our owner was not able to obtain the certification for your home. The certification is meant for homes that were built prior to ****. MPC plans to take this course during our slower season, so this problem never occurs again in *********. Your home was the first time we've run into this certification, and we learn something new every year. I apologize for your home being the example for us, and I hope that you can understand we worked hard on your claim to get full coverage (and succeeded) but couldn't fulfil the build due to this obstacle.

ABC supply picked up the material today (10-6-2022) at 9AM. Your money is absolutely going to be returned to you, just as *** promised. We tried to offer you a solution by recommending a company that had the certification, but we understand if you have found other options. MPC wishes you the best of luck and although we couldn't complete the build, we are thankful for the opportunity to work for your full coverage.

MPC completed my roof repairs on 10/08/2020. Claim # **********.The contract provides a 60 month warranty. On 0*/18/2022 after some heavy rains, I noticed a wet spot on the ceiling in my bathroom assuming it was coming from the roof. So the logical thing to do was contact MPC for warranty work. I sent emails, a certified letter, and phone calls from */21/2022 to 4/11/2022. MPC did not respond to any of these requests. In late June I submitted another request through the H*6*1*7*9*2*8*1*8*1H website, threatening to file a complaint if I did not hear from them by 7/8. They finally called me on 7/6 and left me a voice message. The persons name was ***. But that was the extent of it. I've called Ben * times since then and he has not responded. Meanwhile the leak in my roof continues to grow. I want MPC to honor their contract and repair the leak within a reasonable time. Five months for a roof leak is unreasonable and they've had plenty of notice to make this right.
