      Headwall Sports is a used gear reseller. No documentation/waiver is provided to sellers when using the service. I sold a used pair of skis with attached bindings in 2019. I received payment for $130 and the skis were eventually returned to headwall sports by the buyer. Headwall Sports claimed I was responsible for the new balance. After being instructed to come to the store and settle the dispute like men, the owner **** agreed to resell the bindings for 100% profit. I was told that would be the end of the issue. This year I decided to bring some jackets to headwall for resale. I was unaware that my account had been set to a negative $30 balance. When a few items had sold, I noticed the issue. After another phone conversation, I was told we never agreed that selling the bindings back in 2019 would settle my account. **** was adamant that the conversation never took place and I owed his business the $30. He instructed me to come collect my current balance of $35.40 and collect my unsold items. Without the negative balance starting on my account, I should be owed $65.40 and that is what I would like to collect. I have uploaded pictures of my current sales and the balance. I have no documentation from the original issue in 2019. I don't believe I will receive my funds due, but people should be aware of the way Headwall Sports conducts business.

      To whom it may concern,

      I am writing today to explain Headwall Sports side of this issue.

      I have read the statement submitted to you by ************** to you at the BBB several times.  Unfortunately the statement does not seem to line up with the way myself, my staff, and the documented history on his account remembers and shows.

      I have attempted to explain our side of the story several times verbally over the phone for a week.  I have attempted to do so verbally due to all the details, and it seeming simpler to explain verbally then written.

      First thing Id like to address is ****************' statement that there is no waiver or documentation.  Every consignor that we do business with is presented and expected to sign a contract with us.  I have attached a screen shot of our contract.  Also every consignor has direct access to a account that we create for them to check on their goods for sale, price we sell at , and their current balance based on activity.

      ************* had consigned a pair of used skis and bindings with us back in November of 2019.  They sold promptly and ************** collected a check for $119.40, 60% of the sale price of the skis.  Unfortunately the person who purchased the skis brought them back to us because after visiting a shop to have the bindings adjusted it was discovered that the skis have already been mounted twice before.  This is a disqualifying factor for us at Headwall SPorts to sell skis in that condition.  This is a safety issue.  When we are taking goods in we  generally ask if the skiis have been "drilled more than once".  As ************* stated he did not know that was the case with the skis he sold through us.  However unfortunately it is my policy for both safety, and customer satisfaction that if it is discovered skis have been drilled more then once we will take them back.  

      We attempted several times to contact ************** to both collect his skis and repay us for the sale of the skis.  After a long period of silence he finally got back in touch with us.  I offered to go out of my way and remove the bindings, that were still in good working order, and sell them seperate from the skis.  This was done in attempt to help him redeem some of his loss and partially pay us back.  This is not a very typical situation for us.  

      We were able to sell his binding for $149.  That gave ************** a credit of $89.40 towards his negative balance of $119.40.  Which brings us to the remaining negative balance ************** is upset about of $30.  In no way is selling a pair of bindings cover my cost of returning both the skis and bindings that I have already payed ************** for.  That would be like saying selling a car, taking back the car, and selling the wheels is equal.  ....just doesn't add up.  We have not heard from ************** since 2019.  Which means he has owed us $30 for nearly 3 years.  We did not pursue or harass him at all about the $30.  I just accepted that we got taken for $30.  

      This Fall ************** decided to revisit us to consign some more of his gear.  His account still showed the negative balance of $30.  This negative balance is perfectly visible to him if he was to check his account.  When a few of his items sold he then checked his account to discover that the negative $30 had indeed carried over.

      I attempted to have a phone conversation with ************** to resolve this situation. During the conversation ************** raised his voice and began to speak offensively towards me.  When that occurred I asked him to come collect his items still here for sale, as well as a check for $35.40 that was his credit for his most recent sales.
