    On or about July 20th, 2023, the following unfair or deceptive act occurred: I had given 2 deposits of $2,865 equaling to $5,730 for a potential tiny house build in ***************, ********. I had signed a contract with Nomad specifying my rights and I could get my deposit back if anything happened financially. Within the 30 days, ******* was not able to get me financed as he stated his financing person has fallen through with proof of emails stating this. I have asked multiple times within the 30 days to receive the money back and they have not fulfilled my request. My sister, ***********************************, who was working on a separate project (after our original project stopped due to non-buildable land), had contacted them and requested the funds back for the project that was never started or completed. They also deceived the bank when I requested the amount back and left out the 30 day refund paid if I was not able to get financing within 30 days.

    While the signed contract with this purchaser does state that the deposit is refundable if financing cannot be obtained, it is also limited to 30 days. Upon signing the purchase agreement, we immediately connected the purchaser with serval financing partners who we assume that they applied with. After considerable effort by our team to confirm the feasibility for her project, the purchaser decided that they were no longer interested in pursuing the development of the property because of specific local political conditions. The purchaser then decided to continue the development feasibility on a second property they owned in another state. Continuing our professional services free of charge, our team assisted with feasibility on the new property, which involved a full set of preliminary as-built drawings for review by her local planning department. The purchaser then decided that she did not want to pursue the development of the second property due to personal challenges with neighbors. Working with the purchaser on two development options well exceeded the 30-day refund period and we estimate that the value of the of professional work involved exceeded the amount of the deposits in place.

    That is not a valid response as I have nothing to do with her property or separate project in **************. This is strictly for my deposit that I put down on my own singular Tiny Home (there were two). I am requesting my money to be sent back to me as this goes against your own contract before getting going to court for this matter and getting Lawyer fees added on.

    We understand that ***** had a separate contract; however, communications and management of the purchase was handled by another acquaintance or family member. As each contract states that deposits are non-refundable this would also apply to Frank's contract. If ***** wishes to continue with the acquisition of the NOMAD Cube components and building permits, NOMAD will be more than willing to assist in moving things forward.
