I am writing to formally lodge a complaint against Sudbury Towing LTD regarding an incident that occurred on August 9th. My vehicle was towed by Sudbury Towing LTD following an accident on August 4th, and I have encountered several issues with their service that I believe warrant your attention. Firstly, despite my repeated requests, I was not allowed to retrieve my personal belongings from my vehicle. This refusal persisted even though I had not yet paid the towing fee. According to my understanding of Canadian law and after consulting with my lawyer, tow companies are required to allow vehicle owners to access their personal belongings, regardless of the payment status of the tow fee. Secondly, when I attempted to discuss this matter with the owner of Sudbury Towing LTD, he became extremely confrontational. His behavior was unprofessional and intimidating. Furthermore, his wife physically pushed me out of the store, which I found to be completely unacceptable and distressing. Additionally, I have heard from many others who have experienced similar issues with Sudbury Towing LTD. This pattern of behavior is deeply concerning and suggests a broader problem with their business practices. I am deeply concerned about the conduct of Sudbury Towing LTD and believe that their actions are not only unethical but also potentially illegal. I am seeking your assistance in addressing this matter and ensuring that such behavior is not repeated with other customers. I would appreciate it if you could investigate this incident and take appropriate action against Sudbury Towing LTD. I am also requesting that they be instructed to allow me to retrieve my personal belongings from my vehicle without any further delay or confrontation. Thank you for your attention to this matter. I look forward to your prompt response. Sincerely, *********** ******Business Response

Mr ******, I red carefully your complain.
Your vehicle ****** was towed by the RCMP last August 4/2024 after you had an accident You choose to drive without valid registration under your name and without valid insurance. The ****** is a total loss!!! According to you it's your vehicle so take your responsabilities and pay the invoice as we dont work free. We told you to help you, we would not charge storage fees.
You came to our office last August 9/2024 to mentioned the human rights and you were talking about your lawyer while letting your friend negociated for you. As your ****** is a total loss, you could sell your vehicle to a scrape yard but you cannot do it as the ****** is not under your name legallly !!!
The only prescription that was in the ****** was the illegal drug that was seized on site of the accident by the RCMP when you tried to escape the accident site. You are complaining about beein push out of our office, you didn"t see our 16 cameras that record 24/7 at every angles ? All the complains we received are about the money, customers dont want to pay their invoice, customers choose their own insurance's coverage so dont blame us ! As soon as you"ll pay your invoice, we'll give you your laundry .

I am rejecting this response because:
Thank you for your response. I must respectfully reject your proposal for the following reasons:
Legal Rights: According to Canadian law, tow companies are required to allow vehicle owners to access their personal belongings, regardless of the payment status of the tow fee. This has been confirmed by my lawyer. Therefore, I should not be required to pay anything to retrieve my personal belongings from my vehicle.
Personal Belongings: I had more than just laundry in my car. My vehicle contained three brand new ****** 15 Pro Maxes, a ******* Galaxy Note laptop, and a small sum of money. These items are of significant value and importance to me.
No Criminal Charges: The police did not charge me with possession of illegal drugs or any other criminal charges. Therefore, any claims regarding illegal substances are unfounded and irrelevant to this matter.
Proof of Ownership: I have provided you with the bill of sale and insurance card, which clearly demonstrate my ownership of the vehicle.
I am seeking your cooperation in allowing me to retrieve my personal belongings from the vehicle without any further delay or confrontation. Additionally, I request that we address the outstanding invoice in a professional and respectful manner.
Thank you for your attention to this matter. I look forward to resolving this issue amicably.
Sincerely,

I do not have time for the lies, Constable P.is on charge of your file and he agrees that you pay your invoice if you want your clothes.
your vehicle is lock, we don't have the key.
As soon as you'll pay your invoice, you'll have your stuff. We don't work for free. You can sell your vehicle to a scrap yard.
Again to help you, we charge no storage.
You can tell your lawyer to come to see us, so we'll give him our lawyer's business card
No need to repeat all the time the same things, simply pay your invoice.

Owner of Sunbury towing wouldn't help with a boost or a pull onto a trailer from in his yard. Offered to pay. Yelled at me and my friends yelling "***** ***** ******" and I said wow that's real professional and he says "yes it ******* is". Wouldn't recommend to anyone or ever call this company. I'd call a truck from fredericton or something. Even pay for one from saint john. Just not sunburyBusiness Response

June 16th/2024: The **** 2500 diesel was impounded by RCMP request as nothing was valid with the vehicle: no valid registration, no valid insurance no valid driver license as you are a suspended driver ,
June 17th/ 2024: You came at our yard screaming at us, we had to phone RCMP to calm you down ! You then paid the invoice to have your **** 2500 Diesel release from our compound. We then aggreed to keep your vehicle free in our yard as you couldn't drive it away as you have no valid driver's license.
June 18th/ 2024: A woaman came by herself with a ****** car dolly rental blocking our yard for several hours, you never came yesterday as you send friends. A boost wouln't star the **** 2500 Diesel as it need to be fix, your friends tried for minimum 2 hours to boost it. We couldn't load the **** 2500 Diesel on a car dolly as it wouln't be secure, the **** 2500 Diesel is way too big and too heavy for a car dolly. The **** 2500 Diesel is not your vehicle as it's not legally registered under your name so under the law you have no right about this vehicle. Our yard and building are monitor 24/7 by many cameras with sounds as well as our phone's lines. Please phone another towing company to deal with your bad temper !

I am rejecting this response because:
1. The truck is registered to my girlfriend. Yes it was impounded. doesn't mean it's not ours.2. You didn't calk the rcmp. I did who do you think I called before my bank.
3. There were damages to the truck from you securing it to the truck by the ball hitch.
4. Your customer service and general respect is lacking. Your wife ran out screaming like a lunatic

My snowmobile was towed by the RCMP for being left unattended because I broke down the night before, the 16th Feb. Sunbury towing is the business that towed it, on Feb. 17th. The snowmobile is around 400 pounds and they only towed it 11km and charged me $747.50. They overcharged me, and I’m sure other customers because we have no other choice but to pay it to get the vehicle back. I talked to an rcmp officer about it and he told me that RCMP quote for a similar job is around $150 to $200 and recommended I go through BBB. They also wouldn’t release me my snowmobile on the 18th Feb. because they claimed there was no one in the office and told me to come back the 21st Feb. when I came back on the 21st the owner of the business wouldn’t release me my snowmobile because he claimed I didn’t have the proper documentation, which I knew wasn’t correct. So I had to phone the rcmp to get the owner to release me my snowmobile and they were closing at that point so I had to come back the 22nd to finally get my snowmobile back. On the recipe I got charged $300 for towing, $200 for storage, $100 for “winch”, $25 gate fee, and $25 for something I couldn’t make out on the recipe.Business Response

On a stormy day, last 17 feb/2023 at 16.05 pm, we received a RCMP's Emergency call to tow an abandoned snowmobile(that wasn't legally register) on Tch 2 marker 292 in the ditch.
RCMP couldn't tracked down the owner so they ordered us to tow and impound it.
Any RCMP's Emergency call, start at 300 $, it's not a question of mileage, its a call that request us to be done NOW.
By the order of RCMP, we could release the snowmobile at the register owner only. The first time Mr. ****** came at our office on the 21st Feb/2023, he didn't has the proper paperwork on him. Mr. ****** was rude, loud, impatient. He even asked us:"What kind of way do you run your business ? "
To calmed him down, i accepted to stop the cost of daily storage (40 $ + tax = 46 $ rebate for him. I want to mention that our office and yard are monitor by security's cameras.
The invoice was 300$ Emergency tow+200$ storage (5 days at 40$ )+25$ gate fee(admin fee)+25$ flat bed+100$ for a winch+ tax.It was paid Visa on 22 Feb/ 2023.
We understand being tow is a stressfull experience as it's an unplan expense that create a lot of frustration, we double checked yesterday with the RCMP's office and RCMP dont quote
towing business price.
We even had to contact the RCMP after the first visit of Mr. ****** for them to tell him to calm down when he would be back at our office.
Being that said, there will be no billing adjustment

I am rejecting this response because:
What they’re doing is criminal, the facts are that they overcharged me because I had no choice but to pay the fee or not get my few thousand dollar snow machine back. A quote to tow my snowmobile from any other towing company is significantly lower than what they charged, only takes some phone calls to verify this. If I phoned them to do this job, whether it was snowing or not, they would have charged me significantly less. That in itself shows how blatantly they’re ripping “customers” off. They’re taking advantage of people in already bad situations, literally anybody would tell you it’s no way to run a business.Business Response

I already answered the complain yesterday.
there will be no billing adjustment. On his first complaint Mr ****** said we overcharged him and today according to him we are criminals…
