  I hired this company to ********** and build a site pad for a pole barn. They put it in the wrong location, destroying the original site plan in the process. The owner is dismissive and not willing to correct the mistake. I gave a $9000.00 deposit but did not recieve a contract that I asked for. I would like for the issue to be resolved and have my money returned before taking legal action, but the owner is not cooperative.

  As a company we strive to do the best we can. I understand the frustration of this. We did reach out to you and offer to make an agreement. At that time as you know I the owner was away on military training. I tried to see what else could be done and also explain why the pad was built this way. It was done the way it was due to lay of the land and cost that is available on the budget. You said that we did not out stone on the pad, we did. I also have proof of this with pictures of the job and all receipts from the stone quarry. The ***** was spent on labor, fuel, trucking, stone, and fill materials. I would like to resolve this professionally as possible.

  I am rejecting this response because: 
                           I am the one who contacted the owner when new stone mysteriously appeared on the pad, weeks after our dispute started, and days after I contacted the BBB (all documented). On that day he offered to work on a solution. I told him that I would work my schedule around him and to let me know what day was best for him. He replied that he would and then didnt respond for 35 days, when the BBB contacted him (all documented).  
                        I gave this project to this company partly due to his veteran status (my nonprofit serves veterans). According to an affidavit filed in **************** in another case involving this company, as of June 19, 2024, he is not in the service of the United States of America.  
  
                        He admits in his response that he moved the pad from our agreed upon location. There wasnt a budget because we had an agreed upon, set price.  Ive paid $9000. of which $5000. of the project has yet to be completed (documented). It is not possible for him to have $9000 in receipts. There was no cost for fill materials because there is a big gaping hole on my property where they took fill material  in which he trespassed on my prpety and knocked down four more large trees to surround the hole.                                 I have spoken with the owner since his response. He admits to his dishonest conduct, but still refuses to issue a refund. I feel that I have no option other than legal action at this point.
