    My husband and I were interested in having this company build our new home. We got an estimate by email around August 3. We discussed some questions we had. On August 8 the owner attempted to email me the contact. I was unable to open. He could not bring a copy said that his printer was down. That day in good faith I wrote him a check for 25,000 dollars. I had written on a piece of paper his draw schedule and some of the budget numbers that he showed me on his phone. We both signed the paper to verify money was changing hands. He was to bring the contract down in the next day to review as soon as his printer was working. By August 20 still no contract after multiple requests. We were getting very uneasy with the situation so we asked him just for a price to frame the house using the materials that he had already ordered. He brought that estimate August 22. The price was outrageous. At that point we told him that we would pay him for his time and to please make sure that we got our materials that we had given him money to pay for. I contacted the roof truss place the next day only to be told that he cancelled the order...they had contacted him that day because his check bounced. He said cancel the order he no longer had the job. The last email that we have from him is from August 30. He offered to return 12,500. We responded that he had to st least pay for the materials. I have emailed him once since then with no response. We have had to pay for all of the materials again. His initial email states something to the effect that his legal counsel said that we gave him that money as part of a contractual agreement and that we are in breach of contract. We never had a contract let alone something that indicates a cancellation fee. Please advise
