    Robert ******* **** ************** ***** contacted 17 Pools to construct a 40x8 foot container pool. We had a conference call to designed had an approved design around April 13, 2023.Robert wired money to them for $****** USD. The pool was to be delivered in July 2023 but 17 Pools have been claiming delays in construction since July2023 to the present Dec 2023. No proof of pool construction has been sent to either of us: no pictures or video. They will not return emails or phone calls to my builder, Robert *******. 17 Pools is emailing me claiming the pool is finished and asking for a crane at delivery but they are not providing a delivery date. ***** ******** **** * *********** ********* **** ****** ****

    Kurt ****** from Seventeen Pools asked us to wire a $***** deposit for a container pool. He has since taken our money and we have no pool.     Made down payment to Seventeen Pools for build and delivery of shipping container pool. Signed contract to build on July 4, 2022. Paid deposit of $****** with contract promise to deliver in about three(3) months. Kurt W*****, Seventeen Pools owner, has said pool is ready for delivery since September 2022. In emails on the following dates, Kurt said, 9/27/2022, "just about ready to go here." 9/29/2022, "Please let us know when you are ready for pool and we will deliver it." I replied that I was ready for delivery. He has since said several times the pool was ready but has yet to deliver. As per the attached building contract: Seventeen Pools have repeatedly failed to follow through with promises of sending me progress photos of the construction, and have failed outright in confirming a date of completion and delivery. Seventeen Pools has failed to assist in finding me a local installer in TX to install the pool when it arrives. Seventeen Pools have failed to complete construction on, and delivery of, the agreed upon pool within 3 months of the date we signed the "shop drawings" (July 11, 2022) as more than triple that time has now passed. I did finally receive a photo of the pool, January 10, 2023. The pool was built to the wrong drawings.

    Kurt, the owner of the company has been telling me that my pool is ready and on the way for 7 months. When in fact, I ordered a pool that was already made. I've called about 20 times and nobody returns my call and Kurt replies with a broad text saying that he will call back and never does. We paid over **K and they have not performed.     We have fully paid for a 20ft container pool from seventeen pools but have not received a pool from them. They have been telling me multiple time over the past 6 month that it is shipping but it never does. They keep blaming it on the shipping company. I have offered to pay extra if needed to get a different shipping company so that my pool can actually be shipped. Seven pools will not answer the phone and talk to me but so for they are at least responding to emails. It this point, I really don't know if the pool even exists that I paid for.

    An agreement was signed on June 3, 2022 that Kurt ******* Seventeen Pools, was to produce a 40' container pool for agricultural use. Amount agreed on was CAD$30,000, which included delivery fee within 60 days upon signing off pool design. The design was signed off on June 9, 2022, thus delivery date was set mid August. First installment of CAD$15,000 paid on June 7, 2022 and 2nd installment of CAD$12,000 paid on June 10, 2022. The 3rd installment of CAD$5,400 will be due before the pool leaves Winnipeg Manitoba. After the 2nd installment was paid, Kurt ****** started making numerous ***** promises that he'd send photos of the pool and prep-plans so we could prepare for excavation. It was not until Sept 2, 2022 that ****** finally sent a very blurry video and photo of the pool after we requested for a refund, but the drain holes did not match with the design that we agreed on. The video looked like a poorly made demo .gif file which had a pool lining that changes color and the photo was just a snap-shot of the video. On September 12, 2022, Wittin sent a Bill of Lading file to us and requested that we fill out the consignee info AND sign the document. We confronted him that we have confirmed with the transportation company that the document shouldn’t be signed prior to delivery of the pool. ** **** *** **** ***** **** ******* **** * ***** ** *** ********** *** **** **** *** **** ********** ** *** ********** **** **** *** **** **** **** ******** *** ***** *** ***** ****** **** we requested that he disclose the actual location of the pool and we’d like to see the pool in person prior to making the last payment. He never answered our request, ******* ** ********** ** **** **** *** ** ** ** **** ***** *** **** ********* On September 19, 2022, ****** delayed delivery again.

    We can appreciate the customers frustration with this but at this point in time the pool has been built and the funds have been invested in to the product, *** ******** ** ******* ******* **** * ****** ** ******** ******* ***** ** **** *** *** *** **** ****** *** ***  If the customer chooses to have a refund we will deduct all the work that has been put in to the product and refund what we can, If the customer chooses the pool can be sent to the customer as contracted and that is the result that we would like to see, Unfortunately we have been understaffed this year and that is why we are having some delays

    I ordered a shipping container pool from Seventeen pools with Kurt ****** in March 2021 with a contract to have it delivered May 2021, I paid a 31,500 deposit and have not received the pool. Kurt has refused to deliver the pool or return my money. He has repeated **** about building the pool and delivering it. ************************************************************************************** He continues to***** about delivery of the pool. He promises delivery about every month and never does. He will not return calls. after almost 1.5 years I have nothing and cannot get my money back. Extremely frustrating. **************************************************************************************

After the customer had started using abusive and threating language towards us we have cancelled this contract. *************************************** We have also advised the customer that he can pick up his pool at his cost and furthermore will be charging a 32 dollar storage fee a day until the pool is picked up. If it has great but that would involve returning my $31, 150. If you can get him to confirm when the funds would be returned that would be great. He is correct that I have been upset with him... but he has ************** not delivered after more that a year delay, my response is completely justified. Kurt sent a video of a pool to me over the weekend, it appears to resemble my order (though no cover, dirty, dented and the video just shows the outside). He is required to show me the pool operational and have it delivered to my property per the contract. I am a little puzzled that he wants to charge me for something I have no idea is mine or operates. Why would he not just fulfill the contract as he has told me on several occasions that the pool will be delivered?
