    i had went to park in bfs parking lot south high plaza the courthouse is right across the street and I have court mandated drug tests and after I needed to go to the post office so I parked where I always park I wasn’t gone even 10 minutes and I came out and this towing place was trying to tow my car. I had no other way home so I was forced to pay the $85.50 to drop the car. when I came home I realized the time stamp was wrong said the car was called in at 9:30 I didn’t leave my house until 10:18 and didn’t arrive until 10:36 I had came out of the courthouse around 10:45 I was sitting around crying and trying to figure out how to get them to drop my car and it took about 10-15 mins to do so I didn’t leave the parking lot until 10:56 but the time stamp says they dropped my car at 10:30 when I wasn’t even there yet. life 360 shows all my times of when I left my house, when I got there, when I left the parking lot, and when I got back home. I called the place and they said the times was right on there end, 10:36 is when it was called in which is WHEN I GOT THERE. Im a minor and I just got my license like a month ago I didn’t know I wasn’t supposed to park there because I’ve always done it and nobody’s ever told me different. but at this point they watched me pull in and walk to the courthouse and decided oh today im gonna **** someone’s day why there gone getting a drug test for 10 mins. so im ****** *ould like reimbursement.

    The following is in response to a complaint filed
    by ******* ******* regarding the towing of her vehicle at South High Station on
    May 21, 2024.

    On May 21, 2024, we responded to South High
    Station to tow a 2011 Ford Escape which had parked there, and the owner walked
    across the street to the Courthouse. South High Station is privately owned
    property and provides parking only for the businesses located on their
    property. The Courthouse utilizes paid parking spaces on High St. and Foundry
    St. as well as several nearby public parking lots.

    After our driver arrived and hooked up to the
    vehicle, the owner of the vehicle showed up. The driver explained to the owner
    that he could release the vehicle to her on scene for the charged amount or
    that she would be charged double that amount if it were to be towed back to our
    facility. After several minutes, the owner decided to pay the fee to have her
    vehicle released.

    In her complaint, the vehicle owner is
    requesting reimbursement of the fees, but does not really give a specific
    reason why. She stated that she parked there “because I’ve always done it and
    nobody’s ever told me different.” However, there are multiple signs posted
    throughout the parking lot warning that parking is only for the businesses of
    South High Station and that violators will be towed at owners’ expense. She
    also complained about the times on the bill being wrong. We do acknowledge that
    the driver was mistaken on the times, most likely because our times are usually
    based on a one hour minimum. However, that has no bearing on the fees charged
    in this situation because on a release on scene the charges are the same
    whether it is five minutes or an hour.

    We will not be offering any reimbursement at
    this time as we are performing our business as we are lawfully and
    contractually obligated. All charges were in compliance with the rates set
    forth by the State of West Virginia.

    I was at an establishment called ****** **** ********* ***) on 10/23/2022. I parked my car in the parking lot in the back of ******. I looked at the multiple signs in the parking lot before parking and the signs said “Resident and Customer Parking Area. All others towed. Video Monitored.” We were customers at ****** for the entire time my car was parked. When I left ****** at 2 am, my car was gone. I called the police and they said it was probably towed. I called all of the tow companies in the area until I found that Ervins Towing, Inc. Auto Repair & Body Shop towed my car.

    When I picked up my car, I asked why my car was towed. The towing supervisor said they monitor the parking lot and tow cars. So, I had to pay $183 for towing fees for my car that was towed even though the signs in the parking lot say that customers can park in the lot.

    I am requesting a full refund of the towing fee ($183) and that Ervins does not tow any more cars from the lot until the signs are corrected.

    The following is in response to a complaint filed by a customer whose vehicle was towed for being illegally parked on private property. The parking lot in question is owned by ****** ********** ** *** ********* ***. Signs in the lot state that parking is for residents and customers, which refers to customers of ****** *********** The lot is not available for use of customers of other neighboring businesses. The customer stated that she was a customer of ***** *** ******* ** *** ********* ***. and this was all explained to the customer by our towing supervisor. The primary complaint from the customer seems to be the wording on the signs. I have, therefore reached out to the owner of ****** *********s with the suggestion of changing the signs and offered to provide them with Permit Parking Only signs with our company name and phone number on them. However, that decision will be at the discretion of ****** *********s as the state of West Virginia has no legal requirements for signage on private property.
