    Business Response

    Date: 13/10/2023

    hello there,

*************************** was a person I hired a few years ago, who had no experience doing construction work. I thought he was a good employee and had lots of energy and soon found out he was an ex-con who had been selling drugs, and while working with him found that a lot of equipment would go missing. He was the only one on the job that had a license in a vehicle so if he was picking everyone up, he was the only one that couldve removed by tools and equipment offsite.

Its a crazy long story, but several jobs he worked on with me . He tried to take the job over from the customer who sometimes customers go along with this trying to save money. He took over three jobs that I have had with me losing at least $200,000 in work at this point which I can document with signed contracts with the customer.

The latest one that hes complaining about was after I brought him back after , working with him during the summer. He messed up quite a few jobs that had to be redone and resulted in losing customers because the work was done so poorly or not done at all. Each time I paid him as a subcontractor to do the work.

Recently, he called me back which I have all documented in text messages and asked to come back at work. I told him I didnt want him working with me because of the past experiences I have had. I outlined a contract with him, which told him the only way we work together again is if he  agreed to work week in arrears, if any tools went missing, I would hold back that money, if any jobs were lost to him. Obviously, I would haul back that money.

He came back and worked for about four weeks which I paid him at the end of the second week for the first week he had worked. He had agreed to work as a subcontractor with his money held in arrears, and after complaining that he didnt want me to hold the amount back , I paid him for the work he had completed the second week, which was basically double what he had done the first week. From there I told him that I would hold back that final week in arrears indefinitely.

Still the conditions remained as outlined above, that if he stole any tools or any tools went missing , or if he attempted to take over the project that I had spent six months getting with clients that I would hold back a week of pay to cover the tools stolen, as well as he agreed that if he missed any days, he would not be paid for the week because this was another complaint I had about people not showing up.

I had a new project started near omemee that was worth about $17,000. I had a signed contract with the client and I started the work with **** asking to work on this project since he was close to his house. I agreed. The client had paid a deposit of  $4000. **** was hired as a subcontractor to do this work but went to the client and asked him finish the job where they would pay him instead of me for the remainder of the contract and the remainder of the work that was completed.

In the end myself and three other people **** being one of them completed $8600 worth of work which the customer verified but the customer said they would not pay this amount to me. They would pay it directly to **** and they would not have me finish the job. They were complaining that **** was left alone to work on this job . This was only done because he had requested to work on the job since he lives close by. The address on this file is not his address he just doesnt want me to see his actual address which is now in Millbrook.

He continue to tell me that he was going to take all my jobs away from me if I didnt pay him for the last week in arrears. I asked him to return the tools which he refused to do. He told me he had a tool left on a job site where he had worked with me. I sent him the money for the tool in excess of its value although I couldnt find the actual tool he was looking for.

On the weekend last weekend, he went to the customer and convinced him to let him into the blocked job site, which is a restaurant in Sterling, and proceeded to steal my tools which is now , going to go through a police investigation.

Recently, **** also asked the police to help him get money For this week in arrears which I told him I wasnt going to pay him till he returned my tools. The police officer agreed. This is a civil matter and told me to ignore ****. He called **** and also told him that if he had a problem as a subcontractor, he would have to take it to small claims court, but suggested to him, that what he had done repeatedly to me was unethical.

I will attach a few pages of the text message correspondence thats been coming from him where he continues to threaten me in various ways.

Please call me if you have any questions about this.

I know Ive got some bad reviews on here but they are being dealt with and where necessary I have paid back clients  for things theyre frustrated about. For the most part, my problems over the last three years have been from poor quality employees that lie about their hours. When I work on my own, I can achieve a five star review with clients as soon as I try to bring someone else in the quality of their work is devastating to my company.

    Cheers,

I hope you find this letter helpful.

This company is now conducting business as Next Space but it is the same person. He is a CON. He took 50% deposit from me and never came to do the job. I have subsequently found that he is involved in MANY claims against him. Reviews and going to court are not enough. This person needs to be charged criminally as this is an ongoing pattern--taking money from the client and never doing the job. I am doubtful I will ever receive my deposit but hopefully this will help someone else. ** *** **** ********* ******** ** **** ****** ***** * *** ****** ****** *** *****
