    Before meeting with Brinkmann Pools, I sent photos of my backyard to Rob Brinkmann. He indicated that the land was feasible to build a pool on with a small wall. Based on this, my wife and I spent two hours with **** going through his sales pitch. His pitch included his stating the the pool would take 3-5 days to install, a 4 foot wall would need to be built, and the cost would be approximately $200,000. We then wrote a check for $5000.00 as a deposit. Subsequently, **** sent out two people from his facility to properly spec the land. We were then told the wall itself would be over $100,000, there would be significant landscaping costs to repair our front yard from all the truck traffic, the wall would have to be 8-9 feet tall, and we would have to pay for an engineer to be on site during construction which would be 3-4 weeks (not days as originally promised). We invoked our right to negate the contract but **** kept $2500 to pay for the cost of his inspections. Nowhere in the legal agreement are clauses that suggest we would have to pay for these inspections if we decided to not put in the pool. In addition, the $2500 includes hourly rates of $200-$300 dollars per person which is a significant markup. **** has not responded to emails regarding the situation. I believe that 1) he has no right to charge us anything as their is no stipulation for such charges in the contract nor was there any verbal warning that we would have to pay if we decided to not build the pool 2) we would have never written a check for $5000 if we had known the construction would have taken 3-5 weeks and included a 9 foot wall. We trusted him which turns out to be a mistake.
