    We received a proposal from Irving Home Improvements to replace our roof in June, 2022. We signed a contract and provided a $1,000 deposit to "hold a spot" on 6/29/22 and the remainder of the deposit, $8,500, to schedule the job on 7/22/22. Robert I************ had indicated that work would begin on 8/9/22, however he did not show up and when we inquired he indicated he had been in a car accident. We corresponded with him for the next 5 weeks with promises to begin and no one showing up. Most recently, we were told he "would be on the roof on Thursday" (9/16) and when we reached out mid-day to determine his whereabouts, he indicated he did not have a crew available. At this point I told him I would need the deposit refunded, less any materials purchased (with invoice), at the end of two business days (Monday 9/19). He indicated that he was taking out a loan to refund our deposit and would bring cash. On Monday (9/19) he indicated that he would not have the funds until Tuesday. On Tuesday (9/20) he indicated he had to return to the bank for additional paperwork. At this point, it has been 8 weeks since we provided the agreed upon deposit for our project, the project has never been started, and our deposit has clearly been spent.
