  We had a blacktop driveway installed on 9/2/23. In under a year, it has started cracking in multiple places. My first contact with this business about the cracking was on 8/19/24. I was questioned whether or not I had it sealcoated yet? We did have it sealcoated by this very company (Fox Valley Asphalt) on 6/14/24. After the sealcoating was applied is when we started to see cracks start to form. I was told by the lady who answered the phone that she would send ***** out to look at it. She never did ask for my name or address. My second call to this company was on 9/2/24. I asked if anyone had been out to look at our driveway yet? She said she did not know. I then gave my address and was told someone would come out and take a look. My third call to this company was on 9/9/24. I again asked if anyone had been out to look at our driveway yet? I was told by the same lady who answers the phone that she did not know? That she hasn't had a chance to talk to ***** yet. She again asked for my address. I then emailed ***** and **** Best whom I'm assuming are the owners. Their email addresses are provided on the brochure that they gave me at the time of paving. I still have not received a reply from anybody. The driveway came with a 1 year warranty. I have been trying to get someone to come out and see the cracking before it expired. But I keep getting put off.

  Please see the attached copy of the "Terms & Conditions"  of our contracts.

  Our workmanship and materials are guaranteed for one year as it is clearly stated,  however it also makes it very clear that there is not a warranty against cracking.  

  If the customer thought that seal coating would repair any cracking;  that is clearly not the case.

  FVA  would be happy to come out and complete Hot Rubberized Crack Sealing at NO cost to the customer.

  Nobody has come out to look at our driveway, as we had asked. Per FVA contract: driveway cracking is not covered under warranty due to frost or soil movement. As previously stated, the cracking formed in the early summer months AFTER sealcoating was applied. Frost and soil movement had long left the ground underneath. There were no cracks before sealcoating was applied. We would like our driveway correctly fixed. This should not have happened before 1 year of installation.
