This is what was sent to ***************************, owner of Brew City.Attached are pictures of the late *************** due from our 2021 *************** taxes. You received our taxes to complete for 2021 on March 12, 2022. You were unable to prepare them by the due date & did file an extension for us. Unfortunately you filed the extension at zero dollars due. Which means you had not looked at our paperwork while you filled out the extension. If you had done the extension correctly we would not have accumulated $524.68 of late fees and interest due. You had still not begun to prepare them, other than your secretary flipping through our ******************* despite my repeated calls to you. I picked up the tax paperwork on July 12, 2022. A full four months after having dropped them off. 4 months after you had the ********************* needed to prepare our taxes. Due to your inability to do our taxes in a timely manner you owe me $524.68. Payable immediately to ************************* , W125S7649 *************, ******* **. *****. Your inability to prepare our taxes & not letting me know so I could take them to another preparer is inexcusable. As is your secretarys repeated promises to me that they would get done very soonwere working on them now was a phrase I heard several times. I expect a check from you in the amount of $524.68 within a week. Today is December 28, 2022. I expect a check no later than January 4, 2023. Ive provided the dates for you as Ive learned through experience with you that you are not good at dates & deadlines.

We submitted all of our tax records and documentation to *************************** at Brew City Accounting and Tax on March 12, 2022, for the 2021 year. As the tax deadline approached, I contacted his secretary and was assured that they were being worked on. We never received any contact from them that they would/could not complete them. After more attempts at contacting them, after the tax filing deadline, (they do not staff the office with any regularity) we found they did not file or complete or file an extension. We finally took possession of our records back, on July 12, 2022 and took them to another tax preparer. Because of filing late we incurred fee's and interest that i believe ******* should take responsibility for paying the $524.68 of late fees and interest due .

Attached is the response we sent ***** and ***** at the beginning of January in response to her email she initially sent us. I redacted confidential information, but does not change context of the letter. The information she provided was inaccurate for dates. The date of signed engagement was on March 14th. We have an audit trail in our CRM showing when we reported she picked up the information, which was on June 6, 2022. Once the information is picked up, our engagement is completed. We covered the interest for the days we had an engagement. In addition, we did not receive any payment for services already completed.

These are not standard returns and require additional questions/documents, waiting for the *** to release forms (k2 & k3) and due diligence. With being behind from the start, additional requirements needed, delay from the *** releasing forms, the returns were also delayed. We had an initial amount due as outlined in the letter. In June we had to do a final review and complete the requirements for the k2 &k3, then the returns would have been completed. These would have been completed within a week, had they not been picked up.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

In response to the response from Brew City Accounting regarding my complaint, perhaps more detail is needed. My wife contacted *************************** at Brew City Accounting after our tax preparer that we had used for over a decade notified us that they would no longer be preparing taxes. *he emailed Brew City the info for her **2 and called the next day to ask ******* to do an extension for her * Corp. This was in mid January 2022 for tax year 2021. ******* did do the **2 and said he filed the * Corp extension. *he dropped off the tax info for the * Corp and our personal taxes on March 12, 2022. * Corp is a pass through meaning taxes owed by the * Corp pass to personal taxes. Brew City had our tax information a full month before the due date for personal taxes. As stated in a letter we received from *************************** at Brew City Accounting dated 1-3-2023, "an extension (for the * Corp) was attempted but your previous preparer already submitted it". Not True. There was no previous preparer for tax year 2021, and the tax preparer we had to move our 2021 taxes to was unable to find it. Because it was never done by Brew City. Quoting from the same letter from Brew City, "For the personal extension, the extension was filed on April 18, 2022..." "At that time, we estimated the tax liability to be over $50k..." Brew City estimated our tax liability to be over $50k yet he filed an extension at $0 due. Tax money is due on the due date. If it is not paid by the due date, penalties and interest begin to accrue. *************************** had a responsibility to file an accurate extension especially given he had our information for a month. My wife called numerous times asking when our taxes would be done and continued to be strung along. *he finally went and got the info from Brew City and took it to another tax preparer after months of waiting. We incurred a total of $524.68 in *tate and Federal penalties and interest. My wife sent him a bill for this amount and he paid $190.44. He paid for the interest and penalties accrued up until we took our taxes somewhere else. He still owes $334.24. No penalties or interest would have been generated if *************************** of Brew City Accounting had done his job and filled out the extension correctly. In his response to my BBB complaint, he states he reached out to us. False. We contacted him, not the other way around. He sent us a letter dated 1-3-2023 with a check for $190.44 in response to the bill my wife sent him stating he owes $524.68. I've noticed his responses to other complaints often include "I reached out...". This appears to just be something he says, not something he actually does. I strongly advise not using Brew City Accounting. *************************** of Brew City Accounting has ignored the letter from my wife dated 1-5-2023 requesting the balance due of $334.24. He has not "reached out" to us since receiving this latest letter.

      Regards,

      *************************

The **Corp tax return was due on March 15th,which you brought the information in on March 14th. We have a signed engagement with that date. The **Corp tax return has to be completed prior to the personal return, as information produced from the 1120S (**Corp tax return) passes through to the personal taxes via form K-1. Since the **Corp information was not provided timely, that delayed your personal return.

When we tried to file the **Corp extension,we received Rule Number: F7004-011-03 indicating the *** had already received a return for that EIN. We can only assume your previous preparer submitted the extension.

We filed an extension electronically and since no payment was being processed with the extension, box 7 was zero. We do not process payments as we let you be in charge of your money. A printed copy of form **** was available to pick-up on April 18th showing the estimated total liability and total payments.

With the documents being picked up on June 6,2022, our engagement ended on that date. We have no control over what you do after the engagement ends. We calculated the time we had the tax return compared to when you finally paid and reimbursed proportionally the interest and penalties.
