    We signed with ******************** and ******************** in April 2021 to develop a small subdivision. From the beginning the project was poorly managed, experienced staff turn over, required constant follow up on our end, and things were almost never done correctly the first time resulting in delays and extra money. I have 100+ emails attempting to follow up with them throughout the duration of this project. Both engineers we were working with are no longer there. We have been forced to work with ********, the owner, a very unreasonable/unprofessional man that is refusing to finish the work unless we sign this agreement:Your threat to *** cannot be part of any communication or discussion.You must be cordial and courteous to our employees, no cursing etc.You will not defame or *** ******************** & ******************** or insult any of its employees.You pay our invoices for work completed, on time, since you have been late on your invoices, we cannot extend credit to you any further and all payment must be paid in advance.You will pay for our time beyond the original contract Ifn the event you engage us in any unnecessary emails, consultations, meetings. etc.Your direct contact for all future work will be myself.*******, cannot be part of any direct communication with me or any of ********************'s employees.Unless we agree not to pur*** legal action against them for the money they have cost us they will not finish the project.In August of 2022 our grading company reached out to let them know that grades werent matching and we needed to address a stormwater drainage is***. ******************** told them to continue as shown on their plan and not address the is***. At inspection the town/county took an is*** with the area the grading company attempted to mitigate. We had to pay $2500 to re-mobilize the grading equipment to complete the work that couldve been done last year.We paid $1600 towards the as-built that is not complete. ******************** refuses to provide us with the work in progress and they will not refund our money.

    Please be advised that ********* & ********, LLP has been retained to represent Jahnke &
    Jahnke Associates, LLC, in this matter.
    With all due respect, the Better Business Bureau does not have jurisdiction over the dispute
    involving the licensed engineering and surveying firm of Jahnke & Jahnke Associates, LLC. We
    do not waive our position on this issue. We object to any decisions made by the Better Business
    Bureau in this matter because of this lack of jurisdiction. The matter brought by the Smiths is a
    civil dispute between two businesses.
    The Smiths want the Better Business Bureau to believe they are ordinary citizens. However,
    they are a business. The work of Jahnke & Jahnke Associates, LLC was for the development of
    *****************s Subdivision. The development was being done by ***** Subdivisions, LLC.

    For the record, Jahnke & Jahnke exercised ordinary care in performing its duties as engineers
    and surveyors under its contract with ******* and ************************* operating as ***** Subdivision,
    LLC. Jahnke & Jahnke did not fail in its contractual responsibilities. There is no expert
    testimony against Jahnke & Jahnke, Associates LLC. Jahnke & Jahnke met the standard of care
    in carrying out its duties for the ***** Subdivision, LLC project.

    For your information, the Smiths have been late in paying for many of Jahnke & Jahnkes bills
    and have made a chargeback against the credit card company for payments made on Jahnke &
    Jahnkes bill.
    ******* and ************************* (***** Subdivision, LLC) contracted with ********** Grading to
    perform the grading work. Jahnke & Jahnke was not involved in that contract.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    Jahnke & Jahnke is holding our project hostage. They refuse to complete the work unless we sign a ridiculous (additional) contract with them, and they refuse to provide us with the completed work we have already paid for. We had to hire another firm to re-do the job and we want our money back. If they cannot agree to a reasonable settlement then we will be forced to pursue legal action. 

    All of our contracts with them have been in our personal names. Bills were only late when we had billing questions that went unanswered. There were multiple billing errors throughout this project so we had to go over everything with a fine tooth comb, always. Im not sure how any of that is even relevant, but it tracks with how this company conducts themselves. Wildly unprofessional and *****.

    Again, we assert that the Better Business Bureau does not have jurisdiction over this claim. The
    contract for the work on ***** Subdivision LLC and Jahnke & Jahnke Associates, LLC is
    between two businesses. ***** Subdivision, LLC, is a business corporation, not a consumer.
    This is a construction related dispute between a developer and a licensed professional
    engineering and surveying company. We are suggesting that the proper venue is the *********
    Court System, which would include mediation or a civil lawsuit, not the Better Business Bureau.
    Disputes between such companies are often decided by mediation. Mediation is governed by
    ********* Statutes. This is a highly complex land development project involving the developer,
    ***** Subdivision, LLC, the licensed professional engineer and surveyor, and a grading
    contractor. This is not simply a dispute between a consumer and a business. The facts are too
    complex to be decided by the Better Business Bureau. The phone calls received by Jahnke &
    Jahnke from ***** Subdivision have been too acrimonious. The parties have exhausted their
    efforts at resolving this matter. Mediation is the simplest and least expensive method as well as
    the government approved manner in which to resolve a dispute like this. To that end, I left you a
    telephone message yesterday as well as a written response regarding your mediation services.
    Please note that to date ***** Subdivision LLC has not produced any expert evidence to show
    negligence/malpractice on the part of Jahnke & Jahnke
    Perhaps I was not clear, but my email of 06/27/23 was sent in order to move forward. The email
    indicated that I wanted to talk to you about the mediation services that the Better Business
    Bureau offers. As of this time, you have not called me in response to what was raised in my
    email or my request for information about your mediation service. Please contact me so we can
    set up a mediation.

    d/b/a ***** Subdivision LLC have agreed to mediation according to your email. Again, Jahnke
    & Jahnke Assoc., LLC are not members of BBB and object to its handling of this matter.
    However, Jahnke & Jahnke Assoc., LLC will go to mediation with the Smiths and their
    company.
    By telephone you indicated to me that BBB will not furnish a mediator. Based on your letter of
    June 29, 2023 and our phone conversation I will look for an experienced mediator. I will also try
    to contact the Smiths and indicate that if they have a mediator, I will be open to one who is
    qualified.
    It is our further understanding that the BBB will no longer be involved.
