      We purchased a house with *** Obrien in December 2022 with a warranty for 1 year. They had honored the warranty initially until about the 11 month **** when communication stopped. There were two issues that were not resolved and we again emailed about these in December with no response and then again in February with no response. We find this lack of response for 3 months concerning as this was pertaining to items within the warranty period that we brought up during the warranty period and now that 1 year has passed they no longer communicate with us. For this reason were hoping to use BBB resources in the hope of finding a solution or guiding us about options we would have legally in the state of *********. As to the issues- the first one was that our blue door had white paint sprayed onto it accidentally by a *** Obrien team member. This occurred because our door frame had not been painted so we reported this at the one month followup. The painters painted the door frame but in the process also sprayed white paint onto our blue painted front door. We were hoping to get this white paint spray corrected.The other more important issue to us pertains to a range hood that came with the house. This has been an ongoing issue since we first moved in. At first it was positioned incorrectly and lights would flicker intermittently which we brought up in the first warranty review. The positioning was corrected but the flickering became more prominent and we reported this. After that we noticed that there is a much louder noise coming from the Range Hood when it gets turned on and the flickering persisted which we brought up at 11 months. This looked at this with no solutions provided. If this is something that cannot be serviced properly we requested having a new replacement range Hood installed as we think that with the number of attempts at correcting it (since the very beginning- so almost a year), it is likely defective.

      We apologize for the delay and lapse in communication in addressing the performance of your range hood.  We thank you for bringing this to our attention, and for your patience, responsiveness and communication with our ************* Specialist ***************** on March 12th, as *** researched the issue with our appliance supplier.  This morning, we received notice that a replacement hood is on order.  Well stay in communication with our appliance supplier regarding its replacement.  We will take care of the painting once it gets more consistently warmer.  Thank you for choosing *** OBrien Homes.  We look forward to resolving this issue

      me and my wife bought a home from *** obrien back in november 2021 the home has had issues since the very first winter but we're not noticeable until the second year of use. 9 of the windows leak in cold air to the point the room temperatures drop below 20 degrees in the winter rendering the rooms unusable even with plastic and coverings. this was told to them via email because they had been here to repair a window because water was leaking in wich that window was partially repaired and they never returned to properly fix anything else. the floors were also popping up from the joint and they also refused to fix or have it fixed the outside stone work is starting to fall of in different corners also refused to fix.4 windows are currently leaking in water and 2 outlets under the windows have begun to pop out due to the moistures these issues were borough up to them and they set up a date and time to be fixed and no one ever came i am tired of dealing with their stupidity and absurdity and feel other home owners should beware of their product as being c*** buyers should beware a new home should not come with these many issues thats the point of buying brand new! and issues arrise they should be fixed immediately and urgently not be ignored.

      We are in receipt of the complaint from ******************************** at W200N4888 ************, ***************, **  *****, made on April 26,2023.  On October 20, 2022, we received the following correspondence with regard to the prescribed 11-month review, under the terms of the 1-Year Warranty included with the sale of the home, which subsequently expired one year from the sale date (December 2, 2021), on December 2, 2022 :

      Email list of 4 items received from our customer in October of 2022):

                  The floors in the rear hallway have some lifted uneven
                  The adjoining wood has came apart several times and had to be reglued
                  There's a leak from somewhere on the front side of the house that leaks in to the living room on rainy days and leaks all the way trough the basement and also leaks on to a power outlet (have videos format is too large for email)(and no its not the windows being left opened)
                  Kitchen lights flicker when other lights are turned on on the main floor I'm sure there's more but that's what I remember so far

      In response to this request, our ************* Team visited the property on October 28, 2022 to evaluate the list above, and returned on November 3rd to address and correct the water leak, following up with the customer on November 8 to ask if the homeowner had experienced any further occurrence of the water leak.  During subsequent communication attempting to confirm the results of our work, our ************* Team also made effort to schedule service for the additional items on the October 20 list.  The next documented correspondence received from the homeowner was on January 9, 2023 (after the expiration of the Warranty), in which the customer asked ************* to add more windows to the list.  During further correspondence, we were informed of additional concerns with the home,and also informed that the homeowner would be out of town in March, with our most recent attempts to schedule visits for March 24, 28, or 30, 2022,unfortunately resulting in no confirmation of an actual appointment with the customer.

      As for the temperature extremes in this complaint, we thoroughly test the home with a 3rd party energy rater who uses infrared cameras and a Blower Door test to determine air leakage in the home.  This all happens within a few days before the customer occupies the home.  This home tested well below the targets for air infiltration and all infrared data indicate a well insulated home.  We believe the customer is not closing the window properly in said room and that is creating a draft.  It is impossible to have a room in the home at 20 degrees without serious repercussion to other areas of the home.  We will review this particular room in detail using a infrared camera and we will also address proper window operation when we visit the buyer again this coming week.

      As of this writing, we have been in telephone contact with the customer, and have a confirmed appointment for the coming week for our Team Member(s) to visit,inspect, and formulate a plan to address the remaining items, and any additional warrantable items reported since our receipt of the original 11-month list on October 20, 2022.  We have been responsive to every inquiry the customer has made.
