On June 12, 2024, I contracted Magic Air to install two new central air
condi?oners and two central high e?ciency gas furnaces in my recently purchased
home, for a total cost of $16016,00. The agreement explicitly included the
installa?on of all necessary duct work and a safe, professional installa?on of all
units. Upon completion of their work, I was appalled to discover that the
installation was riddled with critical and dangerous flaws, including:
    1. A non-functioning downstairs furnace, which is completely unacceptable given
the amount paid. The new downstairs furnace does not work or heat. After
paying for a fully operational system, I am left with an expensive, nonfunctional unit. There is water leaking inside the electrical panel creating serious hazards.
    2. Unsecured PVC pipe fittings of furnace vents which had fallen apart and created
a safety risk. According to code standards, “ PVC pipe fittings for high-e?ciency furnace venting must be securely joined to prevent leaks and ensure the safe discharge of combustion on gases. These joints should be sealed with an
appropriate adhesive, often a solvent cement designed specifically for PVC, to create a watertight and airtight seal. This process is crucial because high-
e?ciency furnaces produce condensate, which is slightly acidic and can corrode unsealed or improperly joined connections , leading to gas or moisture leaks that
could pose safety risk and carbon monoxide poisoning.
    3. Exposed and hazardous electrical wiring, posing a serious risk of electrocution or fire.
    4. Leaking gas line from furnace, creating an immediate danger of gas poisoning or explosion within my home.
    5. Improperly installed and unattached duct work. The downstairs units duct work was left lying haphazardly all over the ground under the house.
    6. Unlicensed and Unsupervised Workers
7 Improper floor vent duct work.

    Business Response

    Date: 12/30/2024

    Dear BBB,

The invoice said we were suppose to install 6 new runs , not complete Duct Jobs. This job was completed at the last of June 24th. At this time everything had been working including downstairs furnace. Customer and Magic Air did a final walk through of entire job and customer told Magic Air that is was a good job and that she was well pleased.

Two months later customer contacted Magic Air about equipment literature, she was informed that literature was on the furnace. At this time she never once mentioned any flaws or problems. Never again did customer reach out to Magic Air in any shape or form to inform Magic Air that she had problems with her install.

According to WV code Chapter 21 article 11 A-8 ( Notice and opportunity to cure construction defects). Customer has to notify in writing to Magic Air LLC, of any construction defects. Since customer did not contact Magic Air LLC, in any form 21-11 A-7 Prerequisites to Commencing an Action that customer has to comply with , the provisions of this article ( court shall dismiss this complaint because Magic Air has never been informed of anything from this customer). Customer did not give
Magic Air notification there were any defects in the installs.

Magic Air LLC only first learned of a problem this last November, the customer had disputed the credit card charge because she says she did not get the right equipment. Magic Air was charged back a little over $8000.00 on Magic Air's ****** account. Magic Air disputed this charge back and then customer changed her dispute on credit card. She changed her dispute to telling credit card company that she paid another way. This was found out to not be true and credit card co found in favor of Magic Air LLC and returned $ 3,267.71 and the $ 5,082.29 is still under investigation.

As for the compliant about unlicensed workers is simply not true both Magic Air employee's have held a valid WV HVAC Tech for the last 2 years. Magic Air owner is the only one that has to hold a WVa contractor license and he does.

All gas connections were checked with gas detector chemical and at that time none were present. The pictures of the old ductwork under the house was left there by the original home owner. Glue was applied to all PVC fittings. There was no Bare electrical wires exposed. Pictures that customer sent of wire clearly shows electrical wire has electrical wire nuts on them.

Customer should have contacted Magic Air about any concerns she might have had, but to this very day, Magic Air has not been contacted by customer. Magic Air did reach out to customer by phone at the end of November but customer did not contact Magic Air back.

Magic Air LLC is asking BBB to not post the complaint from customer because,  Customer did not follow Prerequisites to Commencing an Action against Magic Air LLC , WV code Chapter 21 article Il-A-8 and 21-11 A-7. At this time Magic Air is denying all allegations of customer.
