    My daughter was a member of the Wisconsin Heat Fastpitch team which is associated with Next Gen Sports Academy. ********************* runs both places & was previously listed as owner under their previous business names. We recently found out that EM changed the business names in 2023 & put NGSA in his daughter ***************************** name & possibly his wife's name ******************** for WHF. This was after ******** wife were found to owe the government back taxes of about $68,000. We ONLY dealt with **** the entire time since August 2023. We paid via Venmo to ********************* @sc-wi: 8/26 $120 (jerseys), 9/10 $68 (dome tournament), 9/11 $40 (Kenosha tournament), 9/17 $50 (XL helmet), 9/27 $65 (Rhinelander tourn.), 9/30 $680 (monthly fees), 9/30 $20 (pants), 10/4 $46 (hats), 10/7 $40 (pants), 10/25 $50 (Dells tourn.), 10/29 $50 (Marquette tourn.), 11/2 $26.50 (hat), 1/12 $35 (Giddy Up tourn.), 1/13 $77 ********* tourn), 2/21 $55 (April tourn.). **** stated we were to pay via Venmo to him @sc-wi or pay cash.We paid via Paypal to NGSA (batting lessons): 9/24 $212, 9/30 $53, 9/30 $53, 10/4 $212, 10/4 $53, 11/18 $58. Our daughter became extremely ill at ***************** tournament. She was hospitalized 4 times for a total of a month. She had over 40 ambulances & over 50 ER visits over the next few months. She was unable to participate & we kept her coach ******************************* aware. ******* kept saying she was still on the team. When she had medical clearance, ******* kept her out of tournaments she paid for. EM then removed her from the team. We asked for $781 back for: the helmet she did not receive, the tournaments she paid for & wasn't allowed to be in, the Marquette tournament that never happened, the monthly fees she wasn't allowed to be there, the 3 lessons postponed. We tried via emails, phone calls, *************** to get refunded but EM called us losers, threatened to kill my husband twice, & claimed he didn't know us. EM told all team members they were not allowed to contact ******.

    To whom it may concern,
    This complaint is frivolous and from a family that obviously thrives on not following rules as they have been removed from various youth sports clubs. Take to social media defaming businesses and people. ********************* or ********************************* personal financial situation should not even be considered or mentioned. The complaint should be stricken, due to this family bring personal affairs.

    www.nxtgensa.com shows there is no refunds for hitting and what the protocol is if rescheduling is needed.

    Wisconsin Heat
    The family kept their daughter on the team. That simple! However, never brought their daughter to practices or tournaments to be part of the team. She was never NOT allowed to tournaments. The family CHOOSE not to bring her. BBB, you have allowed a potential complaint on very awful lies. 

    www.heatfp.com (about) shows that there are no refunds and hasn't been refunds since 2017.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    1. Our daughter was NOT kicked out of previous sports clubs.   We chose to try out for different teams just as the other kids on the team did.   She was on a previous team and switched to this one due to Coach ************ Repeatedly asking her to because of her pitching ability and because of the increased number of tournaments the Heat does. In fact, after ********************* kicked her off the Heat, she subbed in playing at tournaments for a previous team she was on. 

    2.  The financial info of **** and ****************** were brought up because **** was previous owner to this business before the *** saw they were not paying taxes.  They then switched the name and put it under their daughter once their wages were garnished.   **** is the only one we ever had contact with and dealt with payments and ordering.  This was brought up as evidence of ***** history of fraudulent acts.

    3.  We were repeatedly told by Coach **** and **** that ****** was on the team.  **** would not allow ****** to play because of medical reasons.  Our family lost over $40,000 due to wages lost and medical expenses.   We were not traveling several states away nor across the state with a sick child to watch games and not have her allowed to play.  Instead, all of the girls on the team and parents can vouch for the fact that our daughter watched every game online and messaged the girls and cheered them on from home.   She supported all of the girls and encouraged several who were not doing well with their games.   Then when  she was allowed to play medically, **** stated she could support the team by sitting in the dugout.  He kept her on the team to not give money back and keep collecting money.  He had no intention of her playing. 

    4.   **** often told players they could reschedule their hitting lessons for various reasons.  He did that with three of ours.   We will not permit our daughter to reschedule those lessons with a person that threatened to **** down and kill her father and who called her, her mom, and her dad fat and terrible people, fat and lazy.  Another parent told us of a highly inappropriate perverted incident that his wife encountered with **** at a tournament in *********.  We would never have her with him again. He also kicked her off the team so is not allowing her to go back there for lessons. 

    5.  One fee was for a helmet never received.  

    6.  One fee was for a tournament that was canceled and not one player attended.  **** kept the money for this Marquette tournament instead of refunding it.

    7. After we filed complaints they changed their websites.  Other parents said they noticed how the websites had different verbage now. 

    8.  We left a bad review online for the company.   That is not slander.  It was factual information.   In fact we had team  parents who called us and tell us how awful they felt that **** was lying to them and doing this to us.  They also told us that **** had a private meeting with the girls on the team and told them things about our daughter and told them they werent allowed to tell anyone what he told them.   But some girls did tell parents.  He also held a parent meeting and told them we were awful people and them we were lying and that he did refund our money already.  We heard this from three families on the team.

    9.  All evidence was attached in the first complaint.  I could not reattach all here in time for the 30 min allowed by BBB to respond.  

    10.  We are not asking for all of our money to be returned.  We want the portion mentioned and listed in the original complaint for the items she did not receive nor was allowed to be an active member of.   It is theft and we will report this legally if not resolved here.  This will be to the police and to small claims court. 

    11.  Also,  several families told us that **** told them he obviously had returned our money. Also they said he charged the subs who played in place of our daughter for the fees as well.  So, he was collecting double for these tournament for the one player position (our payment and the sub).   They knew this because the parents said when the parents would argue about playing time and said they paid more than the subs so they should be allowed to play- the sub parents all said that they had to pay to play there too.  Parents were surprised and asked what they meant- they said they were charged tournament fees to pay to **** too. 

    12.  We have zero false information reported to the BBB and will stand by that if we have to go to small claims court.  We are not lying and have much evidence and people to back that up.

    Hello,
    **** and ********************************* personal or business issues are not of concern. FYI - Softball is not the reason for the back tax, and the complainant should stop stating this or it could become a serious matter.

    I have attached some communication with parents from the 2023/2024 team.

    After review, the ******* family did purchase a helmet and didn't receive due to not having her size in. a $50.00 refund will be given.
