My neighbor hired Northern Exposure Landscaping to do work on April 18. With my neighbor's permission, I asked the landscaper to trim some branches that extended over my driveway and were hitting my house. In doing so, the landscaper ended up cutting off a large portion of the tree and had it fall onto my property opposed to having it fall onto the property of my neighbor who hired them and who the tree belongs to. This resulted in scratched siding and two ripped window screens. I emailed the landscaper to tell them what happened and included Nest camera footage showing the tree falling and hitting my house along with photos of the damage. The owner, *********************, emailed me back on May 17 stating that "Northern Exposure is not accepting responsibility for any damage done during this process." My siding company estimated it will cost $325 to order and replace the two scratched siding pieces, and it cost $37 to replace the two torn window screens that I have since replaced. I am requesting that the BBB helps me to resolve this matter by the company paying for the damages. Another issue with this company is ************************* behavior. Before I sent the email with video footage and photos, I tried talking to him and showing him the damage the next time he came to my neighbors. He raised his voice, became argumentative, and I felt extremely threatened by his behavior. I don't feel comfortable in personally engaging with him any further to resolve the matter. I informed my neighbor because he has a strong relationship with Northern Exposure Landscaping. I asked if he could help amicably resolve the matter, but he has not followed up with me despite me asking several times. I'd like to note the neighbor is ******************************* who I heard is a BBB board member. If that is correct, I request he not be involved as a BBB member due to objectivity concerns. Photos of the damage are attached; I would like to share the video footage, but it won't let me submit mp4 files.Business Response

Dear ******* and BBB Representative,
We appreciate the opportunity to address the concerns raised in Complaint ID ********. We are committed to providing excellent service and take all complaints seriously. After a thorough review of the details provided, we believe that there are some inaccuracies in the complaint. Northern Exposure would like to begin by stating that customers statement of the problem is not the customer of ********************** but is the neighbor of Northern Exposures customer.
********************************************* received video footage and pictures from complaint in which Northern Exposure professionally responded via email that after review, company was not accepting responsibility for damage to siding or a window screen. The video and pictures were reviewed by owner, employees, customer, and unrelated persons. All of which agreed the claims against Northern Exposure were not possible.
Northern Exposure has been working with our client to resolve the neighbors concern; this can be seen in the attachment.
The complaint here misleadingly accuses Northern Exposure of damage and then requests her neighbor to purchase and install a privacy barrier for her benefit. This deviates from and is unrelated to the initial claim against Northern Exposure Landscaping. We hope this clarifies the situation and demonstrates our commitment to transparency and customer satisfaction.
Thank you for your understanding and cooperation.
Sincerely,
*********************

Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I reject Northern Exposure Landscapings response dated June 14, 2024. Owner ********************* is using distraction techniques to skirt the issue that his employees scratched my siding and tore my window and door screens on April 18, 2024.
My video camera footage clearly shows the employees letting the large set of tree branches fall onto my property, hitting my house, and subsequently scraping my house with the tree branches as they dragged them down my driveway. I have emailed the video clips to ******, the assigned BBB representative, so they are officially submitted as evidence on file with my complaint.
As far as owner **************** assertion that the owner, employees, customer, and unrelated parties indicate ********************************************* is not at fault, of course he - the owner - would not find fault; of course his employees would not find fault as they are on on his payroll and dont want to acknowledge their negligence; of course his customer - ******************************* - would not find fault as he is a long-term customer; and the unrelated parties lack any credibility.
To address **** Haddads many distraction techniques, he claims that I misrepresented myself as a customer. I never said I am a customer. I recommend he rereads my initial complaint where I clearly stated that my neighbor hired Northern Exposure Landscaping.
As for ********************* accusing me of bringing up the unrelated panel (or what he calls a privacy barrier), I would again advise he rereads my initial complaint because it does not state anything at all about the panel. It is an unrelated issue and another distraction technique to ***** responsibility for the property damage.
Northern Exposure Landscaping caused the property damage on April 18, 2024 when they cut the large set of tree branches. It was on a subsequent visit on May 3, 2024 that Northern Exposure cut the remainder of the tree down, leaving a huge open gap between our properties.
I planned to purchase and install a panel to conceal that gap but, upon checking the survey plot, that it would have to be located on my neighbor ***************** property. ********************* erroneously claims I asked *** to purchase the privacy barrier at my own benefit. Ironically, in the email exchange between me and *** that **** obtained and submitted in his response, *** clearly states multiple times that I offered to purchase and install it. So Im not sure what kind of point **** is trying to make erroneously claiming that I asked *** to purchase it at my benefit.
The only reason the panel got brought into the property damage issue is that ******************************* tried using the panel as leverage to get me to drop my grievances with Northern Exposure Landscaping.
I first asked *** permission for me to purchase and install the panel on May 8, five days after Northern Exposure cut down the rest of the tree on May 3. *** never gave me an answer regarding the panel despite me asking again on May 10 in a phone conversation and again in person on May 29.
Its VERY interesting timing that *** authorized his permission for me to purchase and install the panel on June 5, the day AFTER I submitted my BBB complaint on Northern Exposure on June 4. In fact, he sent me the email at 11:16 a.m. on June 5, just two hours after I received confirmation from the BBB at 9:12 a.m. that the BBB had sent Northern Exposure my complaint.
Since ********************* conveniently already submitted this email exchange, you can reference the following statement from the June 5 email where ******************************* stated: Again, we are accepting your agreement in good faith that acceptance of your proposal will resolve your concerns and consider this matter officially closed with us and our contracted landscaper. What does me purchasing and installing a panel have anything to do with Northern Exposure Landscaping???
*** continued to contact me about the panel to officially close this matter with us and our contractor in a June 7 voicemail and email and June 10 email. He even went so far as to give me a deadline to respond to him by end of day June 10. It was very clear his objective was for me to drop my grievances with Northern Exposure Landscaping in exchange for getting his permission for the panel, which is why I replied to let him know that I was not interested in the panel anymore and the matter with Northern Exposure is not resolved until they pay me $362 for the property damages.
Then *** attempted to pay me off to drop the matter with Northern Exposure by personally paying me $150. It was very evident to me that he was colluding with Northern Exposure and putting together a fabricated version of events, including making up details that I called the damage negligible and obscure to the naked eye, which I did not say. *** gave me a deadline to accept his payoff by close of business Friday, June 14. After I did not respond, I - not so coincidentally - received Fadis BBB response on Friday, June 14 at 4:53 p.m., furthering proving *** and Fadis collusion.
I am requesting that Northern Exposure Landscaping stop their distraction techniques and take responsibility for the property damage. Furthermore, if **** claims they are a transparent company then I request he provides me the certificate of insurance they state on their website that they will provide upon request. (Screenshot from their website attached.)
Regards,

In response to *********************** message dated June 19th received by the BBB regarding complaint ID ********.
We take all feedback seriously and strive to address concerns promptly and effectively. However, we must address several untrue accusations made in the complaint.
There are no distraction techniques being used by Northern Exposure as ****** states. Despite all the unnecessary details provided in ******* letter, there is only one subject or situation of concern here. This matter being Northern Exposure falsely accused of damaging ******* siding and window screen, which can be seen in the video footage she has provided. The tree branch was clearly dropped behind the house, not against the siding.
****** has stated more than once that Northern Exposure purposely let and had it (tree branch) fall onto her property. With the video she has provided, (keep in mind ****** requested *** to remove the branch) it is clearly seen that gravity allowed the branch to fall onto her driveway, it was not with intention or purpose to push it to her side as she says.
As for the owner, employees, customer, and unrelated parties viewing this video and lacking credibility, Northern Exposure disagrees with ******* statement. ****** provided the video footage to Northern Exposure after her initial complaint, where discernably multiple eyes would view the accusations. Its what she was requesting.
Northern Exposure did not claim that ******************************* misrepresented herself as a customer as stated in the response. The statement written on June 14, 2024 by *** was an opening statement noting BBB referring to ****** as the customer concern. Wanted to make it known that she is not the customer. This is clearly not one of the many distraction techniques, as she states, just a fact.
All talk regarding panels, privacy barriers, the neighbor offering this and that is irrelevant and has nothing to do with the initial complaint against Northern Exposure. There is no colluding between Northern Exposure and ****************************.
In closing, the comments ****** states as ironic timing of written response are not applicable. Northern Exposure responded by the due date for said response, unknowingly to any of her other concerns. ****** is correct in stating that Northern Exposure will provide a certificate of insurance, however it is provided upon request to customers with written and signed proposals. We are open to further discussion and willing to cooperate fully to resolve this matter amicably. Please let us know if additional information is required or if there are any further steps we need to take.
Thank you for your attention to this matter. We look forward to your understanding and assistance in resolving this issue fairly.

Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I continue to demand Northern Exposure Landscaping to take responsibility for the damage they caused to my siding, window screen, and door screen on April 18, 2024. Please see attached screenshots from the video footage that captured the tree branches hitting and scraping my house as they fell and an employee subsequently scraping the branches across my house as they dragged them down my driveway. A professional landscaping company would have the tree fall onto the property owners side and not mine. Those tree branches belonged to property owner ******************************* - not me.
Regarding Northern Exposure Landscaping owner **************** assertion that I requested *** to remove the branch, that doesnt mean I deserved to suffer property damage as a result. Those tree belonged to my neighbor, ***; *** asked **** to remove them; and *** gave me permission to show the branches to the landscaper.
I also continue to be confused as to why **** felt the need to attach to his initial BBB response the email communication between me and *** that was about me asking to install a panel. **** obviously found the emails important if he felt the need to be BCCed without my knowledge and/or to have *** forward him the emails so he could include his BBB response. That is one of the reasons I believe *** and **** were colluding on trying to get me to drop my claim against Northern Exposure Landscaping. Furthermore, **** claims he didnt know the timeline presented in the email communication. I disagree with that. **** somehow obviously obtained the email communication from *** and submitted it to the BBB as part of his response. He is therefore 100% responsible for knowing the contents of the email. The email stated that I was to respond to *** by end of day June 14, which he knew was the deadline from the BBB for **** to respond to my initial BBB complaint. That is no coincidence.
To correct yet another misstatement by Northern Exposure Landscaping, I didnt provide the video footage of them scraping my siding, window screen, and door screen so that they would ask their biased parties to review it. I sent them the video footage to prove to them that I have it on camera that they damaged my property.
I remain steadfast that I would like Northern Exposure Landscaping to take responsibility for the property damage.
Regards,
