I am currently still a member of Windsor ************** operated by Windsor Golf Ventures ***** located in Windsor, *********, because the management has not processed or confirmed my cancellation request.Due to personal and health-related reasons, I was unable to attend the gym for a considerable period. I contacted *********************** Manager, to request either (1) an extension of my membership for the unused time or (2) a refund for that unused time.Unfortunately, I was told that the only option was to provide a medical note to freeze my membership, even though this requirement is not clearly specified in the contract I signed. I believe this demand is unreasonable and inconsistent with good customer service practices.Later, I requested the full cancellation of my membership, but to this day I have received no response from either Ms. ******* or Mr. *** from the administrative team. This situation demonstrates a lack of flexibility and poor customer service, which is contrary to the spirit of Wisconsins consumer protection laws, including Section 100.177.Additionally, I consider it inappropriate to be required to disclose personal medical information without this condition being clearly stated in the contract. In the *************, medical information is protected under federal privacy laws, such as the **************** Portability and Accountability Act (HIPAA).I am requesting a billing adjustment to resolve this complaint. I respectfully request that Windsor ************* / Windsor Golf Ventures **** either extend my membership for the time I was unable to use the facility, refund the unused time, or proceed to cancel my membership without any penalty or additional fees.I respectfully request that this complaint be investigated, added to the public record, and that Windsor ************* / Windsor Golf Ventures **** be advised to review and correct these unfair practices.

We wish you the best in your future wellness endeavors and thank you for your past involvement with our club.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

While I appreciate the acknowledgment, I reject the response as satisfactory. I have no intention of returning to this facility, but I strongly object to the retaliatory and unjust permanent ban included in their reply a decision made only after I exercised my right to file a formal complaint. I believe this reflects unfair treatment of consumers and confirms the importance of further oversight.

    Regards,

    Eng. ***** ****-*******.

On May 21, 2024... We had extremely damaging storms come through our area. The strong winds caused a rotten tree on the golf course side to separate and crash down onto my neighbors fence and ended up damaging my daughters playset, sandbox, outdoor string lighting and the outdoor deck toy box. I called the golf course May 22, 2024 right after the storms to talk with someone about it. ********************* the ** returned my call on Thursday morning at 8am to tell me their insurance was coming out to get it cleaned up and they'd reimburse for the playset and sandbox (whatever was damaged). I explained we were moving his response was "insurance will just cut a check". Moving forward a week... Tree is still here, has damaged more now and it seems the neighbor landlord and golf course are battling over it. Now today June 3, 2024, the tree is STILL here on my half and I STILL have a DAMAGED playset, sand box, toybox and we are unable to go out and play in the yard. We had to cancel a cookout. My dogs can't run in the yard. I am in the middle of this all and NO ONE seems to be doing anything about this at all. I have been looking at MY options as a tenant who is stuck here with a hazardous environment. The tree has shifted since the storm. I just want the tree gone and the money to replace the sandbox (sand) and playset (rubber mulching, mat, lights) and the outdoor deck box.

    Dear ********,

Thank you again for reaching out, per the statue of Wisconsin. "In *********, if a neighbor's tree falls over onto your land, the general rule is that the tree becomes your property. This is because the "felled tree rule" states that the owner of the land where the tree fell is the owner of the tree and any wood obtained from it." Our insurance does not cover this property, this would be the owner of your property that you are leasing from.

Please let me know if you have any questions,

    Sincerely,

Once again, the golf course is trying to pass this off to the landlord across the street and now off onto my landlord. The tree has been deemed rotten per the city of Windsor ordinance.
I have about 45 photos of the tree damage, the dead limbs and branches that the "clean-up crew" throws against the fencing back here. They have been ignoring this tree for YEARS!! I also have 7 witnesses (one being someone who moved but has been complaining prior about the tree). I have a report filed with the Dane County Sheriff field division as well (they have photos of the tree as well).

The golf course should have had this removed and taken care of and reimbursed for damages a while ago. The fact they are pointing fingers instead of doing what is right is going beyond an acceptable amount of time. At this point, this is pure negligence.

    Regards,

    Dear ********,

Thank you for sending us a message. If the owner of your property let us know that the tree was a danger to his/her property, we would then remove it. We have taken over 53 trees off the property along with trees on property lines within the past 2 years. This tree was full of leaves when it fell due to a large storm that came through the area. There has been a large amount of storm damage in the area and will take time to have the insurance companies address this, as stated this is the responsibility of the insurance companies and property owners which had all been contact as of May 23rd.

    Sincerely,
