8/2/2021 My grandmother and I decided to use this cemetery where my deceased father has been buried for 26 years, to dig him out of the ground and place him inside of the wall. Since 2021 I have made half of the payments and my grandmother also has made payments. On 8/25/2024 my grandmother passed away and I continued to make the payments until January 2025. I called to finish the payment but before I made the decision to cancel the process I asked the cemetery what would the next process be since no one explained the process and or that process was not included in the contract my grandmother signed. The secretary stated the next steps of the process includes my dad having a permit to be pulled up, the funeral home has to be present and the labor of this would cost me another ***** dollars. I couldnt afford it so i asked for a refund. They instructed me the only person who can do that was ****. **** ignored my phone calls purposely The whole month of March until March 21st, 2025 when I came into the office to see him face to face. He provided me a forged contract and also false dates of payments. **** is covering up something, he refused to refund us for Damages of a contract I never signed and My Deceased grandmother cannot fulfill, He also stated he can keep our money due to a credit. He stated im also not entitled to a refund but I am an authorized Payer for the account. Also the payment break down he gives he has a credit card next to each payment and 3 out of 10 cards that listed Are my Cards.

The attached document explains our position. The main point of our position is that ****** ****** name is not on the contract, and we believe that this is a probate matter, therefore we would welcome a legal decision.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[see here is a copy of all of my debit cards that are linked and authorized to make payments onto the account. I am also asking that they review their payment documents and refund me the full amount that I am owed. This business is refusing to accept any documents that are needed to the heir of **** ******** who did not purchase that Crypt for herself but for her Son my father (******* ********)

    Regards,

    ****** ******

    Business Response

I have asserted in my previous responses, and I continue to assert that I believe this is a probate issue and I believe that it should be resolved as such. We have a fundament disagreement with Ms. ****** regarding contractual rights and obligations and we would prefer to let either courts or attorneys settle the matter.
