I am rejecting this response because:Flawless did not complete the job and was terminated. Their failure to meet deadlines cost the homeowner significant amount of added expense and lost rental income. The company was paid in full, respectively, timely with the intent to ensure that the job was a priority and this was not the case. Jory continued to benefit financially from all the work that he choose to complete...not one time did he raise to the homeowner, any additional work conducted by himself or company would add delays. The delays were caused by Jory. Jory was fully aware that the incoming tenants were arriving to Winnipeg towards the end of September and still was unable to complete the either scope in full by the end of September, the first of October, the middle part of October when he left for Calgary and the first of November when he was terminated.
Payment and scope:
Flawless was paid for the original scope of work (not completed and work that is complete is of poor workmanship and will need to be corrected at a future date) to the total of $******
Flawless was paid $**** for additional work in the basement and laundry room.
Homeowner resolution:
Flawless to pay the funds owed to the plumbing company for the amount shared, $****
Flawless to pay the funds owed to the electrical company for the amount shared, $***
Flawless to refund homeowner a total of $*******. This is to be paid via certified check made payable to the homeowner within 2 business days upon settlement. This leaves total amount paid to Flawless of $****** for work incomplete and of poor repair.
Flawless to issue homeowner receipts for funds paid
Jory has represented himself as the company owner and is responsible for the quality of the work of the company and his employees and has been ********* in the duties to complete quality work.
pe of work committed to for laundry room, basement ceiling work (drywalling ceiling and painting) $****, funds paid on 9/13 and 9/14.
Sincerely,
Ian ******
Upstairs work was nearly completed on or around October 10 as tenants moved in and could only occupy the main floor. Work completed was of poor quality. The deficiencies include: recurring plumbing fixture issues, tile cuts, tile grout, painting, finishing of doors and hardware, poor carpentry. Some deficiencies shared via text on October 20. Jory was asked to walk the deficiencies on 2 occasions with the home owner and he did not.
Jory was terminated from the job on November 7 due to poor quality of work. Nearly 5 months since agreed upon contract, work was still not done. Multiple expenses and loss of revenue were incurred by homeowner.
Multiple attempts to contact Jory for resolution, compensation and refund have gone unanswered since termination.
Jory was paid in full and did not fulfill his contract nor deliver result that his company name communicates.Business Response

*** ********* ***** *********
*The original scope of work was 2 bathrooms
10 doors baseboards casings closet rods and shelving
The homeowner failed to tell me the roof was leaking water
So what happen was we had all the doors taken out ready to install new ones
It had poured rain a day later I came into water coming in through a couple headers where doors would have been placed
So, I called ian to tell him he said I know but roof can’t get done until end of Oct early November
So, I did the roof for him within 2 weeks to have it watertight which was 3-4 weeks faster than other company
So that put a delay on the project as I didn’t feel comfortable installing doors that would of gotten ruined in the process so I took upon myself to save that headache and save customer money for not having to replace doors a second time
The bathrooms
Plumbing was not up to code so plumber had to pull permit do the work which consist of
Back water valves
New abs in the concrete
New water lines
New stack
Couldn't repour concrete until inspection
Inspector took roughly a week to come down to inspection which passed
But that took and damper on timeline couldn’t close any walls until inspection happen which I told Ian that was the issue he seemed not to care
The spray foam was next but due to roof leaking
And moisture in roof and walls they couldn’t spray foam because all insulation was taken out to be spray foamed in attic then blown in over top with the roof leak once the roof was repaired and closed up I had to run fans in attic to dry everything up which was 2-3 days plus walls
Which again I told Ian about it
I couldn’t close outside walls until spray foam was done
Everything else was closed until spray foam was complete then I finished closing up the walls
Ian also wanted some electrical work done which was also another permit pulled and completed ie add a switch we had to add in a fan and duct work
Which had to get cored through concrete and all duct work complete before I was allowed to close it up which required a inspection which was not part of original quote that I was not paid for either
Upstairs bathroom had to get a gfci plug installed which was part of the permit
There was also extra drywall mud/taping he wanted done on duct work
He also wanted more drywall in laundry room on the bathroom wall
He paid for the drywall under duct work but not the bathroom wall
We also removed carport that he wanted removed
New garage door since old one broke
He still hasn't paid plumber *******$ for work that's been complete he still hasn't paid electrician ***$ for completion of work that they wanted done
For grout lines not being perfectly straight it happens things shift and settle I also had told Ian it needs 24hr dry time before I grout it
He was adamite that I had to be done with in 24hrs as his kids were moving In I did tell him it needs time to dry but he said I don't care please have it completed
So I completed it I was there till 5am tiling came back at 10 and started to grout which didn't have enough time to dry which cause tiles to move
As for deficiencies he claims I never went which is a ***
I went down on a weekend me and another guy
We went through the project in basement then canceled to look at everything upstairs because they were getting new appliances installed
I took my time out of my weekend away from my family to compensate him for him to cancel the walk-through upstairs
We had come up with plan for basement which I was on schedule for
Once again, he added more stuff to scope that I wasn't paid for which was self-leveling the floor on the concrete
Which was not part of original scope
After he fired me to hire someone else, I went out of town to work which I had terrible service
I managed to get wifi and told him that I didn't have good service where I was and I'd get back to him as soon as I could
So for him to say I never responded is irrelevant
I did extra mudding / taping for him on walls and repainted at no extra cost to try and be nice and go above what was asked

I am rejecting what Ian ****** has to report
Why is it when I told him I wasn’t going to be done he had told his ****(renters) that they can't go in for a couple extra days and placed them at the hotel for a few extra days they could have moved in I would of finished last bit of things and help them settle in
Job was not completed cause I was terminated I was there wanting to continue the project and finish it but he never let me and wouldn’t allow me to fix anything he didn’t like as I said before I went on the weekend to look over everything but he canceled upstairs walk through
I followed up many times agreed to fix anything that they didn’t like which wasn’t sufficient enough for him
I had told Ian many times that there were delays with city inspector
Water coming in through roof which resulted to spray foam were not able to spray foam cause of to much water and spray foam
Wouldn’t set or stick properly
I had fixed the water issue 1-2 months earlier than the other company who couldn’t touch it till end of oct which would of resulted to all finishing work to have to be redone which I had told him that was well
I don’t benefit from anyone I've always been an honest person I got nothing to hide
I have proof of email from Ian ****** stating he owes plumbing company ******* which will be shared in this complaint showing it wasn’t paid
After Ian terminated me and I was no longer there he hired my electrician who pulled the permit and failed to pay him after I was terminated so I am not required to pay his bills
Ian wanted to hire someone else to do the project that was his choice I did what I could and he failed to let me finish or fix any work that he wasn’t happy with
I cannot control the fact he ********* his property and didn’t have water issues fixed earlier he knew about it a long time ago
I also can't control when city inspectors can show up to do inspections and legally not allowed to close any walls until inspection was completed which was explained to him as well
I am willing to fix anything that’s he doesn’t like
Part from that I went above and beyond what was suppose to originally be done
