Factory Homes Wyoming is currently scamming me out of money. There are 2 financial issues that I am concerned with.

      1) Contingency. An addendum to the contract referred to a $21K
contingency related to potential price increases. But, clearly stated
that I would be kept apprised of changes to the balance. As of the
last week, I was informed that "there is a small amount left" and a very generic that
it was used due to factory price increases. I was never notified of drivers
this until now, and feel it is a breach of contract. Obviously there is nothing stopping them from pocketing the money if prices stayed flat or even decreased without transparency on where it went.

      2) Additional expenses. I was informed that additional work needed to
be done on site in order to deliver the home in November. I asked for
an estimate of expenses on November 2022, of which one was not
provided nor still has not been provided, despite work completed in
December. I was also informed this week that there would be
additional freight expenses related to home delivery this week, again
      with no estimate provided.

I am gravely concerned about receiving a surprise bill in the tens of
thousands of dollars at the end of this due to work that was never
quoted or agreed upon by me. It feels as though they are using lack
of transparency as a way to profit throughout the process.

I'd like to add the below info and attached image to my existing complaint.

I am trying to understand where my $21K of contingency went, and why
it is not available to be used for additional work such as ramping,
snow removal trucks on delivery, etc. The response I received is this:
"I have record of us discussing lumber price increases on Jun 3 and
how we may not have to use the entire amount of the contingency but it
would be close. I also have a note in your file that you recognized
that lumber prices were much higher than when your home was contracted
on. Luckily these prices did come back down a bit before your home
went into production and the increases did not exceed what was
allotted in your contract contingency and a small amount was still
left." I have attached a snapshot of lumber prices going back to 2021,
with my contract date and building permit receipt date (when they
could send to factory) delineated. Clearly lumber prices were not
      higher than the contract date.

      ******,

Your home will be finished. We are carrying your construction loan for you, which you seem to not care about. We are making it possible for this to happen.

On that note we want this finished badly as well. No, we don't like floating money out there and not getting paid on it. You had every opportunity to get your site accessible for delivery. We did not have that stuff in our original contract. It is your site and as you signed on the contract your responsibility to get to where it can be delivered.

Your home/pricing had a number of prices increases to it that your sales rep will send you. No, the factory has not passed down big prices decreases. The have just stabilized.

There is more to the price increases than just lumber as well. Anyhow, your house will be completed, just like thousands others we have down. Sorry it has been longer and painful than anticipated.

      Repair Issues:
In August, I closed on a home which Factory Homes Wyoming built for me. There were some finishing touches left which I was assured would be completed and were covered under warranty. They informed me week of 9/13/2023 that the fixes were completed. Upon arriving to site on October 17, clearly it was not. The work continues to look horrendous. (Photos attached) I would like the project to be finished asap considering they were paid almost 2 months ago.
