    On January 15th 2024 my wife and I agreed via emails to purchase and have **** Nicely of Nicely Installed and Serviced HVAC install a furnace, heat pump, tankless water heater, spit zone ducting, humidifier, and hepa filter for a total of $42,212.20 and the work taking 10 days to complete (1) (2) (3) (4). We paid $8,190.00 on Feb 13th and he began to install duct work at our house (5). We paid an additional amount of $25,220.44 on Mar 3rd for the equipment (6). Work and communication stopped after this payment and it wasn't until June 11th that we got any equipment and work resumed. We paid an additional $3407.38 on July 2nd after the tankless water heater installation was completed (7). After that payment I emailed **** to let him know that per agreement we owed $5394.34 for the completion of the project and he agreed (8). Sporadic work continued for a bit, but the last time **** did any work at our house was August 29th.We then started to get bids for completing our HVAC and had 5 HVAC companies come and look at our situation. (10) (11)(14)(15)At this point we have paid Nicely Installed and Serviced HVAC a total of $36,817.80, waited over 9 months, and he has only completed the tankless water heater; we are without heat at our house, without the bulk of our remodeling funds, and get no response from ****.The balance we would have owed **** for our completed two-zone system was $5394.34 and the balance we would have owed him for a completed single-zone system was $2,194.34 (3). **** also did not pay the the electrician he hired, so since I will need to pay the electrician, I am subtracting the $1,050 (2) we paid him for the electrical work.Hence, we would owe **** $1,144.34 for a completed single-zone system and because we are having to pay a different company an additional $17,117.31 to get one, we are asking that he pay us the difference of $15,972.97.Note: the parenthetic numbers refer to supporting documentation.

    On 8 Sep 22 we put a deposit ($14,700) down for contracted HVAC work on our new building. On 9 Sep 22, Zach (the "owner" of Nicely Installed and Serviced HVAC) deposited the check. Our last contact with him was 13 Sep 22 as he stated the work permit wasn't going to be let until Friday 16 Sep 22. The problem is that he is not licensed in Casper, as we were told he was, and therefore couldn't pull the permit. In our research we have found that he is not licensed in Cheyenne either, also information we were told differently. Since 13 Sep 22 we have reached out to him on all platforms, to include phone, text, landline and Facebook, without success. We believe he has ghosted us and falsely represented himself as an HVAC contractor with the intent to defraud us on this contracted work. We have all his phone numbers, have had the Cheyenne Police Department attempt to reach him at his home and have asked others around Cheyenne to only find out that nobody has heard of this guy. We are asking for our deposit back so we can proceed to get our building work completed as we are losing revenue. Please help us get this arbitrated or move towards a refunded solution. Thank you

    I have reached an agreement with Darren to get this settlement resolved. It has been a challenge due to the complaint being filed against the company and the rating that I have gotten from it. I had a high interest loan pulled out and then I had broken my hip and had to get hardware put in. This put me out of work. I was able to get him a payment of $1633.  It was agreed upon that this payment would happen starting in April and continue every month until paid off by the end of the year. At this time I had fallen behind schedule but will be paid in full by the end of the year.

    I am rejecting this response because the Company failed to complete the work initially agreed to, the Company kept the down payment for the work promised, the Company failed to comply with the agreement reached for repaying the $14,700 owed and the Company failed to communicate any issues since June 2023.  Multiple attempts were made to find out why the agreed to payment schedule was not complied with but no reply was received. I understand hard times as I am currently out of work due to health issues, but that does not give anyone the right to steal money from someone else.  Until payment is received and the amount owed has been paid, I will not be clearing this complaint against the Company.

    I am rejecting this response because we have agreed to several things but none of them have been complied with from the Company.  We agreed to have the Company perform the work, not done.  We agreed to a payment plan the Company proposed, not done.  All the while I am out the money we paid the Company to perform the work.  If the Company couldn't perform the work, our $14,700 should have been returned.  This complaint with the Better Business Bureau will remain until I receive the money.

    Nicely has still not replied and I still have not received a payment even though he stated he would start paying again.  It's 2 Oct 23 and the agreed to payment was due 1 Oct 23.  Please keep this complaint available for all patrons who might want to employ him to install an HVAC system  The customers need to know what he did to us.  Thank you
