The reason for this letter is to report a business in Huntsville who has stolen money from me by not giving me the money she sold my goods for. First of all, I signed a contract with Lotus Estate Sales on June 23 for an estate sale to be conducted on August 5, 2022. When she had not come to set up tables on August 4, 1 called her, and she told me that she had actually scheduled my sale for the following week but did not know why she had scheduled it that way. On June 23, we had discussed the fact that our house was sold, and the new owners were moving in on August 8, so the 5th of August was the latest it could be held because we had carpet cleaning scheduled for the morning of August 6, 2022. August 5, 2022, Diane sent me a text saying, "I am not charging you any commission because I haven't done much."
Then she sold two chairs from the front porch to the new owners for $80.00 cash and did not report this to me either. On the morning of August 5, she sold my estate merchandise to a man, unknown to me, and according to the new owner of our house, the man wrote her a check for the entire collection.
August 17, 2022, I still have not received the check. I sent her our new address via text message. (It would have been forwarded via the post office if she had sent it to our previous address.) There was no response from her to my August 17 text message, so I sent a reminder by text on August 19, 2022, Sept 12,I was in Huntsville, so my husband and I went to her house. Her car was in her driveway, and when I I rang her Ring doorbell, she refused to come to the door and kept saying "I can't understand you".  Sept 12, 2022 I sent another text explaining that I trusted her when I signed the contract for the estate sale for Aug 2, 2022 and she let me down by not keeping her end of the contract.  Diane admitted in her response that she owes me $280.00 and that she will mail it to me on Sept 13. Again, what I provided for the sale was worth far more than the $200 she sold it for to one person.

    Business Response

    Date: 11/09/2022

Good morning,  first, I apologize for the delay in answering the Better Business Bureau. Secondly, I apologize for the delay in answering Mrs. *****.

The estate sale we had planned for Mrs. ***** turned into an altogether different matter, or there was a few items stacked in the corner of the dining room that we were to sell, at the same time as the new homeowners were moving in. Based on that, we determined there was not enough items to hold a sale, our company was wracked with Covid during this time, and frankly, the new homeowners did not want us there. We called a company out of Fayetteville to give us a quote on buying what was there, they agreed on a price of $200. I had to make the check directly to Mrs. *****. The homeowners purchased the rocking chairs on the front porch for $80 in cash. I have mailed to Mrs. ***** the check from The company in Fayetteville, as well as my business check in the amount of $80.

Again, I do apologize for the delay, and hope this will be satisfactory.
