This was for a 3 day 2 night reservation agreement of 350 Farms.

Communication with the ***** ***** ******** was awful with months of asking for a venue and catering contract. We only completed the reservation agreement because it was required to reserve the space. ***** also had the Glamping sites listed publicly for our weekend. Screenshots provided below from May.15,2023.
May. 11,2023 we were finally able to visit the farm. She promised us a lot of different venue items. A list of these items can be provided if needed
May. 15,2023 we asked ***** for a phone call, she told us 7pmish, we waited and called 3 times and she called us at 9:28pm and said she had an animal giving birth. She did not notify us, and we sat waiting for 2.5 hours. We all agreed that she could see if there was interest in the venue, and also that she would speak to her husband about finding a middle ground about a cancellation
May. 16,2023 ***** emailed that there was no middle ground and we could move the date or relinquish rights but there would be no refund. She ended the email letting us know if we would like to discuss further we could come out and discuss with them. We emailed her, and came as per her offer. She came out screaming at us that we came uninvited at 8pm on a week night. She was incredibly rude and aggressive. We told her we were not there for a refund but to make sure our expectations are clear. She told us she would provide nothing promised because we had no contract (because she would not provide one) and her husband told us to “Leave now” and “Never Come Back”. I told them that I heard what he said. ***** then took her phone out and started recording or taking pictures of my truck. We no longer feel safe there, as the ***** is incredibly volatile and unpredictable.
***** emailed us afterwards threatening legal action if we shared what happened tonight on social media.

    Business Response

Ms ********** and Mr ***** have a history of public slander, libel and defaming.

They have signed a contract.  They called wishing to cancel their reservation with less than 30 days notice (we require 90). They are also in Breach of contact for not pricing the necessary security deposit not securing their AGLC permit.  They should also have taken event liability insurance and event cancelation insurance to help them in case they needed to cancel.

Mr ***** showed up unannounced after business hours to the farm (not our home) and was threatening and aggressive  which is why he was asked to leave.

Neither  of the couple has put into writing or would agree when asked if they wished to cancel.  We cannot advertise our venue without the customer canceling in writing and a signed agreement as such.  Mr ***** cannot have it both ways.  Further, the remedy and means by which Mr ***** has sought his remedy are by duress, threats (verbal) and aggressive /erratic behavior.

We Already offered to waive the caterering agreement valued in the ballpark of $1200.

We stand by our contact and will not be offering a refund.  We will not be advertising our venue as Mr ***** nor Ms ********** have confirmed that in writing.

This matter has been referred to our representation though we remain available via email to discuss and find a solution with Mr ***** and Ms **********. We take their vicious attacks very seriously. We will not be participating in any further ti these unfounded  *** claims or responses and can direct you to our representation.

I am rejecting this response because:

If you look at the attached email you offered for us to come and speak in person if we desired. I did not threaten you a single time, I gave you exactly what our expectations were, which is that we expected the event to be prepared as we were not cancelling. We did not want our money towards the venue wasted and wanted access to what we payed for. What we received when taking you up on your offer to talk was hostile, yelling, and accusing. It is difficult to communicate with you and in person has been the most effective. We do not feel safe or comfortable returning to your property after being threatened with legal actions several times and told to leave and never return from your husband. None of what I put in the claim was inaccurate or fabricated, I provided an honest account of what happened.

    Sincerely,

    ***** *****

    Dear *****,

When someone says we can discuss further in person that is not an open invitation to come to a place of business at dusk without an appointment and expecting 1) the business to open for you 2) the business to drop everything to open for you and 3) allowing you to disrespect and threaten the *****s and employees.

Witnesses in the office overheard and observed the entire interaction from the loft.

You further blocked email communication thus severing any link to communicate.

Your efforts to bulldoze your way into a refund are not successful.  You may cry wolf all you want.  You had a contract,  we are enforcing the contract.   We are not a member of the *** and will not respond further.  You may direct any inquiries to our business email and they will be forwarded to our representation.

You were asked to leave during your unscheduled visit due to threatening and aggressive behavior which will not be tolerated. Should you be able to govern yourself accordingly you will be welcomed back.

I am rejecting this response because:

You are entitled to not respond but we  are comfortable sharing our experience here.
When you end an email with “Please let us know if you’d like to chat further. If so, you are welcome to come out and discuss with us both” it explicitly says we are welcome to come out. If it was an issue because we interpreted your email differently than you intended you could have just told us that. Instead you came out screaming, accusing, and out of control. Please tell me a single threat I expressed in any way. We asked that the venue be set in the way we had discussed. You asked us to leave and we left, we took the proper measures reporting to an agency our incredibly unreasonable, volatile, and aggressive experience with you yesterday. You can make up things about each of our characters saying that we have a history of defamation, libel, and slander while having absolutely no grounds to say that. We expressed the issues our family members had with making it to our wedding, and they continue to voice their concerns to us. We tried to work with you to find a middle ground where we could all win but that wasn’t able to happen. When we asked for the venue to be prepared as we discussed you continued yelling and screaming without even attempting a civil or respectful conversation. Then after we filed a complaint you have threatened us twice with legal action for simply voicing what happened in the proper channels. How can we expect to have any part of our wedding at a venue where the *****s have made it clear not to come back, made legal threats to us, and screamed in our faces about showing up at a place of business at 8pm because your email did not come across the way you intended. Not to mention your business hours are listed as 24/7, yet getting in contact with you is incredibly challenging. We attached an example in the original pictures of an email on April.9,2023 asking about the post dated cheque. No answer. Then April.12,2023 a text asking about the post dated cheque because there was no response. No response. Then another text about something else on April.25,2023 and you finally answered just the final text on April.26,2023 but did not respond to either of the prior two. We have a wedding in 3 weeks and we couldn’t get a contract from you outlining venue responsibilities or a catering contract. There are so many red flags to us. Not to mention you had Glamping sites available during our booked weekend. And lastly, you have proven your lack of respect as you can not even get my name correct. My name is ***** *****, not ***** *****. First post had me as Mr. *****, second post called me *****.

    Sincerely,

    ***** *****

I booked a glamping site for 2 nights. They had to cancel due to safety issues and offered me a full refund. On May 3 I paid my deposit of $141.25 and on June 10 I paid the remaining $141.25. On June 16 they had to cancel for good reason (it wasn’t safe) and offered to give a full refund. I accepted and they said it would take 5-10 days to process. After 13 days (June 29) I let them know it had not yet gone through. They said they’d send a support ticket to stripe as this was unusual. I sent another email in the middle of July asking if they’d heard anything and I had no reply. So I sent a Facebook message on July 20 telling them if sent another email and wondering if they had an update for me. I got no reply so I re-sent my fb message on July 25. I heard nothing. I sent another Facebook message on August 7 and had no reply. So I emailed stripe to see if they could help me and they said they needed copy of the refund receipt. So on August 13 I called 350 farms and after having her yell at me, she agreed to email them to me on the 15th. I got nothing and sent her reminder emails on the 16, 17 and 18th of Aug. On Aug 18, a partial refund of $137.19 went through (she emailed me and let me know), but she still has not provided my receipts/records and I’m still needing the rest of my refund which I requested copies an additional time on August 18. I’ve had no reply since.

This person was already sent there full refund. We do not store any credit card information here and we go through stripe. Stripe tried processing their refund but wasn't able to at 1 point and we investigated for them on their behalf even though they could have contacted their credit card company at any time . This person decided not to do that and they called an email that's incessantly even when we said we were investigating this and we were able to get them a resolution on August 18th. This refund has already been paid in at this point we consider this malicious intent on the part of this person and will be seeking damages and compensation.

    ********** ********

I am rejecting this response because:

I have not received a full refund. I still have not received the proper documentation showing when the refunds have gone through although I now see they submitted a document showing the partial refund). I have received a partial refund as stated in my initial complaint, and is proven by the document submitted by 350 farms. I am still waiting for an additional $145.31. As soon as I have received the full refund as promised, or the documents showing that the remainder of the refund was requested through Stripe, I will be content. Thank you.

    Sincerely,

We have submitted our notice of intent to proceed in seeking damages. We will not be communicating further except through an attorney. Credit card fees would have been deducted at At ax rate of approx 3%.  Again,  we believe this is an unfounded accusation and will be seeking compensating for malicious and purposeful damaging of our resputation and business by this comparing and numerous word of mouth incidents involving this person

    ********** ********

I am rejecting this response because:

I simply want the remainder of my refund. I’m not sure if it was thought only one transaction had gone through but there were 2 transactions that came off my credit card each for $141.25 as proven in the documents provided.

    Sincerely,
