I have recently closed my account with ************* and switched to *****. I paid two payments to settle the account, the first on Feb 28th for $500 (conf#******), & the second was the remaining balance for ****** on Mar 14th (conf#******). I have confirmed the account settled, however in the recent week I have been contacted by a CBV collection service that has bee aggressively hounding me to pay $253.14. I have submitted a screen shot of my account number and specifed the account number that the ********************** agency is not my account number, they are providing an invoice they say is from ************* for account number ************ (this is no where in my account documentation with ************* nor have I recieved any documentation from ************* regarding this acct#. I have raised this point to *** and confirme with ************* last week that my acount number was settled. *** will not provide me with any information regarding a contact at Direct for any person handling my file nor do they seem to respond to the fact that the account number they are referencing is not mine. Yet when I called ************* the account was closed. I have responded to *** that I will be in contact via a formal letter with ************* via the office of ombudsman or office of the Vice President. I would also request these threats against my credit profile be recinded until further clarification can be provided as to this mysterious acct # and any balances they feel are owed.

*** has been reporting a 6 year old collection account with account number ****** on my credit report which I don't recognize. I had mailed the company requesting them to validate it (documentation has been attached) through Canada Post registered email with tracking number RN809323243CA which they received on 16th January, 2025 with A ****** as the signatory (find it attached). It has been more than 4 months now and I still haven't received any response from them. As it has been more than 4 months that I requested it and clearly *** cannot validate this alleged debt, this collection account needs to be deleted immediately off my credit report or I would use my consumer rights and reach out to the *********************************** which clearly states that Collection Agency has to tell a consumer what they say an alleged debt is for.

      Business Response

      Date: 22/05/2025

Thank you for contacting our office regarding your concerns.  Please be advised that we take a consumer matters seriously.  We have reviewed your letter and I have provided statements of your ****** account, as well as ***'s provincial license authorizing us to collect in ********  In regards to the statute of limitations, the statute is 2 years.  This means that after a consumer defaults on a payment the creditor, which in this case is ****** has 2 years to initiate legal action against you to collect the debt.  While the statute is 2 years to pursue legal action the duration the account being reported to the credit reporting agencies is different. Unpaid debts can remain on a credit report for 6 years from the date of last activity.  I see in my review that the 6 years is coming up which means it will be removed in June, however this doesn't mean that collection activity has to cease.  Collection attempts can continue indefinitely.  I would recommend contacting our office to speak to one of our representatives in regards to resolving the matter.

If you have any further questions please let us know.

      Regards,

      CBV Collection Services.

      Thank you for your communication.

Please be advised that we have reviewed the information and have found that the consumer contacted us on 05/14/2025. The consumer claims that they have resolved the account. We have requested for a proof payment and the consumer did not want to discuss the matter further.

Kindly be advised that the consumer also sent an email on the same day 05/14/2025 advising that the file does not belong to them.

At this point in time, we do recommend that if the individual is in disagreement with the file, they should file a dispute with one of the major credit reporting agencies ********** or *******. The credit bureau would need to conduct an investigation on their end to determine validity of the individuals claim. We have provided the contact details for the credit bureaus listed below. We apologize for any inconvenience that may have been caused. Thank you for your communication and patience.

Please be advised that collection items are not removed from credit reports once they are paid, they are updated to reflect their status.  I have reviewed your account and can confirm that a release letter was sent to you, the file is closed as paid in full on our system, and your credit reports reflect that it's paid in full as well.  Removals do not occur just status updates.

      Business Response

      Date: 02/06/2025

Please be advised that accounts are not removed from credit reports, they are updated to reflect their current status, which in this case is paid in full.  The account will reflect that status, that the file has a zero balance and the file is closed.  This does not go against the Credit Reporting Act, the Act talks about consumers having their rights to request updates, but that is not in regards to removing accurate information, it's for disputes and discrepancies.

      Regards,
