      Strata VAS 2825 located at ********************************************, hereafter known as Strata is making a complaint against ****** ********************************************** a division of MacBeth Roofing Corporation located at ************************************************, hereafter known as MacBeth.Strata hired MacBeth to replace the roof of the above-mentioned building, per the attached quote, which formed our contract. MacBeth received full payment from ******. After completing the work, water leaked into a top-floor condo unit and the units below. ****** hired an independent contractor to investigate the cause of the leak (report attached). Deficiencies in MacBeths work were discovered as follows:1. No drainage mat was installed below the insulation. 2. No filter cloth was installed per best roofing practices. 3. No paver pedestals were installed per MacBeth's proposal. Without drainage mat installation, paver pedestals are mandatory. 4. No screws and plates in the large, exposed area were observed per MacBeth's proposal. 5. There is a breach in the *** roofing membrane field area which caused water to run between the *** membrane layers, eventually breaking through to flood the suite below. A leak at the perimeter, as suggested by MacBeth, would have shown up on the drywall of the ceiling or wall below, which is not the case.6. A skylight was left covered in a tarp. ****** contacted MacBeth by phone and email to attempt to claim repairs under warranty on Oct 26, 2024 but received no response from MacBeth until Dec 3, 2024. ****** was forced to hire a contractor to tarp the roof to prevent further leaking. MacBeth eventually sent personnel to conduct their own investigation (report attached). MacBeth has not responded since. Strata wants MacBeth repair the roof and damage to the building resulting from their improper work and to pay for Stratas cost for tarping the roof, in accordance with the terms of our agreement and MacBeths warranty.

      Hi Macbeth Roofing Investigated Roof with 2 senior ****** attending. A detailed roof report was forwarded itemizing all issues and recommendations. I tried a few times to call ***** (strata ***** Was told email only. Macbeth is more than willing to again meet strata on site to review and discuss all concerns. I will personally attend this site meeting. Please let us know Time and Dates that will work, Thank You

      I am rejecting this response because: the third party company we hired disagrees with your assessment.  We don't need another inspection by MacBeth, we need to know whether or not you will honour your warranty and fix the damage.  As stated in my email to you (copy attached):

      We need a response from you so we can move forward with repairs. 

      We hired a third party contractor to independently determine responsibility for the damage and based on their conclusions MacBeth needs to take responsibility for the deficiencies and damage noted in their report.  This is not up for debate, we would simply like to know whether MacBeth intends to complete repairs under warranty or whether we need to hire another contractor to complete the repairs and seek compensation for our damages later.

      We have paid in full for work that was not completed as specified in our contract and we would like to resolve this without having to take further action against MacBeth.
